HomeMy WebLinkAbout022924 letter re: DCD permit RECEIVED Most respectfully 1 JAN 2 9 2024 j� ,v JEFFERSON COUNTY COMMISSIONERS In 2010 Jefferson County accepted a permit application to put up a Radio Tower in the middle of a 300 x 1200 foot rural vacant lot. No development in the immediate proximity; no one cared. The permit was approved/issued with a "Renewable Lease." Ten hears later that wasn't the case. The antenna has to move. April 18, 2023 the County accepts a building permit application for an antenna location about one-third of a mile away. It was an application to "relocate" the existing tower on Jacob Miller Road to 35 Rainshadow Drive. The truth in fact was to demolish the tower on Jacob Miller Road and construct a new tower on Rainshadow Drive. A SEPA from 2023 was submitted with the application. DCD issued a Determination of Non-significance July 18, 2023. DCD then said there would be a revision to the DNS. August 16, a new DNS was declared and that document is the SEPA from 2010 at 591 Jacob Miller Road. DCD/David Wayne Johnson claims this is okay because the two sites are "identical". The locations are totally different. In fact, the project has expanded to include a studio and office. Old location - no staff; new location - office and studio (presumed to be staffed). The resident and rural elements are totally different. 3 to 4 times the population density and treed verses clear-cut. The access is private, not public like Jacob Miller Road. The entire permitting process was different in 2010. The current applications, both original and supplemental, have representations that the county knows to be false (accepted that way and not corrected/denied). The relevant SEPA is the current SEPA of 2023 which has been disregarded. DCD has accepted and made untrue assertions. The county does have land for utilities and right-of -way on Jacob Miller. (map attached) The county has failed to engage all the affected property owners on the private road. The owners at the end of the dead-end road are not counted and one owner has been avoided. DCD has allowed storm water calculations to be manipulated. The terms: relocation, non- commerical, and identical have been misused to the point of ?... Deliberately designed to mislead. Another observation revealed, "the tower will not be visible from any residence or road" (DWJ) Simply untrue; Go walk it. Further, there has been a misinformation campaign to scare people into the idea that there will be no emergency broadcasting if KPTZ doesn't get this antenna. First, the emergency broadcasting could be handled by the KPTZ antenna on Morgan Hill provided by the city in 2019. Second, KROH, right here in Port Townsend is better equipped now than KPTZ will ever be in terms of emergency broadcasting, and they are hooked up to the system. Add all the other AM and FM stations that can broadcast emergency information and the conclusion should be: KPTZ can broadcast emergency information but its not a reason for there to be another radio station. We believe this tower is going to be a visual nightmare to our neighborhood. If it is this great an asset to our community, put it on county land on Jacob Miller Road. Please revoke the permit or remand it back to the county for a fair and correct process. Thank You. One was not concerned, the other doesn't want it but didn't think anything could be done. Thrown together last minute. Not to difficult to sift through if your interested. A copy of this DNS is attached as EXHIBIT B 2 and is incorporated herein by reference. 3 4. Respondent COUNTY through its Department of Community Development 4 5 issued a Revised Determination of Non-Significance on September 7, 2023 which is the subject 6 matter of this appeal. A copy of this revised Determination of Non-Significance is attached as 7 EXHIBIT C and is incorporated herein by reference. 8 5. On April 20. 2023, the COUNTY received a Supplemental 9 10 Application/Residential or Commercial Bldg Permit from RADIO PORT TOWNSEND. Copy 11 attached as EXHIBIT D. 12 6. Based on the Supplemental Application and the Revised Determination of Non- 13 Significance. The COUNTY issued a Building Permit for the project. A copy is attached as 14 EXHIBIT E. 15 16 COUNTY ERRORS IN ISSUING THE BUILDING PERMIT 17 The County erred in issuing the building permit for the 190-foot radio tower at 35 18 19 Rainshadow Drive on 9/13/2023 for the following reasons: 20 1. The County failed to require Site Development Review(SDR)prior to the 21 submittal of a development application in violation of Jefferson County Code (JCC) 18.40.440; 22 2. The County failed to require a Legal Lot of Record (LLOR) determination prior 23 to the submittal of a development application in violation of JCC 18.12.030; 24 25 3. The County relied on a 13-year-old SEPA determination for a different project on 26 a different lot to reach its Determination of Non-Significance (DNS). The County processed the application as a Utility Development, Minor under JCC 2 18.20.400 rather than as a Utility Development, Major under RCW 18.20.410; 3 5. The County processed the SEPA determination under the term "relocation" of an 4 5 existing tower when, in fact, this is an entirely new project on a different parcel AR 15-17; 6 6. The County failed to require a Conditional Use Permit(CUP) for the project; 7. The County issued the permit that violates the height restriction of RR-1/5 zoning; 8 8. The County had no factual basis for making a SEPA determination that a 190-foot 9 io tower would not be visible from the road or adjacent properties; and 11 9. The County did not follow its own process which would have required proper 12 public notice and a public hearing regarding the project. 13 STANDARD OF REVIEW 14 The Standard of review for the Land Use Petition Act review is contained in RCW 15 16 RCW 36.70C.130, which provides in pertinent part: 17 Standards for granting relief—Renewable resource projects within energy overlay zones. 18 (1) The superior court, acting without a jury, shall review the record and such 19 supplemental evidence as is permitted under RCW 36.70C.120. The court may grant relief only if the party seeking relief has carried the burden of establishing that one of the 20 standards set forth in (a)through (f) of this subsection has been met. My greatest concern is that a low power local radio station broadcasting transmitter isnt the end use of this tower. While im not very happy to have any tower in a residential area (especially mine) its something that if done thoughtfully, as has been implied will be done, I could live with.... but even thats a stretch. My real concern is this tower being used for cell phone repeaters, wireless intemet, TV and who knows what else. Once a 25 yr lease is out of the bag I suspect it may be very difficult to reign it in if very specific and strong legal language is not in the original contract. Its realy easy to picture a cash strapped (or completely bankrupt) public radio station in a financial bind, then being offered a huge amount of money by a broadcaster to have another transmitter (with different and much stronger radiation) added to the tower at no cost or inconvenience to our friendly hometown public station... and down the hole we go... I include my original email to Mark Magee with an article link discussing some of the difficulties of towers and the financial elements in particular. Mark didnt have much to say about my comments. I am interested in what concerns you have with the tower as well. I appreciate and support public radio and even the emergency response system, but find the idea of a radio tower in a residential area abhorrent. And yes,a little nimby. If the tower is 423 feet above sea level,it would be about 240 feet above ground level,which makes it hard to believe it would be hidden from the road and all of our lots. Not to mention the flashing lights at the top of the tower radiating through the night sky,especially when foggy... *Mark has said there will be no Tight* While Im not too happy about having the RF radiation in close proximityto any residence, I do understand that this is a low powered transmitter.Their class Astatus may allow for a tripling of their current power though. What Im really concerned about however is the potential of another entity,like a cell phone provider or TVstation,renting space on this (25 year lease)tower. These frequencies are vastly more harmful to nearby inhabitants as well as being quite a source of income for financially strapped public stations. A25 year lease can fall into the hands of anyone with the resources once issued.
