BoCC, Carolyn, Monte and Barbara,
I was made aware this morning of an email from Colette Kostelec to my client questioning what I represented in my letter about ownership of Lots 9 and 10.
When we submitted our proposed access easements to the BoCC last April, we specifically provided that TPHOA owned Lot 19 and a 33/56th interest in Lots 9 and 10, and that TPP owned 11-18,
22-41, 45, 46, 51, 52 and 56. (See attached file)
Consequently, my statement in the letter to the BoCC stating that the TPHOA does not own Lots 9 and 10 was not fully correct, and I had forgotten that TPP had conveyed its partial interest
in Lots 9 and 10 to TPHOA. This was an oversight and not intentional, which should be obvious based on our previous easement proposal. Instead, my letter should have stated that the
HOA owns a partial interest in Lots 9 and 10 along with other lot owners in the Plat, but that Lot 57 does not own any portion of Lots 9 and 10.
In any event, the foregoing neither changes the position taken in my letter nor does it alter the proposed change to the resolution.
