Recitals 1. WSDOT is planning the construction or improvement of a section of state highway as shown above, and 2. In the construction of the project it is planned to use, for the purpose noted above, those Local Agency roads or streets described above and as further detailed in red on the attached Exhibit"A", and 3. It is anticipated that as a result of the use of these roads or streets, additional maintenance expense may be incurred by the Local Agency. Now Therefore, It Is Mutually Agreed As Follows: 1. The Local Agency hereby agrees to WSDOT's use of the roads or streets covered by this Agreement subject to the conditions contained herein. 2. Immediately prior to the beginning of WSDOT's use of the above described roads or streets, the parties to this Agreement shall make a joint condition inspection and WSDOT shall prepare a memorandum record of the condition of said roads or streets.The memorandum record shall include a statement of the extent and frequency of routine maintenance operations normally carried out by the Local Agency on said roads or streets and may include photographs showing condition of the existing roadway. 3. WSDOT agrees to reimburse the Local Agency for the cost of additional routine maintenance and repairs, operations in excess of those enumerated in the record made under the provisions of Section II, made necessary by WSDOT's project. The reimbursement for such additional routine maintenance and repairs shall be limited to the actual cost of such operations supported by proper records. Such costs are to be exclusive of all administrative and overhead costs and all charges for small tools. 4. Upon completion of use of the roads or streets covered by this Agreement, a joint inspection shall be made by the parties to determine the condition of said roads or streets.All maintenance and/or repairs shall be based upon the conditions of these roads or streets at the time of this completion inspection, taking into account the memorandum record made under Section 2. 5. It is expressly understood that WSDOT shall be responsible only for that extra maintenance and repairs of the Local Agency's roads or streets occasioned by the project use. In the event of a dispute over the terms of this Agreement and/or the extent of maintenance or repair work required to be performed, the dispute shall be submitted to the Secretary of Transportation for determination. In determining this responsibility the Secretary shall give consideration to the memorandum record provided for in Section 2. The conclusions of the Secretary as to the extent and amount of such maintenance shall be final and conclusive as to all parties to this Agreement. DOT Form 224-014 Page 1 of 2 Revised 07/2018 6. The Local Agency agrees not to restrict below legal limits the size, weight, or speed of vehicles using the roads or streets covered by this Agreement except as stated above under Vehicle Restrictions. 7. No liability shall attach to WSDOT or the Local Agency by reason of entering into this Agreement except as expressly provided herein. Work for the full 29 roadway closure shall be considered complete and the road ready to open to 30 traffic when all segments shaded in Stage 2 of the staging plans are complete, 31 all paving and temporary pavement markings are complete, all Contractor 32 equipment and personnel are cleared from the roadway clear zone, and all 33 signs, barricades, and PCMS's pertaining to the roadway closure and detour 34 have been covered, removed, or turned off, or as determined by the Engineer. 35 The roadway shall not be opened to traffic before the final lift of HMA is placed 36 and traffic flow will not be allowed until all highway safety elements are in place. 37 38 The full roadway closure shall begin on or after May 1st, 2024, and be complete 39 on or before June 15th, 2024, unless otherwise approved by the Engineer. 40 41 The Contractor shall select the specific closure dates within this period and notify 42 the Engineer in writing of the schedule dates a minimum of 10 calendar days 43 prior to the planned start of the closure. Only extreme weather events or 44 extenuating circumstances, as determined by the Engineer, will be considered 45 allowable reasons to change the planned start date after notification has been 46 given. The Engineer may deny approval of the Contractor's selected start date 47 if the required and advanced notification is not received. The dates of the one- 48 time full roadway closure shall be displayed on PCMS boards and Class A signs 49 at the project site for 7 days in advance of the closure, as shown in the Plans. 50 1 The total duration of the closure shall not exceed 21 days. The measurement of 2 the total closure period will begin at 00:00 on the planned closure start date, or 3 as approved by the Engineer. 4 5 Partial Closure of SR19 with Detour onto Center Rd 6 7 The contractor will be permitted partial closure of SR 19 at SR 104 for the 8 duration of Stage 1 and Stage 3 construction to allow northbound turning 9 movements from SR 104 to SR 19 and eastbound turning movements from SR 10 19toSR 104. 11 12 The Stage 1 and Stage 3 partial detours shall occur between the dates of April 13 1 and July 30, 2024. 14 15 Traffic will be detoured onto Center Rd as shown on the Plans. 16 17 State Route 104 Short Term Traffic Holds 18 19 Short Term Traffic Holds for construction vehicle ingress and egress may be 20 performed at any time through normal legal movements diverging and merging 21 with public traffic. Traffic holds for truck ingress and egress shall be limited to 1 22 minute or less. 23 24 Short term traffic hold for activities beyond construction vehicle ingress and 25 egress shall be limited to 23:00 to 5:00, maximum 5 minute duration. Traffic 26 holds shall be coordinated with the Hood Canal Bridge closures to minimize 27 traffic impacts. 28 29 Release traffic in all directions until queues dissipate before commencing 30 another traffic hold. Where bicyclists and motorists need to share a lane 31 following the end of traffic holds, release motorists first allowing queues to clear 32 and then allow bicyclists to proceed. 33 34 If the Engineer determines the permitted closure hours adversely affect traffic, 35 the Engineer may adjust the hours accordingly. The Engineer will notify the 36 Contractor in writing of any change in the closure hours. Exceptions to these 37 restrictions are listed below and when applicable take precedence over closures 38 listed above. The Engineer may also consider on a case-by-case basis 39 additional exceptions following a written request by the Contractor. 40 41 Lane, ramp, shoulder, and roadway closures are not allowed on any of the following: 42 43 1. A holiday, 44 45 2. A holiday weekend; holidays that occur on Friday, Saturday, Sunday or 46 Monday are considered a holiday weekend. A holiday weekend includes 47 Saturday, Sunday, and the holiday. 48 49 3. After 12:00 on the day prior to a holiday or holiday weekend, and 50 51 4. Before 12:00 on the day after the holiday or holiday weekend. 52 1 5. The two-hour period prior to and the two-hour period after the following 2 special events: 3 4 Discovery Marathon June 1 —2, 2024 5 Lavendar Festival July 19—July 21, 2024 6 Wooden Boat Festival September 6—September 8, 2024 7 8 9 It shall be the Contractor's responsibility to obtain the dates and times of all 10 events. The 21 consecutive calendar day closures for SR 19 are not subject 11 to the holiday closure requirements. 12 13 Traffic Delays 14 When Automated Flagger Assistance Devices (AFADs) or flaggers are used to 15 control traffic, traffic shall not be stopped for more than 15 minutes at any time. All 16 traffic congestion shall be allowed to clear before traffic is delayed again. 17 18 If the delay becomes greater than 15 minutes,the Contractor shall immediately begin 19 to take action to cease the operations that are causing the delays. If the 15 minute 20 delay limit has been exceeded, as determined by the Engineer, the Contractor shall 21 provide to the Engineer, a written proposal to revise his work operations to meet the 22 15 minute limit. This proposal shall be accepted by the Engineer prior to resuming 23 any work requiring traffic control. 24 25 There shall be no delay to medical,fire, or other emergency vehicles. The Contractor 26 shall alert all flaggers and personnel of this requirement. 27 28 General Restrictions 29 Construction vehicles using a closed traffic lane shall travel only in the normal 30 direction of traffic flow unless expressly allowed in an accepted traffic control plan. 31 Construction vehicles shall be equipped with flashing or rotating amber lights. 32 33 No two consecutive on-ramps, off-ramps,or intersections shall be closed at the same 34 time and only one ramp at an interchange shall be closed, unless specifically shown 35 in the Plans. 36 37 Roads or ramps that are designated as part of a detour shall not be closed or 38 restricted during the implementation of that detour, unless specifically shown in the 39 Plans. 40 41 Note: "controlled access" paragraph is deleted. 42 43 Advance Notification 44 The Contractor shall notify the Engineer in writing of any traffic impacts related to 45 lane closure, shoulder closure, sidewalk closure, or any combination for the week by 46 12:00 p.m. (noon)Wednesday the week prior to the stated impacts. 47 48 The Contractor shall notify the Engineer in writing ten working days in advance of 49 any traffic impacts related to full roadway closure, ramp closure, or both. 50 The Contractor shall notify the Engineer in writing of any changes to the stated traffic 51 impacts a minimum of 48 hours prior to the traffic impacts.
