PROJECT DESCRIPTION AND REQUIRED PERMITS/STUDIES:
SHORELINE CONDITIONAL USE ADMINISTRATIVE PERMIT AND CLASS IV GENERAL STORMWATER PERMIT WITH STATE ENVIRONMENTAL POLICY ACT (SEPA)
REVIEW for residential development within a Natural Shoreline Jurisdiction. The scope of work includes a new single-family residence, a septic system, and a residential well.
The proposed residence meets the required shoreline buffer and is 160 feet (150-foot buffer + 10-foot building setback) away from the Ordinary High-Water Mark (OHWM).
The septic system components meet the required shoreline buffer of 150 feet from OHWM. The Class IV General Stormwater Review with SEPA, required to clear the
property for residential development, also requires a Class IV Forest Practice Permit (FPA) from the Department of Natural Resources (DNR). The applicant proposes to clear a total of 27,850 square feet or approximately 0.65 acres of native vegetation outside of all shoreline buffer requirements. The applicant has submitted an engineered stormwater plan, designed by Everett Sorenson, PE in conjunction with this application. A geotechnical report to address the mapped geologically hazardous areas was presented in conjunction with this application. The report was prepared by Stratum Group on October 3, 2022. There is a mapped Non-Fish Habitat stream on this parcel which does not exist, confirmed by DNR during a site visit in July 2022.

receive notice of and participate in any hearings; and (c) receive a copy of the decision by submitting such written comment(s)/request(s) to scartmel@co.jefferson.wa.us or
via mail to the Jefferson County Department of Community Development, Development Review Division, 621 Sheridan Street, Port Townsend, WA 98368, (360) 379-4454.
Comments concerning this application should be submitted to the Department by 4:30 p.m. on Friday, February 10, 2023. If the last day of the comment period falls on a
weekend or holiday, then the comment period shall be extended to the first working day after the weekend or holiday. Comments submitted after this date may not be
considered.
SEPA ENVIRONMENTAL REVIEW:
The optional DNS process of the State Environmental Policy Act (SEPA), Washington Administrative Code (WAC) 197-11-355 is being used. DCD reviewed the proposal for
probable adverse environmental impacts and expects to issue a DNS. This determination is based upon a review of the SEPA Checklist, project submissions, and other
available information. Additional conditions or mitigation measures may be required under SEPA. The SEPA Official has determined that this will be the only opportunity to
make comments related to SEPA. There will not be another comment period after the final threshold SEPA determination is made. If the threshold determination is a Determination of Non-Significance (DNS) or a Mitigated Determination of Non-Significance (MDNS), parties of record may appeal the decision to the Jefferson County Hearing Examiner within 14 days of the final Notice of Decision. A Determination of Significance (DS) may not be appealed to the Hearing Examiner. Decisions of the Hearing Examiner may not be further appealed except to Superior Court. PUBLIC HEARING INFORMATION: This is a Type II Administrative Conditional Use Permit Application that is subject to SEPA review. There will not be a public hearing unless the final permit decision and/or the
SEPA threshold determination by the Administrator is appealed to the Jefferson County Hearing Examiner. If an appeal hearing is scheduled, separate notice will be made at
least 10 days prior to the hearing. A copy of the staff report will be made available at least 14 calendar days prior to such a hearing. Appeals of environmental determinations
under SEPA, except for a determination of significance (DS), shall be consolidated with any open record hearing the project permit. Revised Code of Washington (RCW)
36.70B.110(6)(d)).
APPEALS:
Type II administrative decisions shall become final subject to the following: an applicant or party of record may appeal the decision to the hearing examiner for an open record
hearing, as further set forth in Article V of Jefferson County Code (JCC) 18.40 [Ord. 8-06 § 1].All appeals of Type II permit decisions must be in writing, conform with the
procedures for appeal set forth in Chapter 2.30 JCC and the Hearing Examiner Rules of Procedure and shall be filed within 14 calendar days after the notice of decision is
issued.
