WHEREAS, the Jefferson County Board of Commissioners has reviewed a road vacation petition
submitted by Wefore, LLC; and
WHEREAS, the Jefferson County Hearing Examiner held a public hearing on the road vacation
petition on May 16, 2006; and
WHEREAS, the Jefferson County Hearing Examiner considered testimony of the public, comments
from applicable departments, agencies and offices, the recommendation from Jefferson County Public
Works Department and Jefferson County Department of Community Deyelopment at the public hearing;
and
WHEREAS, the Jefferson County Hearing Examiner has determined that the public will benefit
from the vacation of this usage road and such vacation complies with the Jefferson County
Comprehensive Plan and other applicable plans, policies or ordinances; and
WHEREAS, the Jefferson County Board of Commissioners has considered said Hearing ExamiIler's
report of the public hearing and his recommendation for the vacation request and hereby adopts the
Findings of the Jefferson County Hearing Examiner dated May 30, 2006; and
NOW, THEREFORE BE IT RESOLVED that the following be vacated and abandoned pursuant to
RCW 36.87.140 and Jefferson County Road Vacation Ordinance No. 01-0102-96: Harrison Street as
presently built and maintained by Jefferson County and as shown on the face of the plat of Tukey's
Addition, as recorded August 23, 1889 in Volume 2 of Plats at Page 20, records of Jefferson County,
Washjngton, lying Easterly of Cape George Road.

SUMMARY OF REQUEST:
The applicant is requesting approval to vacate that portion of the usage of right-of-way
known as Harrison Street.
SUMMARY OF RECOMMENDATION:
It is hereby recommended to the Board of County Commissioners of Jefferson County that
the Jefferson County Road known as Harrison Street be vacated subject to meeting
applicable regulations.
PUBLIC HEARING:
After reviewing the Jefferson County Department of Public Works Report and
examining available information on file with the application, the Examiner conducted
a public hearing on the request as follows:
The hearing was opened on May 16, 2006, at 1 :00 p.m.
Parties wishing to testify were sworn in by the Examiner.
The following exhibits were submitted and made a part of the record as follows:
EXHIBIT "1" -
County Road Vacation Petition with Attachments A-I
Appearing was KELLI LARSON, the representative from Jefferson County Department of
Public Works. She discussed the County road vacation petition as requested by WeFore,

LLC. The request is to vacate a usage right-of-way known as Harrison Street. The street
only provides access to the subject property and the golf course parking lot. The applicant
is proposing to reconfigure the lot and accesses. Notice of and request for comments were
made to all appropriate agencies. All agencies that responded are recommending
approval of the request. The Department also recommend approval. The appraised value
is $7,800.
Appearing was MIKE ASMUNDSON, the representative from WeFore, LLC. The applicant
is requesting vacation of this right-of-way so that they can reconfigure the accesses to the
golf course. The road only services the golf course. All land surrounding the road is
owned by WeFore, LLC. The applicant has other permit requests regarding accesses to
residential properties. There are going to be 30 homes in this area. It makes more sense
to reconfigure the accesses because it will provide better access for the ultimate users.
No one spoke further in this matter and the Examiner took the matter under advisement.
The hearing was concluded.

FINDINGS, CONCLUSIONS AND DECISION:
FINDINGS:
1. The Hearing Examiner has admitted documentary evidence into the record, viewed
the property, and taken this matter under advisement.
2. Road vacations are exempt from SEPA, per WAC 197 -1,1-800(2)(h).
3. Notice of the public hearing was mailed to adjacent property owners on April 11,
2006. Legal notification of the public hearing was posted on May 3, 2006, and May
10, 2006. Notice was posted at the site by the Department of Public Works on April
21,2006.
4. The applicant, WeFore, LLC., submitted a petition to vacate a Jefferson County road
on March 22, 2006. The road is legally described as follows:
All that portion of Harrison Street shown on the face of the plat of
Tukey's Addition, as recorded August 23, 1889 in Volume 2 of
Plats at Page 20, records of Jefferson County, Washington, lying
Easterly of Cape George Road.
The stated reason for requesting the vacation is that the street only serves the golf

course itself. The access for the golf course parking lot and the residential homes
surrounding the golf course is going to be reconfigured. Those permits are being
requested under separate application.
5. A hearing regarding the petition to vacate the road is required per RCW 36.87.060
and Jefferson County Code (JCC) Section 12.10.080. JCC Section 12.10.110
specifies certain criteria that must be reviewed prior to a recommendation being
made. Findings on each of these criteria are hereby made as follows:
'-(1) The property that is proposed to be vacated is designated/zoned as Rural
Residential. The road currently services as an access to Discovery Bay Golf
Club. Future development will be subject to all applicable plans, policies,
and ordinances of the zoning code. The future development will also be
subject to the Jefferson County Comprehensive Plan. The present request
will not violate either the comprehensive plan or other applicable zoning
requirements.
(2) Vacating the road will not create any circulation problems for the area.
Different accesses are going to be provided which will provide better
Circulation than what currently exists.
(3) It does not appear that any emergency services will be impaired by this road
vacation. All appropriate agencies were notified of this request and no
objections were submitted.
(4) There is currently a Puget Sound Energy line within a portion of the street.
The line only serves the golf course. Therefore, any potential changes in the
future will have to be borne by the golf course itself. The utility provider is
recommending approval of the vacation request.
(5) It does not appear that this particular section would be used for trails or
pathways. Access will be changed, but there will eventually be improved
access provided to all areas. The Jefferson County Parks Advisory Board
has no objection to the approval of this request.
(6) The area is not abutting any body of salt or fresh water. Therefore, there is
no problem meeting the criteria for related to RCW 36.87.130.
(7) The proposed location will not land lock any parcels of property.

CONCLUSIONS:
1. The Hearing Examiner has jurisdiction to consider and make a recommendation
regarding this request.
2. The petition to vacate a portion of Harrison Street, as presently built and maintained
by Jefferson County, as shown on the face of the plat of Tukey's Addition recorded
August 23, 1889, in Volume 2 of Plats at Page 20, records of Jefferson County,
Washington, lying Easterly of Cape George Road, does satisfy all of the review
'-criteria stated in JCC Section 12.10.110. Therefore, the Hearing Examiner
recommends that the petition be approved subject to the applicant satisfying all
other applicable provisions of the Jefferson County Code, including, but not limited
to, those sections relating to compensation as outlined in JCC Section 12.10.120.
RECOMMENDATION:
The Hearing Examiner hereby recommends to the Board of County Commissioners of
Jefferson County that the petition for vacation of a Jefferson County Road known as
Harrison Street be approved subject to the applicant satisfying all other applicable
provisions of the Jefferson County code, including, but not limited, to those sections
relating to compensation as outlined in JCC Section 12.10.120.
