HomeMy WebLinkAboutAgreement re: HCCC i INTERAGENCY AGREEMENT HOOD CANAL COORDINATING COUNCIL This agreement is made and entered into by and between and undersigned member agencies of the State of Washington and other named entities to establish the Hood Canal Coordinating Council, pursuant to provisions of the Interlocal Cooperation Act of 1967, Chapter 39.34 RCW. Definitions For the purpose of this Interlocal Agreement and all other agreements, contracts and documents executed, adopted or approved pursuant to this agreement, the following terms shall have the meaning prescribed to them within this section unless the context of their use dictates otherwise. 1. Council shall mean the Hood Canal Coordinating Council. 2. Hood Canal Regional Planning Policy shall mean selected policy and operational recommendations addressed to local, state, and federal public agencies, developed by the Council within the first six months of its existence and as amended thereafter by formal action of the Council. 3. Member agency shall mean any public agency which is a party or becomes a party to this Interlocal Agreement and is a county, city, town or Indian tribe or state agency, or other named entity of the state government. 4. Public agency shall mean any city, town, county, public utility district, port district, fire protection district, school district, air pollution control authority, Indian tribe, any agency of the State government or of the State government or of the United States and any political subdivision of another state. 5. Region shall mean that territory lying within the boundaries of Kitsap, Jefferson, and Mason counties and whose natural drainage is tributary to Hood Canal. Recitals WHEREAS, the undersigned member agencies recognize the benefit to the public of participating in a forum for mutual critique and cooperative policy review to improve regulatory decision-making affecting the Hood Canal region, and WHEREAS, such a forum can reduce duplication, improve cost-effectiveness, and maintain credibility with the public, and WHEREAS, involvement of the public and of local governmental units will help to ensure development of accepted and workable programs and regula- tions for the region based in part on continuing research efforts, and WHEREAS, the undersigned member agencies are authorized and empowered to enter into this agreement pursuant to Chapter 39.34 RCW, THEREFORE, in consideration of mutual promises and covenants herein, it is hereby agreed: 1. Organization, composition, nature: there shall be established a Hood Canal Coordinating Council which shall serve as a forum for accomplishing the tasks identified below. The Council shall consist of the following members: one commissioner each from Kitsap County, Jefferson County, and Mason County; one representative from the State Ecological Commission, one representative from the Skokomish Tribe, and one representative from the Port Gamble-Klallam Tribe. Members of the Council shall be appointed by their respective juris- dictions for terms of four years. The chairman of the Council shall be selected from among the Councilby the appointed members. 2. Delegated Authority and Purposes: The Council shall have the following delegated authorities and purposes: A. Within the first six months, the Council will: (1) Establish, define, and prioritize regional objectives for the near and long range, (2) Develop a work program addressing overall water quality and related elements, and focusing on topics of regional concern, issues and problems, and coordi- nation of public agency activities affecting the Hood Canal region, (3) Identify and help coordinate existing programs where possible, and work toward development of workable programs for public agencies, including coordination of actions correcting identified and prioritized problems, (4) Establish a public education, awareness, and review process, (5) Review state and federal legislation and make recommendations to the applicable agencies and the Puget Sound Water Quality Authority, where appro- priate. (6) Establish a timely relationship with the Puget Sound Water Quality Authority to preclude duplication and foster effective and efficient planning and imple- mentation. B. At the end of six months include all of its recommendations in a report entitled the Hood Canal Regional Planning Policy. - 2 C. After the initial six months, to continue to meet at least semi-annually to consider amendments to the Hood Canal Regional Planning Policy, to provide coordinated liaison with the Puget Sound Water Quality Authority, or to take other actions delegated under this Interlocal Agreement. 3. Committees: The Council shall actively seek the advice of citizens and appropriate public agencies with expertise in the issues under review. The Council may establish such committees as necessary to provide for a smooth information flow. Any such committees shall have no authority to approve or deny permits or projects. 4. Funding: The work of the Council shall be funded in the budgets of the respective public agencies participating on the Council and through such technical assistance which may be provided by other public agencies. The Council is authorized to apply for such federal, state, local, or private funding of any nature as may become available, including support which may be provided from the Puget Sound Water Quality Authority. 5. Withdrawal from Agreement: Any member agency shall have the right to withdraw from the Interlocal Agreement by giving written notice at least three months prior to the intended date of withdrawal. 6. Duration: This Agreement shall remain in force and effect perpetually or until terminated by member agencies which represent half or more of the signing members. 7. Disposition of Assets: Upon termination of this Agreement any money or assets in possession of the Council after payment of all liabi- lities, costs, expenses, charges validly incurred under this Agree- ment, shall be returned to all contributing member agencies in proportion to their financial contributions determined at the time of termination. The debts, liabilities, and obligations of the Council shall not constitute a debt, liability, or obligation of any member agency. IN WITNESS WHEREOF, this Interlocal Agreement shall have full force and effect from and after lr_gt 1985.
