I represent District 2 on the Planning Commission. I need to point out that there are occasions in the draft Shoreline Master Program (SMP) document where the DCD consultants changed
existing requirements from “shall” to “should”. “Shall” is a mandatory requirement while “Should” is a suggestion.
I draw your attention to lines 4581, 4582, and 4583 of the draft document:
“(xvii) Aquacultural facilities should be designed and located so as not to spread disease to native aquatic life, establish new non-native species which cause significant ecological
impacts, or significantly impact the aesthetic qualities of the shoreline.”
The word “should” means it is a goal and not a hard requirement. In my opinion this needs to be made non-negotiable by using the word “shall”.
