These costs may include but are not limited to: instructors, coaches, uniforms, facility reservation, officiating, number of participants and administration costs. In all cases, a percentage of the revenue will be used for scholarships. In addition the Recreation Program will seek to raise scholarship funds through grants, fundraising activities and donations. SECTION 3 -RULES: The County reserves the right to add to the following rules and regulations by publishing on site, local area policies and procedures that are specific to certain programs, facilities, and changing environmental conditions. 1. The County Reserves the right to cancel programs and facility,. campsite, field, and room reservations due to weather, maintenance, safety, or emergency conditions related to a building or a facility. 2. Groups or individuals that cause damage to facilities due to abuse and neglect or do not follow rules will be denied subsequent use of the facility. SECTION 4 -REPEALER: This Ordinance repeals and replaces Ordinance No. 04-0317-03 and 13-1213-99 and Section 2 of 14-1213-99. SECTION 5 - SEVERABILITY: If any section, subsection, or sentence, clause, phrase, of figure of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance or the application to other persons or circumstances shall not be affected. Fischbach, County Administrator From: Frank Gifford, Public Works Director ~O~ Agenda Date: December 11, 2006 Subject: Parks and Recreation Fee Ordinance Statement of Issue: The fee ordinance presented for public hearing on December 4th, 2006 differentiates between non-profit and for-profit groups in regard to fees by applying higher fees to for-profit groups. The differentiation is based on the market, not on cost recovery. The Board of County Commissioners requested that this issue be reviewed and a recommendation made for a modification to the proposed legislation. Analysis/Strategic Goals/Pro's R Con's: An analysis of the year 2006 to date indicates that 95 q of the total revenue from fees charged to groups is from non-profits. Fiscal Impact/Cost Benefit Analysis: A majority of facility users are non-profit. Our projections indicate that by using only the non-profit rate at the Picnic Shelters, Memorial Field and H.J. Carroll Park, the 2007 revenues will be reduced by $1850. The recommended combined rate maintains the overall fee goals as presented on 12/4/06.
