Good Afternoon‐ This email is the Notice of Application for the Jefferson Land Trust Hall Baetz Viewpoint Project
(MLA2022‐00026/SDP2022‐00010). Attached is the Notice of Application and the submitted SEPA Environmental
Checklist. Public Comment is due September 9th, 2022. Please see the text below for a summarized project description:
TYPE III SHORELINE VARIANCE PERMIT FOR A WATER ORIENTATED RECREATIONAL USE ‐ The Jefferson Land Trust (“the
applicant”) proposes to construct the Hall Baetz Viewpoint along 31 Fairmount Road in Port
Townsend, Washington. The project site is located on the southern side of Discovery Bay. The Hall Baetz Viewpoint
would serve as a public viewpoint of Discovery Bay and a natural/media interpretation area. In a larger context, the Hall
Baetz Viewpoint may be designed to connect the existing Olympic Discovery Trail to a proposed trail expansion to the
West. The trail expansion is not included in this Type III Shoreline Variance application. Improvements of the Hall Baetz
Viewpoint include one viewing/memorial structure, one interpretive sign, one road approach, one parking lot with a

capacity of ten vehicles, one vault restroom facility, and a pedestrian circulation walkway. The proposal would create
approximately 9,500 square feet of new impervious surface and 33,240 square feet of land disturbing activities.
All work would be conducted on a vacant, previously disturbed property. There is a Category I Estuarine Wetland,
Category IV Slope Wetland, Discovery Bay, two Type “F” Streams, Frequently Flooded Area (AE Flood Zone), Geological
Hazardous Areas (Seismic Hazard Area and Tsunami Hazard Area), Susceptible Critical Aquifer Recharge Area, Coastal
Saltwater Intrusion Protection Zone, and a potential Archeological Resource Area located on or adjacent to the subject
property. No in water work is proposed. The applicant has submitted a SEPA Environmental Checklist, Engineering
Geology Assessment, Engineered Stormwater Management Plan, Wetland Delineation Report, Wetland
Planting/Monitoring Plan, and a Cultural Survey with the Type III Shoreline Variance Permit application. This proposal is
subject to review under the State Environmental Policy Act (“SEPA”).

Dear Amanda Hunt,
The Jamestown S’Klallam Tribal Historic Office (THPO) is aware of the Hall Baetz Viewpoint Project in Discovery Bay, Jefferson County, Washington. It is the THPO’s understanding that the project
location underwent a cultural resource assessment in 2011 as part of the Snow Creek Estuary Restoration Project and no archaeology sites were identified within the project area. Additionally, the
project area has been manipulated by numerous grading and filling events sense the early 1900s. While it is known the area has been disturbed, the THPO requests the use of an inadvertent discovery plan
for all project ground disturbing activities due to the proximity of a recorded historic S’Klallam village
location, sq̕ʷaʔqʷéʔəɬ. Additionally, the THPO would appreciate notification prior to the planned
ground disturbance.

The Department of Ecology (Ecology) reviewed the environmental checklist and has the following comment(s): SHORELANDS & ENVIRONMENTAL ASSISTANCE: Rebecca Rothwell (360) 810-0025 The proposal will require a shoreline variance and will have to demonstrate consistency with the variance criteria in WAC 173-27-170 and the county's SMP. The proposal will have to be consistent with all applicable SMA and SMP policies and regulations, including provisions for the established shoreline environment designations (SED). The upland areas on the parcels where this development is proposed appear to be in the Natural and Conservancy SEDs. Both the SMP maps and the county’s online map layer showing SEDs lack the specificity and clarity to determine which areas on the parcels fall under which SEDs. Although the SMP maps are officially approved by Ecology, where maps are unclear, we rely on the SMP text that establishes the SED purpose and criteria (e.g., JCC 18.25.210). Ecology is available to work with the county to make a clearer assessment of where these two SEDs apply on the subject parcels. Per JCC 18.25.490(2)(c), in the Natural SED, low-intensity water-oriented recreational use and development may be allowed subject to policies and regulations of this program and the following criteria: (i) Essential minor structures such as trails, stairs, small picnic areas, primitive roads, viewpoints, restrooms or other appropriate sanitary facilities, interpretive facilities, or development that will not adversely affect shoreline ecological functions and processes are permitted, subject to policies and regulations of this master program. The proposed paved entry drive and gravel parking lot appear inconsistent with the specificity in this code section regarding “low-intensity recreational use” and “primitive roads.”

Page 2 Per JCC 18.25.490(2)(d)(iv), in the Conservancy SED, recreational use and development will not result in visitor patterns that degrade shoreline ecological functions. It will be important for the project to demonstrate how this criterion will be met. This may entail split-rail fencing and/or signs instructing visitors to stay off the bank and beach so as to prevent trampling of sensitive vegetation, littering, etc. The project will also need to be consistent with criteria that address stormwater and runoff, such as 18.25.320(1)(f), 18.25.490(1)(i), 18.25.520(1)(k), and 18.25.520(5)(b)). Per 18.25.320(2)(a) the project must be designed to be consistent with the most current version of the Ecology Stormwater Management Manual, NPDES general permit requirements, and JCC 18.30.070. SOLID WASTE MANAGEMENT: Derek Rockett (360) 407-6287 All grading and filling of land must utilize only clean fill. All other materials may be considered solid waste and permit approval may be required from your local jurisdictional health department prior to filling. All removed debris resulting from this project must be disposed of at an approved site. Contact the local jurisdictional health department for proper management of these materials. TOXICS CLEANUP: Dean Malte (360) 999-9584 One cleanup site, North Olympic Salmon Coalition Discovery Bay DOT Right of Way (CSID 12607), is located southwest of the project area at 282532 Highway 101. The site status is listed as “awaiting cleanup” and reported contaminants include gasoline, diesel, benzene, and xylenes in soil. It does not appear that this site is located within or adjacent to the project area. No other confirmed or suspected contaminated sites are located within ¼ mile of the project area. If any contamination is unexpectedly encountered, please report it to Ecology (per WAC 173-340-300) via the online ERTS at https://ecology.wa.gov/Footer/Report-an-environmental-issue/statewide-issue-reporting-form. WATER QUALITY/WATERSHED RESOURCES UNIT: Joseph McCord (360) 791-5017 Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent stormwater runoff from carrying soil and other pollutants into surface water or stormdrains that lead to waters of the state. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants. Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. Construction Stormwater General Permit: The following construction activities require coverage under the Construction Stormwater General Permit: 1. Clearing, grading and/or excavation that results in the disturbance of one or more acres and discharges stormwater to surface waters of the State; and

Clearing, grading and/or excavation on sites smaller than one acre that are part of a larger common plan of development or sale, if the common plan of development or sale will ultimately disturb one acre or more and discharge stormwater to surface waters of the State. a) This includes forest practices (including, but not limited to, class IV conversions) that are part of a construction activity that will result in the disturbance of one or more acres, and discharge to surface waters of the State; and 3. Any size construction activity discharging stormwater to waters of the State that Ecology: a) Determines to be a significant contributor of pollutants to waters of the State of Washington. b) Reasonably expects to cause a violation of any water quality standard. If there are known soil/ground water contaminants present on-site, additional information (including, but not limited to: temporary erosion and sediment control plans; stormwater pollution prevention plan; list of known contaminants with concentrations and depths found; a site map depicting the sample location(s); and additional studies/reports regarding contaminant(s)) will be required to be submitted. For additional information on contaminated construction sites, please contact Carol Serdar at Carol.Serdar@ecy.wa.gov, or by phone at (360) 742-9751. Additionally, sites that discharge to segments of waterbodies listed as impaired by the State of Washington under Section 303(d) of the Clean Water Act for turbidity, fine sediment, high pH, or phosphorous, or to waterbodies covered by a TMDL may need to meet additional sampling and record keeping requirements. See condition S8 of the Construction Stormwater General Permit for a description of these requirements. To see if your site discharges to a TMDL or 303(d)-listed waterbody, use Ecology’s Water Quality Atlas at: https://fortress.wa.gov/ecy/waterqualityatlas/StartPage.aspx. The applicant may apply online or obtain an application from Ecology's website at: http://www.ecy.wa.gov/programs/wq/stormwater/construction/ - Application. Construction site operators must apply for a permit at least 60 days prior to discharging stormwater from construction activities and must submit it on or before the date of the first public notice. Ecology’s comments are based upon information provided by the lead agency. As such, they may not constitute an exhaustive list of the various authorizations that must be obtained or legal requirements that must be fulfilled in order to carry out the proposed action.
