Your bi-monthly update on county related legislative activity January 19, 2024 <https://mcusercontent.com/6943e0d4535671f24022ca02a/images/deee067b-8d4c-3a3a-a72a-403f29828a1c.png> Reducing Emissions From Small Off-Road Engines ________________________________ <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=4df75fd206&e=d6a9a6cb0d> HB 2051 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=51a2134235&e=d6a9a6cb0d> aims to reduce carbon emissions from outdoor power equipment by adopting Title 13 of the California Code of Regulation, which would classify specific pieces of equipment that will need to be replaced by zero-emission equipment beginning in 2027. The adoption of Title 13 would only apply the new standards to equipment manufactured on or after January 1, 2027, and would not prohibit the use or sale of older equipment. The bill specifically exempts chainsaws and generators and establishes a new grant program to ease the transition for local jurisdictions. Unlike the past several sessions, where the pandemic and COVID-19 seemed to permeate every health-related topic, this year has provided a chance for public health to refocus and turn attention to several of their tried-and-true programs and services. As a result, several priority bills are already actively moving through the legislative process. Read more <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=b9f019e77a&e=d6a9a6cb0d> Prejudgment Interest, Elections Bills, and Public Records Litigation Relief ________________________________ <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=3552f5ce47&e=d6a9a6cb0d> The 2024 Session started out with significant legislation moving in several areas. First, SB 5059 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=d3ca9d8482&e=d6a9a6cb0d> , which would apply prejudgment interest to tort cases, was brought up in a slightly new form. Last year, WSAC and other stakeholders managed to stop this bill because of the inequitable way this interest was applied and the costs it would impose on our risk pools. More recently, WSAC has worked with other stakeholders to improve the bill by taking out certain claims and exempting future damages from its application, but the bill would still significantly impact our risk pools and make it more expensive to get insurance. It may also result in fewer policies being offered as insurers decide the market is too volatile. For these reasons, we continue to oppose this measure and look for solutions that offer fair compensation without imposing excessive litigation or judgment costs. Most of them impact only a very small portion of the greater public defense issue, such as internships for rural public defenders (SB 5781 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=07d2663e14&e=d6a9a6cb0d> ) and additional training for public defenders (SB 5780 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=b70b0441f5&e=d6a9a6cb0d> ). While they are helpful to counties, they do very little to defray the cost of trial court public defense. The bills offered that propose to provide real money for the system (SB 5773 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=9cc04caf e2&e=d6a9a6cb0d> and HB 2202 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=b7f8236f75&e=d6a9a6cb0d> ) have yet to be scheduled for a hearing, and with the looming lawsuit against the state on this very issue, will not likely be scheduled while that suit is pending. Read more <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=f2baf67e76&e=d6a9a6cb0d> More Focus This Year on ADUs ________________________________ <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=b91ce3fe14&e=d6a9a6cb0d> The 2024 Legislature is continuing the work of the last several sessions, putting much of its focus on solving the housing crisis. Once again, it’s turning to accessory dwelling units, or ADUs, as part of the solution. Detached ADUs in rural lands are the focus of this year’s legislative proposals. HB 2126 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=0fe1bf00ba&e=d6a9a6cb0d> would allow counties to authorize the development of detached ADUs in rural areas on all residential lots as long as they meet certain requirements for water supply, septic, structure size, etc. SB 6029 <https://wsac.us3.list-manage.com/track/click?u=6943e0d4535671f24022ca02a&id=c35c70d46c&e=d6a9a6cb0d> would require counties to allow detached ADUs with similar requirements in rural areas.
