Butler, Chief Strategy Officer TO: Interested Parties RE: Caswell-Brown Village Supplemental Staff Report ------------------------------------------------------------------------------------------------------------------------------ Jefferson County received five comments from agencies and/or county departments. Three of these five requests propose amendments to the draft conditions of approval or State Environmental Policy Act (SEPA) mitigations. These are incorporated as proposed amendments to the conditions. Comments resulting in no edits to the conditions originated from the following sources: 1. ERTS & SEPA Coordinator Joe Thomas, Southwest Region, Department of Ecology 2. Jefferson County Undersheriff Andy Pernsteiner Comments resulting in edits to the conditions were transmitted from the following departments. 3. Public Health Department Director Apple Martine (regarding condition # 6) 4. Public Works Department Development Review Engineer John Fleming (regarding condition # 10) 5. Public Health Department Environmental Health Specialist Randy Marx (regarding condition # 38) Consequently, the Department of Community Development recommends that the hearing examiner include the following changes to the existing conditions of approval proposed, as set forth below. (Words to be removed are identified by strikethroughs, and new language is underlined) Amendment Number 1 (SEPA) condition Number 6 Public Services: The applicant shall submit for review and approval to Jefferson County Department of Community Development five plans substantially similar to the requirements contained in Jefferson County Code Chapter 18.20.385, including: 1) Safety and Security Plan, 2) Operations Plan, DEPARTMENT OF COMMUNITY DEVELOPMENT 621 Sheridan Street, Port Townsend, WA 98368 Tel: 360.379.4450 | Fax: 360.379.4451 Web: www.co.jefferson.wa.us/communitydevelopment E-mail: dcd@co.jefferson.wa.us 3) Transportation Plan, 4) Perimeter Plan, and 5) Communication and Coordination Plan. Specifically, the applicant is required to complete these plans in consultation with the first responder agencies (Jefferson County Department of Public Health, City of Port Townsend Police Department, Jefferson County Sherriff’s Office, East Jefferson Fire Rescue) and shall submit them to the Department of Community Development one year after operation between April 15 and June 1, and every year thereafter within this timeframe so long as the shelter or 40-lot park remain operational. Based on the annual report, the Community Development Department may require amendments to the plan or conditional use permit to address these issues. Amendment Number 2 Recommended Condition Number 10 Stormwater quantity control, quality treatment, and erosion and sedimentation control shall be designed in accordance with the geotechnical recommendations, as set forth in Exhibit 7, and pursuant to Jefferson County Code 18.30.070 Stormwater management standards, and the Jefferson County Public Works Department Community Development Department shall issue final approval. The submittal documents shall be prepared by a civil engineer licensed in the State of Washington. The fees and submittal requirements shall be in accordance with Jefferson County Code in effect at the time of application or Building Permit if site development review is required. Payment of fees or approval of a fee waiver by the Board of County Commissioners shall be required prior to county review. Amendment Number 3 Recommended Condition Number 38 The Applicant’s permit is conditioned upon meeting the regulations outlined in the Large On-site Sewage System Regulations WAC 246-272B. Code, JCC Chapter 8.15, and occupancy shall not exceed for the Shelter: 50 beds / up to 75 persons or the approved septic permit capacity, whichever is less and for the 40-Space Park/ up to 75 persons or the septic capacity, whichever is less. Amendment Number 4 New Condition of approval - Recommended Condition Number 39 The Applicant’s occupancy shall not exceed for the Shelter: 50 beds / up to 75 persons and for the 40- Space Park accommodating Tiny Shelters, Recreational Vehicles etc. up to 75 persons or the approved Large On-site Sewage System, whichever is less Comments are attached to this supplemental staff report memorandum. As for the question about the calls to the shelter, I believe all those calls are for the shelter and not the Legion lounge area and this is a high number of calls for any given address. Looks like a lot of work to compile all this data. Nice work. Based on the potential for an increased demand for public services, the SEPA Responsible Official approved SEPA mitigations, specifically conditions 6 and 7. The conditions are posted online there and your input is welcome and encouraged if only to say that it looks good. If you see a need for edits, please send your recommendations if possible by Thursday, Close of Business. The county’s submittal of a final supplemental staff report will be posted online this Friday in advance of next Tuesday’s hearing and could incorporate those edits if submitted by Thursday. Contextual questions - Are the reported calls (see Table 1 of the staff report) grouped together with the American Legion’s bar and event space or were these calls exclusively generated by the shelter? Per page 30-31 (SEPA) Condition Number 6, Jefferson County Public Health would not be defined as a first responder agency like those listed in this section of the document. I know we discussed some of the ways JCPH provides clinical and case management services via a menu of free and accessible programs that are available to, and utilized by, residents of Caswell-Brown Village, but our emergency response work centers public health emergencies (i.e., pandemics, natural disasters, etc.) and not first responder activities. It would be best to strike JCPH from the last sentence on page 30. If you’d like to discuss this further, I am available between 11-12 today. Given that the applicant may not have been aware of public works and building requirements before starting grading and clearing in the past, it’s my hope that these are clearly formulated to avoid a repeat. The size of the septic system would limit the occupants, so, if they wanted 200 occupants they would need a septic system to support it. This is something a Large on-site septic system permitted by the state could easily handle. This language should be removed from the health section. Sorry for the reversal.
