Dear Kate and Heidi, That was a solid discussion today. As you know, we believe that a standard CUP for all geoduck applications is the simplest, fairest, and most effective way to regulate geoduck cultivation. We are heartened, however, to hear both of you express interest in requiring a standard CUP in more situations than the Planning Commission recommendation contemplates. Specifically, we heard ideas along the following possibilities, which we think move in the right direction. (Threshold values were not specifically proposed.) Maybe this language will help you think through a good resolution: Applications for geoduck cultivation require a discretionary CUP (CUP(d)), EXCEPT that an application for geoduck cultivation requires a standard CUP, if it: 1) Is for a site in a Shoreline Residential zone; OR 2) Would expand a site's existing cultivated acreage by more than 25%; OR 3) Would convert more than 25% of a site's existing cultivated acreage; OR 4) Would expand the existing site by more than 2 acres; OR 5) Would convert more than 2 acres of a site's existing cultivated acreage: OR 6) Is for a site in a Priority Aquatic zone; OR 7) Is for a site in a Conservation zone; OR 8) Is for expansion of a site that has no current county shoreline permit; OR 9) Is for full or partial conversion of a site that has no current county shoreline permit; OR 10) Is for a site that has no existing shellfish cultivation and no current county shoreline permit.
