FCC DELEGATES AUTHORITY TO THE CHIEF OF THE BROADCAST
BUREAU TO WAIVE SMALL AMOUNTS OF INTERFERENCE RECEIVED
BY NONCOMMERCIAL EDUCATIONAL FM PROPOSALS.
Citing the lack of available transmitter sites in urban and residential areas,
increased demand for educational FM facilities, the crowded nature of the
educational FM band and the elimination of the ten watt Class D Facility option,
the Commission today has decided to delegate authority to the Chief of the
Broadcast Bureau to waive, when warranted, interference received by noncommercial
educational FM applicants when roughly five percent or less of the proposed
service area (1 mV/m contour) is affected. These waivers will only be granted
when the applicant provides sufficient justification such as a lack of alter-
native transmitter sites and/or frequencies. The Commission indicated that
this delegation will increase the efficiency of the FCC's FM processing area,
increase the speed of service, provide applicants with some much needed technical
flexibility in preparing their applications but would not significantly undermine
the overall educational FM allocation scheme.
Action by the Commission July 16, 1981. Commissioners Fowler (Chairman),
Quello, Washburn, Fogarty and Jones, with Commissioner Dawson abstaining from
voting.
