APPLICANT: SUZANNE L CARLSON 3314 GREENWAY PL PORT TOWNSEND, WA 98368 DATE ISSUED: March 31, 2023 DATE EXPIRES: March 31, 2024 CASE NUMBERS: ZON2022-00037, MLA22-00078 PROJECT PLANNER: Shannen Cartmel PROJECT DESCRIPTION: CLASS IV GENERAL STORMWATER PERMIT WITH STATE ENVIRONMENTAL POLICY ACT (SEPA) to clear 21,256 square feet or approximately 0.50 acres of native vegetation outside of the natural shoreline jurisdiction 150-foot shoreline buffer. This proposal includes an associated shoreline conditional administrative use permit, under SDP2022-00020. The scope of work includes a new single-family residence, a septic system, and a residential well. The Class IV General Stormwater Review with SEPA, required to clear the property for residential development, also requires a Class IV Forest Practice Permit (FPA) from the Department of Natural Resources (DNR). The applicant proposes to use full dispersion for stormwater management of 7270 square feet of driveway, sidewalk, and patio. The applicant proposes to use full dispersion with a dispersion trench of 45 feet to manage the proposed 3136 square feet of roof area. A geotechnical report to address the mapped geologically hazardous areas was presented in conjunction with this application. The report was prepared by Stratum Group on October 3, 2022. There is a mapped Non-Fish Habitat stream on this parcel which does not exist, confirmed by DNR during a site visit in July 2022.
PROJECT LOCATION: Parcel # 001061005; Section 6 -Township 30 – Range 1W; TAX 9 WITH EASE; Port Townsend, WA 98368 CONDITIONS: 1.) This APPROVAL is for a Stormwater Management Permit to clear 0.5 acres of timber and convert from forestry to residential use through a Class IV General Forest Practices Permit only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 2.) This approval is only valid upon Department of Ecology’s (ECY) approval of the associated Shoreline Conditional Administrative Use Permit, under SDP2022-00020. This approval becomes null and void if ECY denies SDP2022-00020. 3.) No land disturbing activities are permitted until ECY issues approval of SDP2022-00020 and the approval completes the required 21-day appeal period. 4.) The revised site plan as submitted with the Stormwater Management Permit to clear 0.5 acres of timber and convert from forestry to residential use through Class IV General Forest Practices Permit application on March 17, 2023, has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated March 30, 2023, shall be resubmitted for review and approval by Jefferson County Department of Community Development. 5.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 6.) The applicant is proposing to create or add 10,406 square feet of impervious surface and 21,256 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require the project applicant submit a stormwater plan meeting Minimum Requirements #1 through #9 of the Department of Ecology Stormwater Management Manual for Western Washington. The stormwater plan shall address measures to control stormwater, erosion and sediment during construction and shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 7.) A Stormwater Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 8.) A Geotechnical Report by Stratum Group dated October 3, 2022 was submitted in conjunction with this application on December 2, 2022. The report addressed the stability of the geologic hazard area. A vegetative buffer of 150 feet shall be permanently maintained from the Ordinary High-Water Mark (OHWM). All buffers shall be measured perpendicularly from the top of the Landslide Hazard Area. A Notice to Title has been signed and recorded under AFN 659570. 9.) All contractors and personnel shall be familiar with the inadvertent discovery plan as attached to this permit. If any possible historic, archaeological and/or cultural artifacts are inadvertently discovered, the applicant shall immediately stop all work on the project and shall notify the Washington Department of Archaeology and Historic Preservation, Jefferson County Department of Community Development, and affected tribes. 10.)Prior to any land disturbing activity, the applicant must comply with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development.

FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) This proposal was reviewed under the State Environmental Policy Act (SEPA) by Jefferson County acting as lead agency. A Determination of Non-Significance (DNS) was issued on February 14, 2023. 3.) The Geographic Information Systems mapping review identified the following Critical Areas on the subject property: marine nearshore habitats (Fish and Wildlife Habitat Conservation Area), non-fish habitat stream (incorrectly mapped), seismic hazard, unstable shoreline slope, high-landslide hazard, susceptible critical aquifer recharge area, and coastal seawater intrusion protection area. 4.) The Department of Ecology (ECY) commented: Clearing activities of one or more acres, requires a Construction Stormwater General Permit subject to review and approval by the ECY prior to any land disturbance. 5.) ECY commented: All grading and filling of land must utilize only clean fill. All other materials may be considered solid waste and permit approval may be required from your local jurisdictional health department prior to filling. All removed debris resulting from this project must be disposed of at an approved site. Contact the local jurisdictional health department or Department of Ecology for proper management of these materials. 6.) ECY commented that: No confirmed or suspected contaminated sites are located on or within ¼ mile of the project area. If any contamination is unexpectedly encountered, please report it to Ecology (per WAC 173-340-300) via the online ERTS. 7.) ECY commented that: Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent stormwater runoff from carrying soil and other pollutants into surface water or stormdrains that lead to waters of the state. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered to be pollutants. Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. 8.) ECY commented that: In Washington State ground water withdrawals of up to 5,000 gallons per day used for single or group domestic supply, industrial purposes, or for the irrigation of up to one half acre of lawn and garden are exempt from the permitting process. Water use under the RCW 90.44.050 exemption establishes a water right that is subject to the same privileges, restrictions, laws, and regulations as a water right permit or certificate obtained directly from Ecology. Due to the potential for sea water intrusion, the proponent is urged to locate the well(s) as far inland as possible. Regular chloride level monitoring is strongly recommended. If chloride levels become elevated above initial background levels, ground water withdrawals should be reduced or the pump intake raised to reduce concentrations. All water wells constructed shall be in accordance with the provisions of Chapter 173-160 WAC by a driller licensed in the State of Washington. All wells must be located a minimum of 100 feet from any known, suspected, or potential source of contamination and shall not be located within 1000 feet of the property boundary of solid waste landfills. A well report must be submitted to ECY within 30 days after the completion of the well. 9.) Jamestown S’Klallam Tribal Historic Preservation Office commented that: they request an inadvertent discover plan (IDP) for cultural resources be on-site for all ground disturbing activities. 10.) The Jefferson County Assessor’s Office commented that: The Assessor’s Office has no concerns on this application. 11.) Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Unified Development Code. APPEALS: Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision.
