To all concerned:
At this time everyone has had one opportunity to write to Mr. Causseaux. We have a level
playing field in that regard. There is no authority or reason for any more correspondence
to go to Mr. Causseaux prior to the hearing. Each time a letter goes to him it costs the
County money since we pay Mr. Causseaux an hourly rate.
I am not clear from the last e-mail from Mr. Powers if he intends to write to Mr.
Causseaux again or simply to Mr da Sa e Silva, although the latter route seems unlikely.
I may be misunderstanding what Mr. Powers intends to do and if so then I apologize. But
if Mr. Powers intends to write Mr. Causseaux again, that second letter will only escalate
into a never ending flurry of letters.
This must not happen as it would represent yet another ex parte communication. The only
reason that the applicant and the County wrote to Mr. Causseaux was because Mr. Causseaux
specifically asked for a response from us. The County sees no reason to pay for Mr.
Causseaux to read any more letters that attempt to "try" the substance of the case prior
to the hearing.
If there is any additional correspondence to Mr. Causseaux or his office before the
hearing date of November 3, 2006 relating to the topic of that November 3 hearing, I am
instructing Mr. Causseaux's office to not open the letter or e-mail and to return same to
its sender.
Comment letters can be sent to DCD in accordance with whatever deadline was established
for such comments. That is the proper avenue for comments, concerns, legal arguments,
photographs, etc.
