Butler, Chief Strategy Officer TO: Hearing Examiner Gary McLean, Esquire RE: Second Supplemental Staff Report Pursuant to the Extension of the Public Comment Period ------------------------------------------------------------------------------------------------------------------------------ This supplemental staff memorandum summarizes: 1) Comments received and staff responses. No comments have been received after the originally scheduled public hearing in response to the extended timeline for public comments. 2) Additional findings or amendments. Staff recommends adding condition number 40 regarding payment of fees to the existing amended list of conditions, as recommended by staff in the supplemental staff report dated July 26, 2023 3) Errors or omissions, if any. PART 1 – Comments received and staff responses. No comments have been received by Jefferson County during the period of the extension. Additional actions undertaken to publicize that the public comment period was extended included: a) Published notice of extension in the Jefferson County/PT Leader on September 6, 2023. The publication in the county’s newspaper of record, as set forth in Exhibit 29, announced that the public comment period had been extended until September 12, 2023 b) Second mailings on August 31, 2023. From this mailing, one envelope addressed to John B. Lockwood, 355 Hudson Street, Port Townsend, was returned. A sticker affixed to it states: “RETURN TO SENDER NOT DELIBERABLE AS ADDRESSED UNABLE TO FORWARD” This second mailing used a 3,000-foot radius, as opposed to the required 300 feet pursuant to Jefferson County Code 18.40.210 Notice of application – Mailing, publication, and posting requirements. Staff used the expanded radius out of an abundance of caution as a more expansive mailing list was saved in the Temporary Housing Facilities files. Later investigation revealed that the more expansive list includes properties within the 3,000 feet radius, ten times greater than required pursuant to JCC 18.40.210. \ c) Posted notice of the extension on the Department of Community Development website to reflect the extended public comment period, as set forth in Exhibit 29. PART 2 - Additional findings or amendments. In addition to the proposed amendments to condition numbers 6, 10, and 38, and the addition of 39, as set forth in the July 26, 2023supplemental staff report, staff recommends adding an additional condition, as follows: Condition # 40. Prior to Building Permit submittal, applicant shall pay Jefferson County fees or obtain a fee waiver from the Board of County Commissioners. PART 3 – Errors or omissions. Exhibit numbers 22, and 23, as identified in the Environmental Review and Staff Recommendation MDNS were replaced in the exhibit list as Site and Building Plans, and Housing Emergency Resolution Number 035 17 respectively.
