Crescent Environmental PLLC 2 October 31, 2022 Tim, At your request and consistent with our agreed scope-of-work dated 8/8/2022, I performed a wetland delineation and functional assessment on your parcel # 962700097 located in Jefferson County, Washington (Figure 1). This wetland delineation is prepared because Jefferson County is requiring a new building permit after the previously approved permit lapsed. Jefferson County Critical Areas Code (Title 18.22) uses the following definition for regulated wetlands: Wetland Definition: “(22) "Wetland" or "wetlands" means areas that are inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas. Wetlands do not include those artificial wetlands intentionally created from nonwetland sites, grass-lined swales, canals, detention facilities, wastewater treatment facilities, farm ponds, and landscape amenities, or those wetlands created after July 1, 1990, that were unintentionally created as a result of the construction of a road, street, or highway. However, wetlands may include those artificial wetlands intentionally created from nonwetland areas to mitigate conversion of wetlands, if permitted by the county or city”. (WAC 365-190-030). The subject parcel (962700097) is located directly adjacent to Oak Bay, a Shoreline of Statewide Significance near Irondale, Jefferson County, Washington (Figure 1). The subject parcel was originally platted in 1910 as part of the Irondale Acre Tracts according to documents recorded with the Jefferson County assessor (Vol. 2, Page 145). The parcel is approximately 0.98 acres in area. The address of the parcel is 102 Cleveland Avenue, Port Hadlock, Washington, 98339. Site Characteristics The subject parcel is situated on a gently to moderately sloping terraced outwash and till hillslope bordering Oak Bay to the east. The elevation of the subject parcel ranges from approximately 6.6 feet above mean sea level (m.s.l.) on the east side to approximately 50 feet on the west side based on LiDAR bare earth October 31, 2022 TIM MURRAY WETLAND DELINEATION PARCEL 962700097, JEFFERSON COUNTY, WASHINGTON. Crescent Environmental PLLC 3 elevation data using the National Vertical Datum of 1988 (NAVD88) (Figure 2). Precipitation is seasonally variable, characterized by wet mild winters and relatively dry, cool, summers. Annual average precipitation (1981-2010) is approximately 22 inches primarily occurring as rainfall. Native upland vegetation on the parcel is a mixed second-growth conifer-dominated forest composed of Douglas fir and Red alder. The understory vegetation is dominated by plant species such as Sword fern, Salal, Snowberry, Red alder and Salmonberry. I visited the site on August 24 and October 6, 2022, during the growing season and walked the parcel boundaries and adjacent areas. I excavated shallow soil pits to 16 inches to evaluate soil color, texture, and shallow groundwater characteristics and recorded vegetation communities consistent with the U.S. Army Corps of Engineers (USACE) Western Valleys and Mountains Regional Supplement to the Federal Wetland Delineation Manual adopted by Jefferson County (USACE, 2010). I collected vegetation, soils, and hydrology data in two plots, one located in the central portion of the parcel and one located in the eastern area. Plot locations are shown on Figure 21 and Plot Data Forms are included in Appendix A. Additionally, prior to visiting the site I reviewed the following information: 1. LiDAR Topography. 2. NRCS On-line soil survey (NRCS, 2020). 3. Jefferson County Critical Areas On-Line Mapping. 4. National Wetlands Inventory Mapping (NWI, USFWS 2021). 5. Aerial photographs from 1942, 1951, 1956, 1989, 2006, 2009, 2011, 2013, 2015, 2017, and 2021. 6. Oblique aerial photographs from the Washington Department of Ecology for 1977, 1992, 2000, 2006, 2016. The NRCS On-Line Soil Survey indicates the parcel soils are (incorrectly) mapped as Tidal Marsh (hydric) soils (Figure 3). Jefferson County Critical Areas Mapping shows wetland areas occupying the eastern portion of parcel 962700097 (Figure 4). The National Wetlands Inventory (NWI) mapping shows wetlands associated with the marine waters of Oak Bay adjacent to the eastern portion of parcel 962700097, but no wetlands mapped on the parcel itself. (Figure 5). Aerial photographs (Figures 6-15) do not indicate the presence of wetlands on parcel 962700097. Oblique aerial photographs from the Washington Department of Ecology do not show any evidence of wetland conditions on the subject parcel. October 31, 2022 TIM MURRAY WETLAND DELINEATION PARCEL 962700097, JEFFERSON COUNTY, WASHINGTON. Crescent Environmental PLLC 4 On-Site Observations The primary wetland area observed adjacent to the south of parcel 962700097 is the marine shoreline and tidelands of Oak Bay (Photograph 1). No other wetland areas were observed on the subject parcel. Upland areas on the parcel are dominated by Douglas fir (Pseudotsuga menziesii) and Red alder (Alnus rubra) (Photograph 2). One small area in the central portion of the parcel (less than 0.10 acre) exhibits a marginally facultative wet plant community including Scoulers Willow, Pacific Crabapple, Soft Rush, Giant butter cup, Lady fern, Field Horsetail, Rough Horsetail, Nootka Rose and Evergreen Blackberry. The area exhibiting marginal hydrophytic vegetation receives storm water runoff from the parcels and surface roads in the adjacent (south) residential development via a series of ditches and a culvert. Review of the oblique shoreline photography indicates the residential development adjacent to the south was under construction in 1990. Oblique aerial photographs from 2000 and 2006 indicate an increase in shrub growth following the installation of storm water facilities that directed surface runoff onto the subject parcel. In order to determine whether the small area displaying hydrophytic plants was a wetland or not, I collected vegetation, soils and hydrology observations at two plots. Plot A and B are located on the central and eastern portion of the area of interest. Data collected at these plots are shown in Appendix A. Plot A (Western Plot) Plot A is located approximately 45 feet north of Plot B on the north side of the area of interest (Figure 21.). The area of interest is within the footprint of a former house shown in aerial photographs from 1956 to 1989. This house apparently burned down after the 1989 photography. Vegetation at Plot A consisted of an over story of Scoulers Willow, and an understory composed of Soft Rush, Field horsetail, Nootka Rose and Evergreen Blackberry. Soils at Plot A consisted of Brown (10YR 3/3) very dense gravelly sandy loam. The soil profile at Plot A was dry to within 16 inches of soil surface, there was no evidence of a water table, and no evidence of surface inundation. Site conditions observed at Plot A indicate the negative presence of wetland parameters. It is likely that the plant community is responding to the seasonal inputs of storm water runoff from the adjacent road and residential development. October 31, 2022 TIM MURRAY WETLAND DELINEATION PARCEL 962700097, JEFFERSON COUNTY, WASHINGTON. Crescent Environmental PLLC 5 Plot B (Eastern Plot) Plot B is located in an upland area on the eastern side of the area of interest (Figure 21). The plant community is mixture of upland and facultative species including Douglas fir, Scoulers willow, Western crabapple, Field Horsetail, Clover, Himalayan blackberry. Soils at Plot 2 consisted of Dark Brown (10YR 3/3) very dense, sandy, gravelly loam. (Note: soil color nomenclature follows Munsell Soil Color Chart standards (Munsell Color, 2000). The soil profile at Plot B was dry to 16” below the soil surface. There was no evidence of surface water ponding or inundation at Plot B. No wetland parameters (plants, soils and hydrology) are satisfied at Plot B, therefore Plot B is located in an upland location. Wetland Delineation Based on on-site investigation of plants, soils and hydrology within the parcel boundaries, no wetland area was delineated on parcel 962700097 other than the marine shoreline associated with Oak Bay. Based on on-site observations, the soil type mapped by the NRCS for this location (Tidal Marsh) is inaccurate. The soils observed in soil pits on site most closely matches the Tukey soil series mapped on the northern portion of the parcel. Additionally, the wetland mapping shown on the Jefferson County Critical Areas mapping is also incorrect for this location (Figure 4). Marine Shoreline of Oak Bay The shoreline of Oak Bay is a Shoreline of Statewide Significance and a Type S water. The tidal lagoon adjacent to the subject parcel is classified as an “Estuarine and Deepwater Marine Wetland” by the National Wetlands Inventory (Figure 5). The Hydrogeomorphic Wetland Class (HGM) for this wetland would be “Tidal Fringe Wetland”. Tidal fringe wetlands occur along coasts and estuaries and are under the influence of sea level. They intergrade landward with riverine wetlands where tidal current diminishes and river flow becomes the dominant water source. Additional water sources may be groundwater discharge and precipitation. The interface between the tidal fringe and riverine classes is where bidirectional flows from tides dominate over unidirectional flow controlled by floodplain slope of riverine wetlands. Because tidal fringe wetlands frequently flood and water table elevations are controlled mainly by sea surface elevation, tidal fringe wetlands lose water by tidal exchange, by overland flow to tidal creek channels, and by evapotranspiration. Crescent Environmental PLLC 6 accumulates in higher elevation marsh areas where flooding is less frequent and the wetlands are isolated from shoreline wave erosion by intervening areas of low marsh. (USACE, 2022). Tidal fringe wetlands are considered Type 1 wetlands in the Western Washington Functional Rating methodology (WDOE, 2015) (Appendix B). Wetland boundaries on the Tidal Fringe wetland were staked and flagged in the field and their locations mapped using an Arrow Gold real-time kinematic global positioning system (RTK- GPS) connected to the Washington State Reference Network (WSRN) to access real-time positioning corrections. Wetland boundaries were mapped in two-dimensional (x, y) space using U.S. Feet in the NAD83 datum using the State Plane Washington North projection with an accuracy of approximately +/- 5 cm Root Mean Square Error (RMSE). The wetland boundary is staked approximately every 25-feet along the eastern parcel boundary with 4-foot tall wood surveyor stakes and orange flagging at an elevation of approximately 7 feet above sea level (NAVD88). Wetland Functional Assessment Wetlands delineated on the parcel were evaluated using the methods published by the Washington Department of Ecology (WDOE, 2015) “Washington State Wetland Rating System for Western Washington”. The assessment forms are presented in Appendix B. Based on the WDOE Western Washington Wetland Rating System, the wetland present on the parcel would be designated as Class I wetland based on function because it is an Estuarine Wetland. The WDOE Western Washington Wetland Rating System does not provide any additional functional assessment for the Estuarine wetland classification. Critical Areas Buffers The Fish and Wildlife Habitat Conservation Area (FWHCA) and wetland buffer required by Jefferson County Code is 150 feet. The buffer proposed for this parcel is 76 feet as shown on Figure 21. This represents a 49% reduction from the standard buffer. Because a 49% reduction in the standard buffer is being proposed, mitigation for this reduction is also being proposed. October 31, 2022 TIM MURRAY WETLAND DELINEATION PARCEL 962700097, JEFFERSON COUNTY, WASHINGTON. Crescent Environmental PLLC 7 Mitigation Plan In order to allow for the establishment of a single family residence 76 horizontal feet from the Ordinary High Water Mark (OWHM) on the Type S water (Oak Bay) adjacent to the parcel, as previously approved by Jefferson County in 2011, I recommend implementation of a mitigation plan for this parcel to restore the functions and values of the marine shoreline and riparian zone. Contents of the Mitigation Plan include: 1. Establishment of a 76-foot horizontal buffer from the Ordinary High Water Mark on Oak Bay. This is a 49% reduction from the standard buffer . 2. Mitigation will include: a. Removal of a shoreline revetment composed of car tires located in Oak Bay on the east side of the parcel. b. Planting native vegetation within the shoreline buffer to re-establish a riparian zone along the Type S water. Plantings will be composed of Western red cedar seedlings (Thuja plicata) on a 12’ x 12’ spacing between the OHWM and the top of the slope above the shoreline. These plantings will consist of #2 or larger seedlings and will be protected from animal browse with a physical barrier. These trees will be monitored for survival for three years. c. In addition, all elements of the mitigation requirements for wetlands will be implemented in the design of the single family residence including: Table 18.22.730(1)(b). Required Measures to Minimize Impacts to Wetlands (All measures are required if applicable to a specific proposal) Disturbance Required Measures to Minimize Impacts Lights • Direct lights away from wetland Noise • Locate activity that generates noise away from wetland • If warranted, enhance existing buffer with native vegetation plantings adjacent to noise source • For activities that generate relatively continuous, potentially disruptive noise, such as certain heavy industry or mining, establish an additional 10 feet heavily vegetated buffer strip immediately adjacent to the outer wetland buffer Toxic runoff • Route all new, untreated runoff away from wetland while ensuring wetland is not dewatered • Establish covenants limiting use of pesticides within 150 feet of wetland • Apply integrated pest management Stormwater runoff • Retrofit storm water detention and treatment for roads and existing adjacent development October 31, 2022 TIM MURRAY WETLAND DELINEATION PARCEL 962700097, JEFFERSON COUNTY, WASHINGTON. Required Measures to Minimize Impacts to Wetlands (All measures are required if applicable to a specific proposal) Disturbance Required Measures to Minimize Impacts • Prevent channelized flow from lawns that directly enters the buffer • Use low intensity development techniques (for more information refer to the drainage ordinance and manual) Change in water regime • Infiltrate or treat, detain, and disperse into buffer new runoff from impervious surfaces and new lawns Pets and human disturbance • Use privacy fencing or plant dense vegetation to delineate buffer edge and to discourage disturbance using vegetation appropriate for the ecoregion • Place wetland and its buffer in a separate tract or protect with a conservation easement Dust • Use best management practices to control dust The mitigation implemented will restore the functions and values of the adjacent estuarine wetland by eliminating the tire revetment within Oak Bay and by re-establishing a native vegetation riparian zone within the shoreline buffer. No direct impacts to the adjacent estuarine wetland will occur and the proposed mitigation will increase the density and structural diversity of native vegetation within the 76-foot shoreline buffer over the current condition which would remain the same if a standard buffer was implemented. SUMMARY Remote review of available wetland mapping, historic aerial photography, and on-site investigation of the subject parcel for the purposes of wetland delineation indicates there is one regulated wetland within 150 feet of proposed residential construction on the parcel. On-site investigation determined that the vegetation community, soils and hydrology on the remaining portion of parcel 962700097 do not meet the criteria for wetland characteristics published by the U.S. Army Corps of Engineers, Western Valleys and Mountains Regional Supplement to the Federal Wetland Delineation Manual adopted by Jefferson County. In order to establish a single-family residence within 76 horizontal feet of the regulated wetland, the applicant is proposing the implementation of a Mitigation Plan that will restore shoreline functions by removing a revetment composed of car tires, restoration of the riparian zone within the established buffer, and implementation of required measures to minimize the impacts to wetlands.
