FINAL DETERMINATION OF NON-SIGNIFICANCE AND LEAD AGENCY STATUS FOR: SDP2022-00020 / ZON2022-00037 / PRJR2022-00001

PROPOSAL: SHORELINE CONDITIONAL USE ADMINISTRATIVE PERMIT AND CLASS IV GENERAL STORMWATER PERMIT WITH STATE ENVIRONMENTAL POLICY ACT (SEPA) REVIEW for residential development within a Natural Shoreline Jurisdiction. The scope of work includes a new single-family residence, a septic system, and a residential well. The proposed residence meets the required shoreline buffer and is 160 feet (150-foot buffer + 10-foot building setback) away from the Ordinary High-Water Mark (OHWM). The septic system components meet the required shoreline buffer of 150 feet from OHWM. The Class IV General Stormwater Review with SEPA, required to clear the property for residential development, also requires a Class IV Forest Practice Permit (FPA) from the Department of Natural Resources (DNR). The applicant proposes to clear a total of 27,850 square feet or approximately 0.65 acres of native vegetation outside of all shoreline buffer requirements. The applicant has submitted an engineered stormwater plan, designed by Everett Sorenson, PE in conjunction with this application. A geotechnical report to address the mapped geologically hazardous areas was presented in conjunction with this application. The report was prepared by Stratum Group on October 3, 2022. There is a mapped Non-Fish Habitat stream on this parcel which does not exist, confirmed by DNR during a site visit in July 2022.

NOTICE OF LEAD AGENCY: Jefferson County has determined that it is the SEPA lead agency for the above-described proposal.
DETERMINATION OF NON-SIGNIFICANCE (DNS): Jefferson County has determined that the above described proposal, conducted in conformance with the applicable Jefferson County Codes and Ordinances, would not have a probable significant adverse impact on the environment, and an environmental impact statement is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with Jefferson County.
COMMENT PERIOD: This DNS is issued after using the optional DNS process in WAC 197-11-355. Jefferson County has considered comments on its preliminary threshold determination. There is no further comment period on the DNS.
APPEAL: Appeal of the DNS SEPA threshold decision of the responsible official on Type II permits may be appealed to the hearing examiner pursuant to JCC 18.40.280, Chapter 2.30 JCC, and the Hearing Examiner rules of Procedure for an open record appeal hearing. Any such appeal must be filed within the time limits of JCC 18.40.330(2)(b), and must be consolidated with any appeal on the underlying Type II permit decision. Appeals for this DNS shall be received in writing, in conformance with Chapter 2.30 JCC and be filed within 14 calendar days after the threshold determination. Appeals for this determination must be submitted by FEBRUARY 28, 2023.
