CONDITIONS:
1.) This approval is for an administrative road setback from the right-of-way of Hilton Ave from 20 feet to 12 feet
only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances
and does not preclude review and conditions which may be placed on future permits.
2.) The reduction of the front setback adjacent to Hilton Ave may cause the land owner inconveniences and
financial loss in the future if certain items such as fences, landscaping, driveways, buildings, drainage facilities,
vehicle traffic etc. are placed in or near the easement. Easement work may include the installation and
maintenance of utilities, ditch maintenance, road widening, etc. Owner may be financially liable for the cost of
removing items near or within the easement for such installation and maintenance activities. Owner accepts all
such risks.
3.) The Department of Public Work does not oppose this reduction. The applicant is required to be notices that the
public-right-of-way setback is reserved for transportation facilities and appurtenances including, but not limited
to, the road surface, shoulders, drainage ditches or pipes, walking paths or sidewalks, cut and fill slopes, and
franchised utilities (power, water, phone, sewer, etc.). Under no circumstances shall any development be
allowed on the public right-of-way, or interfere with maintenance of transportation facilities, drainage facilities, or
utilities.
4.) The Department of Public Works states the County is not responsible for preventing runoff from the right-of-way
from entering adjoining property. Development of adjoining properties shall not be cause for the County to
undertake roadway improvements to alter drainage patterns. All stormwater associated with the development of
this property shall be accommodated by the property owner onsite.
FINDINGS
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development
Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County
Comprehensive Plan and Land Use map.
2.) The site plan as submitted with the administrative road setback variance application on August 19, 2021 has
been reviewed for consistency under the UDC, and is approved by Jefferson County Department of Community
Development without precedent. Any modifications, changes, and/or additions to the stamped, approved site
plan dated November 1, 2021 shall be resubmitted for review and approval by Jefferson County Department of
Community Development.
3.) This application was reviewed for an administrative road setback variance only. This application was not
reviewed for shoreline setbacks, environmentally sensitive areas, FEMA frequently flooded designation,
archaeology and historic preservation. 4.) The approval of this reduced front yard setback from public right-of-way is without precedent.
5.) This application was reviewed by the Department of Public Works (DPW). Jefferson County DCD received
comments from DPW on October 19, 2021 and incorporated them into the permit conditions.

APPEALS:
Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County
Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision. For more
