HomeMy WebLinkAbout052323 RE_ Code Compliance InquiryDear Peter: On behalf of DCD, I wrote to Fort Discovery requesting a copy of the wetlands delineation, as we are aware from their wetlands biologist that it was completed in the 3rd quarter of 2022 but not transmitted. Pursuant to this information, we are actively seeking it for review to ensure compliance. Please note that until we have a new code compliance officer, DCD will continue to triage code compliance. Yes, and thank you also for your offer to provide additional information. * Can you provide the date on which DCD granted Fort Discovery the 60-day extension you referenced? * What was the date DCD originally expected to receive the required wetland delineation report that was a requirement of the 2021 settlement agreement? * Is DCD pursuing compliance with the other violations the County documented in 2019 and were included by reference in the settlement agreement? Fort Discovery/Cedar Hills is currently working towards compliance. The County has granted Fort Discovery/Cedar Hills a 60 day extension to obtain the required wetland delineation report and the case is actively being monitored by the Code Compliance Officer (CCO). The CCO continues to work with all parties to ensure compliance. Please let me know if you need any further information. One of the terms of the settlement agreement was Fort Discovery’s voluntary compliance to resolve multiple code violations on its Cedar Hills Property including but not limited to, illegal filling and disturbance of wetlands. As we approach the second anniversary of the settlement agreement, the Tarboo Ridge Coalition, the community group who opposed Mr D’Amico’s prior plans for the property, would appreciate a status report on Fort Discovery’s compliance efforts. Referencing the County’s May 2019 documented violations, may we expect a report detailing which violations have been resolved and those that remain to be corrected on or before March 1, 2023?
