Joe Briggs, NACo West Region Representative, Commissioner, Cascade County, Montana GOVERNMENT AFFAIRS Update on the Secure Rural Schools (SRS) Reauthorization Act of 2023 (H.R. 5030/S. 2581) – Joe Jackson, Legislative Assistant * The Secure Rural Schools program expired on September 30, 2023 and has not been reauthorized * Counties will receive their last authorized SRS payment in spring 2024. If SRS is not reauthorized, the U.S. Forest Service will begin distributing 25% timber sales receipts to counties in February 2025. Nationally on average, this would result in an 80% reduction in payments to national forest county payments compared to SRS * NACo staff will provide an update on recent advocacy efforts to pass SRS reauthorization legislation and illustrate the path forward New Treasury obligation guidance for ARPA State an Local Fiscal Recovery Fund – Eryn Hurley, Director of Government Affairs * On March 29, the U.S. Department of Treasury (Treasury) released new FAQs <https://www.mmsend50.com/link.cfm?r=b_5cxdcAxAVR3h0NaLyCOA~~&pe=VcuxRvI_Nz9KD2c7KgokIbN9MFEK4kUk5eyH0XfrIjwmmzDGnaa_JEkB9F hTYcbpDgyw_MlWbwW7XBNroRdu9w~~&t=lC4igmSrEvwNnlMO679Tvw~~> related to their Obligation Interim Final Rule (IFR) <https://www.mmsend50.com/link.cfm?r=b_5cxdcAxAVR3h0NaLyCOA~~&pe=WR0RhhaJkSVi_KYNidvlJ Asok3Qe36tlZAmZgB1mO1I-amicF-hzE-ljoU_vIPi-ocM2M5IR6AwzDkclA77PqQ~~&t=lC4igmSrEvwNnlMO679Tvw~~> for the ARPA State and Local Fiscal Recovery Fund (SLFRF) * Addressing concerns raised by NACo <https://www.mmsend50.com/link.cfm?r=b_5cxdcAxAVR3h0NaLyCOA~~&pe=Mh4wF10dZza5EG5WngF5p0lESKHq9lVD9iDRw9Mr2e-SId5-EYoqZTdEql62UcRN9T9OKzVs7l9EDhJLpQ37QQ~~&t=lC4igm SrEvwNnlMO679Tvw~~> , the FAQs offer insights into personnel costs, subrecipient obligations, revenue loss, and handling excess funds * Counties may use SLFRF funds for personnel costs for any eligible position through December 31, 2026, that was filed prior to December 31, 2024 – This is a deviation from the Obligation IFR, which stated SLFRF funds may only be used to cover personnel costs for individuals responsible for reporting/compliance for SLFRF * If a county decides to use SLFRF funds for personnel costs, it is required to collect information and report this to Treasury by either January 31, 2025 (for quarterly ARPA report filers) and April 30, 2025 (annual ARPA report filers) – This is an extension from the previous April 30, 2024 deadline * Subrecipients are NOT subject to the December 31, 2024 obligation deadline * After the December 31, 2024, obligation deadline, if a county has excess funds that were already obligated but not yet expended, the county may reclassify SLFRF funds from the original activity to another project that is eligible under SLFRF guidance Update on the U.S. Forest Service proposed rule on Old Growth Forest Conditions – Joe Jackson, Legislative Assistant * In December, 2023, the U.S. Forest Service released a proposed rule on Old Growth Forests which would amend all land management plans for units of the National Forest System * Implementation of new regulations and guidelines must follow the Forest Service’s existing multiple-use mandates and legal requirement to coordinate and cooperate with state, local and Tribal governments * Currently, the rule only calls for “State agencies and Federally recognized Tribes and Alaska Native Corporations” to participate as cooperating agencies. The Forest Service does not mention counties * NACo staff will provide an update on ongoing efforts to engage with the U.S. Forest Service to amend the proposed rule to include local governments throughout the text and extend the authority to participate as a cooperating agency to county governments TECHNOLOGY AI Technology & Cyberattack Stats Updates - Rite Reynolds, Chief Information Officer * NACo AI – Recent work including highlights from the membership survey on AI will be shared with caucus members.
