Site Location: Parcel number 001061005; 231 Middlepoint Road, Nordland, WA 98358
Description of Proposal: Residential development of a single-family residence with
associated septic system within the shoreline natural designation including a Class IV General
Stormwater Permit with over 10,000 square feet of impervious surface proposed. The applicant
proposes an additional garage, ADU, and home office outside of the natural shoreline designation.

General Land Use:
• Driveway access off of Middlepoint Road is greater than 1000 feet and will require road
naming.
• A site development and legal lot of record review is required for prior to all other applications now. For information on how to apply please visit: https://www.co.jefferson.wa.us/1609/Site-Development-Review-and-Legal-Lot-of
• Rural Residential 1 dwelling per 10 acres (RR 1:10).
• Setbacks: Access – 20 feet; Adjacent Parcels Zoned Rural Residential 5 - feet;
• Stormwater –drainage plan shall meet JCC 18.30. Any proposed development with
stormwater runoff must comply with the minimum standards of the 2019 (or most current addition) of the Ecology Stormwater Management Manual for Western Washington. An Engineered Stormwater Plan is required.
• Critical Areas: Non-Fish Stream, Critical Aquifer Recharge Area, Coastal SIPZ, Shoreline
Natural Designation.
State Environmental Policy Act (SEPA):
• SEPA is required for the class IV general stormwater review
• SEPA will be noticed in combination with the required public notice

Conditional Use Administrative Permit
Type II Process: requires noticing to applicable agencies, tribes, the Port Townsend Leader
(the paper of record), and property owners within 300 feet.
Preliminary Decision issued by Jefferson County
Final Decision issued by Department of Ecology
After Jefferson County permit decision and 10-day appeal period to the hearing examiner, the
application shall be sent to the Department of Ecology for review. On the day the decision is
mailed by Department of Ecology, a 21-day appeal period begins. No construction can begin
until all appeal periods have ended. A building permit application is required.
Shoreline Conditional Use Permit Criteria:
That the proposed use will be consistent with the policies of RCW 90.58.020 and this program.
That the proposed use will not interfere with normal public use of public shorelines.
That the proposed use of the site and design of the project will be compatible with other
permitted uses within the area.
That the proposed use will not cause adverse effects to the shoreline environment in which it
is to be located.
That the public interest suffers no substantial detrimental effect. Jefferson County Conditional Use Permit Criteria:
The conditional use is harmonious and appropriate in design, character and appearance with
the existing or intended character and quality of development in the vicinity of the subject
property and with the physical characteristics of the subject property;
The conditional use will be served by adequate infrastructure including roads, fire protection, water, wastewater disposal, and stormwater control;
The conditional use will not be materially detrimental to uses or property in the vicinity of the
subject parcel;
The conditional use will not introduce noise, smoke, dust, fumes, vibrations, odors, or other
conditions or which unreasonably impact existing uses in the vicinity of the subject parcel;
The location, size, and height of buildings, structures, walls and fences, and screening vegetation for the conditional use will not unreasonably interfere with allowable development or use of neighboring properties;
The pedestrian and vehicular traffic associated with the conditional use will not be hazardous
to existing and anticipated traffic in the vicinity of the subject parcel;
The conditional use complies with all other applicable criteria and standards of this title and
any other applicable provisions of the Jefferson County Code or state law; and more
specifically, conforms to the standards contained in Chapters 18.20 and 18.30 JCC;
The proposed conditional use will not result in the siting of an incompatible use adjacent to
an airport or airfield;
The conditional use will not cause significant adverse impacts on the human or natural
environments that cannot be mitigated through conditions of approval;
The conditional use has merit and value for the community as a whole;
The conditional use is consistent with all relevant goals and policies of the Jefferson County
Comprehensive Plan; and
The public interest suffers no substantial detrimental effect. Consideration shall be given to
the cumulative effect of similar actions in the area.
Non-fish Stream: Presence of Stream requires a 50 – 75-foot buffer.
Geologically Hazardous Area – Seismic Hazard, Shoreline Slope Unstable – Old Slide, High landslide hazard area: o Requires geotechnical report and a Notice to Title (NTT). Class IV General Stormwater Permit – JCC 18.20.160:
• Requires SEPA and SEPA Noticing, may be combined with the shoreline noticing or done
separately.
• Engineered Stormwater Plan Required
• Must have SEPA determination and Permit Approval prior to applying for a Forest Practice
Permit with Department of Natural Resources
• No Permit approval until final decision on shoreline permitting.
• The engineered site plan and report must show which on-site stormwater BMP will be used.
The preliminary designs for each system must be shown on the site plan applicable for each roof type. The engineered stormwater plan must show infeasibility or feasibility criteria for the on-site stormwater management BMPs per the order in the manual. Full dispersion is not
applicable as the proposal is to remove vegetated flow paths.

• Additional DCD fees may also include: Site Development/Legal Lot review; SEPA review
and other appropriate fees if applicable after the pre-application conference, building
permit fees. Fees are based on 2022 fee schedule and are subject change.
• Submit the application in person or to planning@co.jefferson.wa.us – no appointment to submit land use permits is required.
JCC 18.40.090(5) Assurances Unavailable. It is impossible for the conference to be an
exhaustive review of all potential issues. The discussions at the conference or the information
provided by the administrator shall not bind or prohibit the county’s future application or
enforcement of all applicable laws and regulations. No statements or assurances made by county
representatives shall in any way relieve the applicant of his or her duty to submit an application
consistent with all relevant requirements of county, state and federal codes, laws, regulations and land use plans. Pre-applications do not vest any portion of the development proposal. The applicant should read and understand all applicable statues, regulations, and rules.
