As you know, we have been working with DCD to get this permit for over a year now. There are a lot of reports and paperwork involved in this. We are hoping the permitting process can move along so we can start our driveway project this summer in the dry months (as our mitigation plan requires). Our first CAM meeting was 01/07/21 and after many meetings (onsiteand over Zoom) we submitted our REUV Application and payment on 05/17/22. We were told the review process would start in July-August and it has now been 145days since our submittal. This is significantly longer than the timeline outlined in theDCD’s Variance application: · “Step 2 – Determination of Completeness: Following submittal of your application, county staff will make a determination within 28 days as to whether your application is complete. · Step 3 – Formal Application Review and Decision: Following the determination of completeness, a final decision must be made by the county within 120 calendar days. The final decision may be made by either the Administrator (for all Minor Variances) or the Hearing Examiner (for all Reasonable Economic Use Variances and Major Variances). Public hearings before the Hearing Examiner are required for all Reasonable Economic Use Variances and Major Variances. In all variance cases the decision may be appealed.” This delayed review process has pushed out our future building plans yet another year(since our mitigation plan only allows us to put in a driveway between July andSeptember). We are frustrated that merely seeking access to our property has already been a multi-year endeavor. After numerous prior meetings, we would like to see this movingforward and a date set for the Public Hearing with the Hearing Examiner. Donna Frostholm (DCD Staff Biologist) will be assisting me with this application. Please see the text below for Jefferson County DCD’s response to your questions: 1. Do you know how long a Variance permit typically takes? Generally, permit review takes 8 to 10 weeks. More complicated projects (Type II -III) generally have longer review time frames, due to scheduling site visits, public notices, staff report drafting, and scheduling a public hearing. With my current workload, I estimate starting my review of this project in July – August 2022. 2. Do they need to go in front of the hearing examiner? If so is this case on the hearing examiner's schedule yet? Type III Reasonable Economic Use Variance Applications require final decision by the Jefferson County Hearing Examiner (JCC 18.22.250(2)). As of today, this application is not on the Hearing Examiner’s schedule. The assigned planner schedules a Public Hearing with the Hearing Examiner when the noticing period, staff report, and all other review procedures have been completed.
