PROVING TDIU CLAIMS In terms of dollar benefits, a total disability rating based upon individual unemployability (“TDIU”) is the equivalent of a 100 percent schedular rating. If a Veteran cannot work due to one or more service-connected disabilities, then he/she is entitled to a TDIU award. For TDIU requests/claims, the biggest challenge is proving the Veteran’s unemployability. The VA uses the term substantial gainful employment, defined as employment producing earnings above the poverty threshold. In Ray v. Wilkie, 31 Vet. App. 58 (2019), the Veterans Court indicated that the bottom line for determining unemployability is whether the veteran’s service-connected disability(ies) prevents him/her from being a reliable and productive employee. Another way to state the question is “whether a particular job is realistically within the physical and mental capabilities of the claimant.” Moore v. Derwinski,1 Vet.App. 356, 359 (1991). In denying TDIU requests, VA adjudicators typically give poor reasons for finding the veteran employable. For example, they frequently deny TDIU requests if a veteran shows an ability to perform house chores. That is wrong. James v. Brown, 7 Vet.App. 495, 496 (indicating that evidence of some childcare and housework performance does not automatically signal a veteran's ability to secure or maintain gainful employment). TDIU requests are often denied if a veteran is attending a university or other educational institution. That too is wrong. Washington v. Derwinski, 1 Vet. App. 459, 465-66 (1991) (rejecting The Board's conclusion that employability is based upon the veteran attending school because the skills needed to attend school are different from the skills needed to compete successfully in the workplace).
