Deliberation on proposed amendments to the county’s Shoreline Master Program (SMP) as part of required Periodic Review. The Planning Commission may act on this item. SMP Periodic Review webpage: https://www.co.jefferson.wa.us/1481/Shoreline-Master- Program-Periodic-Review ii. On November 1, 2023, the Planning Commission (PC) voted on a motion paraphrased as “the Draft SMP document faithfully represents the deliberation and recommendation of the Planning Commission on October 18, 2023.” Deliberation followed the motion. The vote was 3-3-1 (two absences) and the motion failed. No recommendation went forward to the Board of County Commissioners (BoCC). iii. Correspondence re: SMP since preparation of November 1 meeting agenda: • King – Additional Comments on SMP Update – November 1 • Showalter – handout at November 1 meeting • King – Mason County CUP clarification – November 6 iv. Continued Deliberation: The County Administrator, in consultation with the BoCC Chair with respect to the Board’s calendar, requests that you try again to reach a recommendation on the Shoreline Master Program (SMP). The BoCC acknowledged this preference during its November 6 meeting. This provides an opportunity for the Planning Commission to continue deliberations and arrive at a set of SMP amendment recommendations for the BoCC to consider. b. BERK presentation: (14:42 – 24:47) i. November 10 Staff Report – SMP Options: BERK consultants and DCD staff outline remaining issues and offer options for Planning Commission consideration and vote. c. Motion (CK) that the Planning Commission send forth to the BoCC a recommendation to treat all geoduck aquaculture with a standard Conditional Use Permit (CUP) (option 3): 1st: CK | 2nd: CL | 4 Yay | 5 Nay | 0 Abstention – Motion Fails ii. Motion (KC) to maintain approach in 11/1/23 draft with a mix of standard and discretionary CUPs for new, conversion, or expansions depending on shoreline environment designation (option 1): 1st: KC | 2nd: LD | 5 Yay | 4 Nay | 0 Abstention – Motion Passes iii. Motion (AS) to adjust the language in the Shoreline Environment Regulations section of the draft SMP: 1st: AS | 2nd: RH | 8 Yay | 0 Nay | 1 Abstention – Motion Passes iv. Motion (CK) to maintain approach in 11/1/23 draft with aesthetics analysis as a submittal requirement with the allowance that: Applicants may omit information from Table 18.22.400 that is demonstrably not applicable to a specific aquaculture proposal. An aesthetics analysis would be an important tool to determine first if there are conflicts, and second if and how they could be reconciled (option 1): 1st: AS | 2nd: RH | 7 Yay | 0 Nay | 2 Abstentions – Motion Passes v. Motion (LD) to implement Option B from the hearing draft, which allows common line with conforming lots whereas modest home is for non-conforming lots (option 3): 1st: LD | 2nd: KC | 7 Yay | 0 Nay | 2 Abstentions – Motion Passes vi. Motion (KC) to clarify that a 25% reduction of the standard buffer is the standard per the critical area regulations and 50% is a maximum if preparing a special report (option 2): 1st: KC | 2nd: AS | 6 Yay | 0 Nay | 3 Abstentions – Motion Passes vii. Motion (MN) to adopt the complete SMP recommendation, as amended, and send it forward to the BoCC: 1st: MN | 2nd: LD | 7 Yay | 1 Nay | 1 Abstention – Motion Passes 8.
