Safety Fees for Alarm Registration and Renewal in Appendix Fee Schedules and Amending JCC 3.70.010 and JCC 8.80.030 ORDINANCE NO 0 7 —112 7— 2 3 WHEREAS, the Sheriff's Office collects certain fees authorized in chapter 3.70 of the Jefferson County Code ("JCC"); and WHEREAS, under chapter 3.80 JCC, all fees should be adopted by resolution; and WHEREAS, therefore, amendment of JCC 3.70.010 is required for the Sheriffs Fees to be consistent with chapter 3.80 JCC; and WHEREAS, Ordinance 04-1120-17 was enacted on November 20, 2017 regarding registration and regulation of alarm systems; and WHEREAS, Ordinance 04-1120-17 codified chapter 8.80 JCC relating to Registration and Regulation of Alarm Systems; and WHEREAS, false alarm registration fees are adopted in Appendix Fee Schedules; and WHEREAS, the proposed changes of this ordinance eliminate false alarm registration fees from the code and Appendix Fee Schedules, and allow adoption of new fees by resolution, which is consistent with chapter 3.80 of the Jefferson County Code; and WHEREAS, the false alarm registration fees will not be raised. NOW THEREFORE, be it hereby ordained by the BoCC as follows: Section 1. Findings. The BoCC hereby adopts the recitals (the "WHEREAS" statements) as its findings of fact in support of this Ordinance. Section 2. Amendments adopted in Appendix A. The BoCC adopts Appendix A, which amends Appendix Fee Schedules to repeal Section V11, Safety. Section 3. Amendment to JCC 3.70.010. JCC 3.70.010. last amended by Ordinance 10-0806-18 on August 6, 2018, is amended to read as follows: 3.70.010 Designated. The sheriff, or his or her agent, representative, deputy or employee, shall collect the following minimum fees for official services he or she renders, subject to the indexing methodology listed in JCC 3.70.030 and as adopted by resolution pursuant to chapter 3.80 JCC: (1) For service of each summons and complaint, notice and complaint, summons and petition, and notice of small claim on one defendant at any location; (2) For making a return of service. (3) For levying each writ of attachment or writ of execution upon real or personal property; (4) For filing copy of writ of attachment, order of sale or writ of execution with the auditor, the actual cost of the auditor's filing fee; (5) For processing and serving writ of possession or restitution when enforcement is not necessary (whether due to cancellation or due to compliance by the occupants), including the cost of preparing and serving or posting all notices generated by the sheriffs office; (6) For processing and serving writ of possession or restitution with enforcement, including the cost of preparing and posting or serving all notices generated by the sheriffs office; (7) For serving an arrest warrant in any action or proceeding; (8) For executing any other writ or process in a civil action or proceeding:. (9) For making a deed to lands sold upon execution or order of sale or other decree of the court, to be paid by the purchaser; (10) For making copies of papers when sufficient copies are not furnished to the sheriff, or when additional copies of notices are needed in the course of enforcing a civil court order to ensure all parties receive service; (11) For service of any other document and supporting papers for which no other fee is provided herein: (12) For posting a notice of sale or postponement; 0 3) For certificate or bill of sale of property.. or certificate of redemption; (14) For conducting a sale of property; (15) For preparing notice of levy, notice of sale, or notice to publisher, or any other notice for which no other fee is provided herein; (16) For preparing affidavit of posting or affidavit of mailing; (17) For fingerprinting for noncriminal purposes; (18) For the reproduction of audio, visual, or photographic material, to include magnetic microfilming, (19) For cancellations of service of process, other than writs or court orders directed to the sheriff: (20) For cancellations, prior to levy, of writs of attachment, writs of execution, or orders of sale, whether on real or personal property; (2 1 ) For cancellations, after levy, of writs of attachment, writs of execution, or orders of sale, whether on real or personal property: (22) For cancellations on services of all other writs and court orders directed to the sheriff (except writs of restitution or writs of possession); and (23) For civil standby services scheduled through the civil office. Section 4. Amendment to JCC 8.80.030. JCC 8.80.030. last amended by Ordinance 04-1120-17 on November 20, 2017. is amended to read as follows: JCC 8.80.030 Registration of alarm systems. The sheriff shall maintain a central registrar of all persons maintaining an alarm within the unincorporated areas of Jefferson County. (1) Registration Required. It shall be unlawful for any person within the unincorporated areas of Jefferson County to have or maintain on their premises an alarm, whether an automatic alarm or a semi -automatic alann, unless the alarm is registered with the sheriff and the registration fees required by this chapter are paid. (2) Registration Application. An application for registration of alarms shall be made to the sheriff on forms provided by the sheriff and shall include: (a) name of the registrant, (b) address and telephone number of the registrant: (c) location of the alarm system on the premises of the registrant: (d) type of alarm (tire or burglary) being registered, and (e) such other information as the sheriff deems advisable for the protection of public safety. (3) Registration Fee. The sheriff shall adopt reasonable registration and renewal fees for alarms by resolution, as required by chapter 3.80 JCC. Fees shall be made payable to the Jefferson County auditor by certified check, cash, money order, or electronic payment system.. No registration fee may be charged for changes or amendments in registration information. No registration fee shall be charged to any entity of the state, county or municipal government. Section 5. Severability. if any section, subsection, sentence, clause, phrase or section of this Ordinance or its application to any person or circumstance is held invalid, the remainder of this Ordinance or its application to other persons or circumstances shall be fully valid and shall not be affected. Section 6. Effective Date. The Ordinance shall take effect upon adoption by the Board of County Commissioners. Section 7. SEPA Categorical Exemption. The CPI W is the Consumer Price Index - U.S. City Average for All Urban Wage Earners and Clerical Workers, published by the Bureau of Labor Statistics for the United States Department of Labor. The annual fee adjustment shall be calculated as follows: Each fee in effect immediately prior to the adjustment date will be increased by the percentage increase in the CPIW as reported for the month of September preceding the adjustment date. Increases will be rounded to the nearest dollar. A fee shall not be reduced by reason of such calculation. However, fee increases in accordance with this calculation shall not exceed five percent per year. 1 I-020 Public health clinic services. All of the services/fees listed for Jefferson County public health are hereby being set by the Jefferson County board of health as follows: A cost analysis will be completed annually to set reimbursement rates for community health including family planning services, birth control methods and immunizations.1 Fees for medications, antibiotics and treatment methods will be based on cost of acquisition unless acquired by an outside vendor at no cost to Jefferson County public health. All fees for immunizations not subsidized by the Washington State Department of Health will be the cost of the vaccine plus handling, shipping and nursing time.' Laboratory services are based on the actual fees of laboratory contractors, price lists are available upon request. The Clinical Services Financial Guidelines policy is in place, reviewed and updated annually, using the Federal Poverty Guidelines to establish the sliding fee schedule. A copy of the sliding fee schedule will be available upon request. The sliding fee schedule will not be available or offered for privately purchased vaccines administered for international travel or outside laboratory cost. Certain service fees may be waived, including but not limited to communicable disease prevention cases, medications, laboratory services or vaccines to prevent outbreaks of communicable disease, where personal insurance denies reimbursement. Jefferson County public health will automatically implement future modifications to fees for vaccines, medications, and medical supplies when any of the following changes occur: (1) The actual cost of the service provided by an outside vendor, the supply, medication, vaccine, and laboratory charges, and like costs plus shipping and handling fees. (2) Any new Federal Poverty Guidelines that are published annually. (3) The maximum allowable Medicaid reimbursement rate. Fees for vital records are set by RCW 70.58A.56074—.5-4�+. The cost sheet is available by request. Environmental health fees, established by Section I-010, shall be adjusted annually on the first business day of January (adjustment date) by the amount of the increase of the Consumer Price Index as reported for the month of September preceding the adjustment date, following the annual fee indexing criteria established in Jefferson County Ordinance No. 12-96. Beginning with the year 2015, there is hereby established for the clean water district a fee of $20.00 per year per tax parcel, except for parcels or lands described in JCC 8.65.100. The clean water district fee shall be adjusted annually accordingly on the first business day of January (adjusted date) by the amount of the increase in the Consumer Price Index (CPIW). Filing fee for filing an appeal with the hearing examiner $250.00 JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of Commissioners Mark McCauley, County Administrator FROM: Barbara Dykes Ehrlichman, Civil Deputy Prosecuting Attorney DATE: November 27, 2023 SUBJECT: HEARING re: Public Fee Changes for the County Auditor, the County Sheriff,the Public Records Act Administrator,the County Clerk, and the Department of Public Health(Environmental Health) STATEMENT OF ISSUE: In June 2023, the Board of County Commissioners adopted Ordinance No. 02-0612-23 to streamline and make more transparent the method for adopting fee schedules for county departments and offices. The previous method of adopting and amending fee schedules by ordinance lacked transparency and was cumbersome for county offices and departments with few resources. As a result, inaccurate fees were left in the code which did not reflect the current fee schedule used by the department or office. Under new chapter 3.80 of the Jefferson County Code (JCC), fee schedules are now adopted by resolution. To effect the transition, county departments and offices are encouraged to bring their fee schedules current by the end of the year, by eliminating the fees in the code and adopting a new fee schedule by resolution. Thereafter, the department or office can adopt new fees by resolution in future years. To accomplish this goal for a number of departments and offices at once, the Prosecuting Attorney's Office put together the necessary ordinances and resolutions for five departments to be considered together for the Board's review. The fee changes for all five offices/departments will be presented to the Board in a workshop format. In this package of five ordinances and resolutions, there are only a few minor changes to fee schedules, all of which can be discussed at the workshop and through the public hearing process. The five offices/departments are: (1) the County Auditor; (2) the County Sheriff; (3) the Public Records Act Administrator; (4) the Superior Court Clerk; and(5)the Department of Public Health. ANALYSIS: The Board has already made the decision to convert fee schedule adoption to resolution. These ordinances and fee resolutions implement the new chapter 3.80 JCC, and will help update our system and rid the code of inaccurate fee schedules. FISCAL IMPACT: Staff time will be saved and fees will be kept up to date. This will reduce expenditures. RECOMMENDATION: The Board of Health will attend a Joint Special Meeting of the Board of County Commissioners to hold a hearing on the 2023-2024 Public Fee Changes, and potentially take-action on the proposed ordinance and resolution for the Environmental Health Fees. After taking-action, the BOH will adjourn their meeting, and the BOCC will continue with their hearing to address the other proposed departmental fee changes.
