Description of Proposal: Wetland and wetland buffer crossing for residential development.
DEVELOPMENT REVIEW
Land Use:
• Zoned – Rural Residential 1:5.
• State Environmental Policy Act (SEPA) – Required for wetland crossing. Submit a SEPA
Environmental Checklist.
Critical Areas:
The following critical areas are mapped or have been identified based on-site visits within the project area:
• Wetlands: Wetlands occur on the property, one of which will be crossed to provide access for
residential use of the property. A critical areas stewardship plan (CASP) report for CASP
permitting or a Mitigation plan for Reasonable Economic Use Variance permitting will be
required at the time of application. The report should be prepared by a qualified biologist and
should show compliance with Articles VII (wetlands) and IX (special reports) of Chapter 18.22
Jefferson County Code (JCC).
• Critical Aquifer Recharge Areas and Seawater Intrusions Protection Zones will be addressed at the
time of building application. No report required for wetland and wetland buffer permitting.
Stormwater:
• All projects are required to address stormwater. Complete a Stormwater Calculation Worksheet
along with any additional stormwater forms and submit at the time of application. All stormwater
plans submitted must comply with requirements in the 2019 Washington Department of Ecology
Stormwater Management Manual for Western Washington. Any proposal that cannot meet the
prescriptive standards must be engineered.
Permitting Process for Wetland Buffer Reduction:
• There are three wetland buffer reduction processes in Chapter 18.22 JCC: administrative
reduction up to 25 percent or less, critical areas stewardship plan, or reasonable economic use
variance. CASPs and REUVs are used to reduce a buffer by more than 25 percent.
• CASP: Type I permitting process, which is an administrative approval process. CASP reports
should be prepared by a qualified professional. Prior to issuing a building permit, the property
owner must post a critical areas performance bond with DCD and record a notice to title with the
Jefferson County Auditor’s Office. A CASP requires five years of maintenance and monitoring.
CASP regulations are in Article IX (special reports), Chapter 18.22 JCC.
• REUV: Type III permitting process, which is a quasi-judicial approval process. This involves
noticing the application and noticing a public hearing. Mitigation report should be prepared by a
qualified professional. The public hearing would be held before the Jefferson County Hearing
Examiner, who reviews the proposal for compliance with JCC requirements for REUVs. Five
years of monitoring will be required. REUV regulations are in JCC 18.22.260 and report
requirements are in Article IX (special reports), Chapter 18.22 JCC.
Application:
• Complete CASP application includes:
o Permit Application Form (for the description, indicate the submittal is CASP application
for wetlands and wetland buffers)
o Site Plan
o CASP (that addresses wetland and wetland buffers)
o Stormwater Calculation Worksheet (and any additional stormwater forms)
o Environmental Checklist
o CASP permitting fee: $1,925.70 ($679 – CASP application; $970 – SEPA review; $149
– notice of application; $12- notice board; $24 – scanning fee; $91.70 – technology fee).
The CASP permitting fee is in addition to other applicable development review fees.
• Complete REUV application includes:
o Permit Application Form
o Variance Application Form
o Site Plan
o Wetland and Wetland Buffer Mitigation Plan
o Stormwater Calculation Worksheet (and any additional forms)
o Environmental Checklist
o REUV permitting fee: $4,871.41 ($2,037 – REUV application; $970 – SEPA review;
$149 – notice of application; $149 – notice of public hearing; $12 – notice boards;
$1,298.44 – hearing examiner; $24 – scanning fee; $231.97 – technology fee)
• Building and septic application fees are in addition to those listed above.
OTHER REGULATORY/LAND USE CONSIDERATIONS
• The project will be reviewed by Washington Department of Ecology, who may also have
jurisdiction over the wetland.
• This project may need a permit from the U.S. Army Corps of Engineers. This agency has
jurisdiction over waters of the U.S., including wetlands, and issues permits pursuant to Section
404 of the Clean Water Act.
PRE-APPLICATION MEETING LIMITATIONS
It is impossible for the conference to be an exhaustive review of all potential issues. The discussions at the
conference or the information provided by the administrator shall not bind or prohibit the county’s future application
or enforcement of all applicable laws and regulations. No statement or assurance made by county representatives
shall in any way relieve the applicant of his or her duty to submit an application consistent with all relevant
requirements of county, state and federal codes, laws, regulations and land use plans.
This pre-application meeting is intended to address permitting requirements for wetlands only. This meeting does
not provide permitting guidance for other sections of the Jefferson County Code or other regulatory agencies.
