This letter is to request you deny the building permit for a 190 foot radio tower requested by KPTZ to be
built adjacent to our property at 33 Rainshadow Drive.
We oppose the construction of the tower and the leasing of an easement to KPTZ.
A commercial radio tower should not be built in a residential zone. The property proposed is forested
and a natural habitat for wildlife. Eagles fly overhead daily. The 40 acres our property sits on was divided
into five acres parcels to prevent subdivisions and limit development. It was a planned community
before its time.
The original application for this tower was proposed by KPTZ to the Department of Community
Development in 2010. The area was eight plus acres of partially cleared RR-5 land 450 feet from power
lines. This tower development was requested at 591 N. Jacob Miller Road, Jefferson County. At the time
DCD approved the tower, it was told that a lease agreement with the owner of the property was
renewable. This was not true.
That brings us to the current proposal. Build a new antenna down a private drive. Put it on a leased
easement in a residential area. Allow new construction 155 feet beyond the height restriction near power
lines. KPTZ is a business and therefore commercial. This amounts to a commercial sub -division for 25
years at 35 Rainshadow Drive.
We would appreciate your review of the original project and current application. The original plan was
not solid and there is nothing improved in the new proposal. Please do not let any organization or
individual make this sort of investment on land they do not own. This proposal is in complete disregard
of the zoning and irresponsible with respect to the power lines.
