SECTION 2 - FEE SCHEDULE: The fee schedule is as follows. DEPARTMENT OF COMMUNITY DEVELOPMENT BUILDING DIVISION, DEVELOPMENT REVIEW AND LONG RANGE PLANNING a) Applies to new construction only, otherwise, number 7 applies. b) The fee is determined by a schedule established in the Uniform Building Code, and is based on the value of the structure. c) The fee that is charted by the Auditor's Office for filing. d) Applies to commercial, industrial, multi-family construction and is calculated as a percentage of the base fee. e) The fee is based on Building Valuation Data established by ICBO, Building Standards, modified for Western U.S. Washington State. f) Building Official will verify valuation per IBC Section 108.3 Building Permit Valuations g) All New, Alteration & Addition Permits for a Residence (including ADU's) with a valuation at $150,000 or above will be calculated using the square footage fee for Good (Not Average). REPEALER This Ordinance repeals and replaces the Permit Center-Building Division Section of Ordinance No. 12-1209-96, the Permit Center-Building Division Section of Ordinance No. 13-1213-99, Ordinance 10-1108-99, Ordinance 03-0312-02, and Ordinance No. 02-0315-04 SECTION 8 - SEVERABILITY If any section, subsection, or sentence, clause, phrase, or figure of this Ordinance of its application to any person or circumstance is held invalid, the remainder of the ordinance of the application to other persons or circumstances shall not be affected. The hearing notice was signed by the Board on the Consent Agenda on November 20. It was advertised in The Leader on November 22 and 29. The hearing was held on December 4 and the public comments were not in favor of the fee increases, especially the Hearing Examiner fee of$3,000. The Board took action to delete that fee from the proposed ordinance. The Board also had concerns regarding the rationale for the fee increases and "averaging" the amount of time it took for each service. They asked staff to provide more detail about each fee and schedule a workshop on December 11 to discuss the additional information. ANALYSIS/STRATEGIC GOALS: This proposed fee schedule repeals and replaces all the previously approved fee schedules for DCD. It is consistent with the strategic goals of Jefferson County. FISCAL IMPACT: DCD Budget for 2007 anticipates this increase. RECOMMENDATION: The Department recommends approval of the proposed ordinance. The proposed fee changes are for DCD fees only. Environmental Health and Public Works charge other fees per their fee schedules, Many of these fees are collected by DCD and deposited into those other departments' revenues lines. (9) Wood Stoves, inserts, propane tanks and pellet stoves (in existing structures). Initial installation of these mechanical devices includes inspection of the setup per the manufacturer's specifications, inspecting the clearances from combustibles, combustion air ducts, gas lines (interior and exterior), shut off valves and the stack. This fee includes the permit application submittal to the permit center front staff. Then a project case is created in permit plan (BLD 06... .), and a paper file is developed. A permit technician issues the permit over the counter within 24 hours, once issued and an inspection request is received via the building hotline, a building inspector travels to the project site and performs the inspection. The inspection passes or fails, follow up inspections may be necessary for additional appliances or necessary corrections. The 2006 fee is $51. No additional hours are currently being recovered. Staff Recommendation: Charge a ftatfee of $153. This equals three hours staff time - the minimum' time spent on this type permit. No further billing will occur. This fee includes the permit application submittal to the permit center front staff. Then a project case is created in permit plan (BLD 06....), and a paper file is developed. A permit technician issues the permit over the counter within 24 hours, Once issued and an inspection request is received via the building hotline, a building inspector travels to the project site and performs the inspection. Charge a one time fee of $51. Note: If you are building a new house these installations are part of the building permit for the house and require no additional charges when declared upon initial application. (13) Renewal A stick built/single family residence or garage building permit is valid for one year from date of issuance. A permit may be renewed for one additional year by paying the renewal fee. A building permit can be renewed indefinitely. The 2006 fee is $100. Staff Recommendation: Charge $153, Staff time includes: prepare a monthly list of those stick built/single family residences or garages building cases that will expire next month, pull the files, review the files and verify the status of the building permit. Prepare the renewal letters, envelopes, postage, and mail out. Upon receipt of renewal fee, a receipt is written up, permit plan is updated with fee, fee payment and a new expiration date is assigned. The minimum amount of time to perform this task is three hours. (16) Water System Review This is a proposed new fee for DCD review of water system plans (WSP). The work involves: purveyors are required to have their WSP approved by the Washington State Dept of Health (DOH) and incorporated into the Jefferson County Coordinated Water System Plan. (CWSP). The CWSP has oversight by the Water Utility Coordinating Council (WUCC). The long range- planning department coordinates this activity. The WSP is submitted to the county. The WSP is routed to the fire marshal for fire flow review, to the county engineer for franchise and right of way agreements, to the planning department for consistency with zoning. Eventually, the WSP or amendment to WSP is forwarded to the WUCC to conduct a pubic hearing and forward on a WUCC recommendation to DOH, who is the approving agency. Once approved by DOH the WSP becomes part of the CWSP. Staff Recommendation: Charge a $153 minimum initial charge. Send additional billings as the WSP moves through the process and more staff hours are utilized. 22) Pre-application conference This conference is for a future applicant to review code requirements prior to submitting an application for a specific project and location. All aspects of the application are reviewed. This includes zoning, environmental impacts, uses, septic, water, roads, storm water and state or federal agency requirements. The front staff receipts the application in. The application is routed to the Development Review Division (DRD), a case is set up in permit plan (PRE 06... )and preliminary site specific review is done. The case is assigned to a current planner. The planner coordinates the appointment with the other departments and the applicant. The staff prepares for the pre-application conference by researching code requirements, checking critical area maps, researching parcel information. The pre application conference is held. Statf Kecommendatlon: Charge a flat fee of $255. The minimum amount of time to perform this task is five-hours. No second billing iftime runs over five hours. (23) Administrative Appeal of Land Use Decision An appeal of a type I permit goes directly to Superior Court. An appeal of a type II permit goes to the Hearing Examiner for an open record appeal hearing; the closed record appeal goes to Superior Court. An appeal of a type III permit goes before the Hearing Examiner for an open record appeal hearing. In Port Ludlow, an Appellate Examiner is used for any closed record appeal after the open record hearing has been conducted and decision rendered. The appeal is receipted in at the permit center. The appeal is forwarded to the development review division. A case is set up (ZON 06...). The case is assigned to the planner who handled the original case. Legal arguments are reviewed. A public notice is submitted to the newspaper of record. The land is posted with a public notice of the pending appeal hearing. A staff report is written. The case is scheduled before the Hearing Examiner. A record is created with log items and submittals from the public, the staff and petitioner. The record and a staff report are reproduced and sent to the Examiner seven days before the open record appeal hearing. The public hearing is conducted by the Hearing Examiner. The decision is sent back to DRD for distribution to the parties of record. The staff handles any motions for reconsideration. Currently the 2006 total fee charged to the petitioner is $778. DCD requests this fee be increased to $847. This is a minimum charge. No second billing would occur for additional time spent on an appeal hearing. . (24) Revision to Land Use Applications Requiring a Second Public Hearing Notice Currently $233 is charged. DCD recommends a new fee of $291. This is to include the administrative time that was not taken into consideration under the previous fees. (26) Code Interpretation The previous base did not include the administrative time to take in the application and set up the case in permit plan. One hour of staff time was added to this fee. DCD recommends this fee be changed from $305 to $357. (31) Consistency Review This fee is for researching all aspects of information speCific to the parcel of land in question. This includes zoning, critical areas, previous use, easements, encroachments, existing buildings, the history of any permits, planning area, school districts and fire district information. The current charge is $51 per hour taken in at time of initial application. The residual hours are billed out prior to issuance of the permit. The request is to collect all three hours at time of permit intake and not bill out for residual two hours at a second billing. It is a minimum of three hours to perform the consistency review. A permit can be issued faster by charging up front instead of billing out, waiting on receipt of payment and then issuing the permit. (32)(33)(35)(36)(38) The previous base did not include the administrative time to take in the application and set up the case in permit plan. One hour of staff time was added to fee. (36 NOTE) If approved, DCD would require a shoreline permit for residential construction within 200 feet of shorelines. Code requires this permit, however DCD has been doing the review but not charging the fee. (39) (40) (41) (42) The current charge is $51 per hour taken in at time of initial application. The residual hours are billed out at issuance of the permit. The request is to bill out three hours at the time of permit intake and bill out any residual hours at a second billing. It is a minimum of three hours to perform this review. DCD requests the base fee move to $153.
