Request for variance from Shoreline Management Plan by George and Shirley Janders to enclose a portion of deck at residence located at 221 Madrona Road, Nordland, Wa . 2 . Physical description: This single family residence is located on waterfront property Facing Southwest on Kilisut Harbor . Property is located approximately one third mile South of Fort Flagler State Park on Marrowstone Island. The lot is 73+/- feet wide . The North and South property lines run almost due East-West . East boundry runs North-South . The West boundry follows the shoreline bank which cuts back from the North boundry at approximately 45 degrees to the Southeast, creating a bank facing Southwest . The house and deck are situated parallel to the bank . The deck is 9 feet 6 inches wide and extends the length of house . The front edge of the deck is 35+/- Feet from the bottom of the bank and approximately 15+/- Feet from the top of the bank . The base of the bank is protected by a rock bulkhead . The deck is supported by a stepped 8 inch concrete wall on 2'1 inch footing at the same level as the house footing . 3 . Applicants wish to enclose a portion of the deck 16 feet long by 9 feet 6 inches wide Cwidth of the deck) with glass windows and sliding doors with a cedar shake roof to create a solarium/sunporch . The enclosure will not extend beyond the waterward edge of the existing deck . It will not be used as a "living area" and will have no heat or plumbing . The sunporch will provide shelter from prevailing winds and adverse weather while allowing our Family , friends and guests to enjoy the view of the water, mountains, sea-birds and sunsets when it is not possible to use the unprotected deck . In addition, it will serve as a vestibule to shelter the existing glass sliding door From strong southerly winds during the winter months . The sunporch will also act as a solarium to capture solar heat that can be used to help heat the living area . There are a number of other benefits that accrue that just improve the quality of life-make life a little more pleasant and easier . 'l . To proceed with this project, which is not considered a "significant development" , a variance from the 30 Foot set back requirement is requested . The design of the project is such that it will not interfere with or cause any adverse effects to adjacent properties or to the shoreline . Commissioner Dennison moved to approve the call for bids and set the bid opening for May 22 , 1989 at 10 : 30 a.m. Commissioner B. G . Brown seconded the motion which carried by a unanimous vote. PLANNING AND BUILDING DEPARTMENT • Shoreline Setback Variance Request; Enclosure an Existing i ting Dec Jande r to Convert to a Sun Porch; 221 Madrona Road, Nordl ; arson Applicant: Mr . Janders was present when Associate Mr. Janders reviewed this request for a 15 foot shoreline The deck is wants to enclose an existing deck to make it a sun porch. dint15 feet from the top of the setback of a home .becauses are not the measurement isincluded in the measurement for taken from the foundation, but this request to enclose a portion of the porch which will require that the setback measurement be taken from the porch foundation. Mr. Janders noted that he is going to enclose 15 feet of his 55 foot long deck. The sun porch will not include heat or plumbing, but will have to meet the building code, Jim Pearson noted. Mr. Janders stated that there is wiring next to the sliding glass door in this area already. The request must meet the criteria for granting a variance, Commissioner Dennison commented. Commissioner B. G . Brown stated that he doesn' t see that this request meets hardship criteria. Mr. Janders respondfihP that nhis d in oche faces the southwest ( located on Killisut Harbor) and afternoon is a problem. The wind does not allow use of the deck even on nice days . Other considerations are that the sliding glass door needs protection from the wind, and the lawn furniture could then be left on the porch. Jim Pearson noted that there is a substantial deck and stairway on the neighboring property. Mr . Janders stated that anything he builds will be no closer to the water than what is already there . He added that what he is doing, he feels, is in compliance with the intent of the Shoreline program. He further noted that he is here because he is trying to follow all the rules and he is not trying to extend his house. Commissioner Dennison asked if he feels that this is the minimum amount of space needed to accomplish what he wants , given the restrictions? Mr. Janders responded that it is . The discussion continued regarding the variance criteria and the possible hardship caused. Commissioner B. G . Brown moved to grant the variance as Commissioners ' Meeting Minutes : Week of May 1 , 1989 Page: 4 requested. Chairman George Brown seconded 'the motion and called for a vote . Commissioner B. G. Brown and Commissioner George. Brown voted in favor of the motion and Commissioner Dennison voted against the motion. The motion carried by a majority vote. Residential Setback Variance; Side Yard; 51 Finch Lane Port Ludlow; Gil Berg, Applicant: Mr. & Mrs . Gil Berg and several neighboring property owners were present with Planning and Building Department Director, David Goldsmith, explained this request for a residential setback variance. The Berg's own Lot 8 in Division 6 at Bridgehaven. They are requesting a zero side yard setback for a carport , which has already been constructed . The Berg' s have recently applied for a building permit . The neighbors on one side have nerethat mustthe be three overhangs between structures, with The nofire code states thatt there h allowed. Mr . Berg stated that his property boundary is very poorly marked. He was and when he was going the boundary line when he purchased the property, g g to build a carport he measured what he thought was the property line . Since that time he has cut the carport back to his property line. There are no structures on the neighboring property. David Goldsmith noted that Mr . Berg is asking for a three foot setback ( from the overhang and five feet from the foundation) . Commissioner B. G . Brown moved to approve the variance as requested. Commissioner Dennison seconded the motion which carried by a unanimous vote. Union Wharf Project Update: David Goldsmith reported that the State Department of Fisheries has stated some concern about the amount of shading that the Union Wharf project will make over the water . The State Department of Ecology feels that this is not a significant problem. The County' s ownership in the wharf needs to be transferred to the City of Port Townsend so that this project can proceed. State Environmental Policy Act Review; Shoreline Substantial Development Permit; Intertidal Shellfish Cultivation Using Racks and Jacks; Thorndyke Bay; Jonathan Davis: Associate Planner Jim Pearson explained that this is an intertidal shellfish cultivation project located on Thorndyke Bay which uses rack culture and "vexar" cages containing oysters . Jim Pearson then reviewed the environmental checklist on the project . He explained that in the last week has received State Department of Fisheries interim guidelines on oyster rack aquaculture projects . The Fisheries theDepartmant want to have the proponents note where vegetation is growing to site the racks so that they are away from eel grass beds and to also do some monitoring. Two suggested conditions of approval for this project were also reviewed. Commissioner Dennison moved to issue a mitigated determination of non- significance on the intertidal shellfish cultivation project submitted by Jonathan Davis . Commissioner B. G . Brown seconded the motion which carried by a unanimous vote. JUVENILE SERVICES GRANT APPLICATION re: Juvenile Detention Alternative Program; Juvenile Justice Section; State Department of Social and Health Services: Lois Smith, Juvenile and Family Court Services Director, reported that this grant application, if approved, would provide funding for an alternative juvenile detention for youths that meet specific criteria . The total grant application is for $45 , 307 .
