March 17, 2023 <https://gallery.mailchimp.com/6943e0d4535671f24022ca02a/images/cf04e6fd-150d-4420-a926-ee7a36f2d944.png> COUNTY NEWS A Duty to All is a Duty to No One: Understanding the Public Duty Doctrine Earlier this year, the Washington Supreme Court (Court) issued a decision that has a major impact on the public duty doctrine. In Norg v. City of Seattle, the Court, in a 5-4 decision, ruled that the public duty doctrine does not apply in tort cases where a plaintiff’s claim is based on a common law duty as opposed to a statutory duty. This decision presents an opportunity to take a closer look at the public duty doctrine and its effect on government tort liability. Learn More <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=90a23fd1af&e=03d5c964a3> STATE NEWS WA Rivers, Lake Nominated to Receive New Environmental Protections Under the federal Clean Water Act, states can designate certain bodies of water as Outstanding Resource Waters, which gives them the highest level of water quality-based protection in the state. The state is considering using the designation for the first time. In 2021, a group made up of environmental and recreational organizations, nominated Soap Lake and the Cascade, Napeequa and Green rivers for designation as Outstanding Resource Waters. The company has been working with Adams County and the state Department of Ecology on the proposal since before the county landfill near Bruce was closed and replaced with two transfer stations. "The landfill was designed in the early '90s, and went through the permitting process," Gimpel said, noting Waste Management has had an unclassified land-use permit through Adams County and a solid waste handling permit from the state health and ecology departments since about 1997. Looking ahead, Gimpel said the county will save money in trash disposal costs because of the landfill. Now, as awareness spreads, call centers are feeling pressure to keep up with the growing number of people seeking 24/7 behavioral health support by calling or texting 988 to have a confidential conversation with someone trained to help, free of charge. Are WA Roads Historically Unsafe? A rise in traffic fatalities in Washington has alarmed officials, who say incidents have reached a crisis level following the state’s deadliest year in three decades. The 745 deaths recorded in 2022, according to preliminary data from the Washington Traffic Safety Commission, were the most in the state since 825 in 1990. The spike, up 11% over the year prior, has cast a renewed spotlight on bad road behavior, faulty transportation infrastructure and the importance of driver education.
