Black Shield Oyster Co. Habitat Survey Report
(to accompany map dated 10/18/2021)
A habitat survey was performed on June 24, 2021 from approximately 10:00 am to 11:00 am at an oyster
aquaculture project site located near 312251 US-101, Brinnon, WA 98320. Darby Flanagan and Griffin
Hoins from Marine Surveys & Assessments surveyed along 9 transects at low tide to identify flora, fauna,
substrate types and other qualitative information. Weather was sunny and calm.
The survey area is shown in Figure 2. Nine transects (T1-T9) were surveyed; each was 115 ft long and
transects were separated by each other by 10 ft, running between existing oyster lines and bags (Figure 1).
Substrate was mud, pebble, shell hash, and oysters throughout the survey area.
Areas of sparse, low density macroalgae were recorded at the site and included:
• Ulva 2% cover;
• Desmarestia 2 to 20% cover.
The total percent cover of vegetation within this area is typically calculated and mapped to determine
vegetation scenarios (Figure 2). Ulva is not included in these mapped calculations because the area is not
documented as a herring spawning zone. No eelgrass or kelp was documented at the site.

The project is reviewed under JCC 18.25.440 Aquaculture. Any portion of the project requiring a
Shoreline Substantial Development Permit would be permitted under a Type III review process.
Aquaculture is permitted in Shoreline Environment Designation: Priority Aquatic (shellfish area), Natural
(land area).
I. Policy on Aquaculture -- JCC 18.25.440 (1)(a) & (b)
Aquaculture is a preferred, water-dependent use of regional and statewide interest that is important to
the long-term economic viability, cultural heritage and environmental health of Jefferson County.
The county should support aquaculture uses and developments that:
• Protect and improve water quality; and
• Minimize damage to important nearshore habitats; and
• Minimize interference with navigation and normal public use of surface waters; and
• Minimize the potential for cumulative adverse impacts, such as those resulting from in-water
structures/apparatus/equipment, land-based facilities, and substrate disturbance/modification
(including rate, frequency, and spatial extent).”

II. Primary Criteria for Shoreline Development Permit or Conditional Use Permit JCC
18.25.440 (4)(c)
Aquaculture uses and activities involving hatching, seeding, planting, cultivating, raising and/or
harvesting of planted or naturally occurring shellfish shall not be considered development, as defined in
Article II of this chapter, and shall not require a shoreline substantial development permit, unless:
(i) The activity substantially interferes with normal public use of surface waters; or
(ii) The activity involves placement of any structures as defined in Article II of this chapter; or
(iii) The activity involves dredging using mechanical equipment such as clamshell, dipper, or scraper; or
(iv) The activity involves filling of tidelands or bedlands.
18.25.100(19)(rr) *“Structure” means a permanent or temporary edifice or building or any piece of
work artificially built up or composed of parts joined together in some definite manner, whether
installed on, above, or below the surface of the ground or water, except for vessels (WAC 173-27-
030). Retaining walls, bulkheads, fences, landscaping walls/decorative rockeries, and similar
improvements to real property are examples of structures. Geoduck tubes are not considered
structures for purposes of this program.
B. Critical Areas (Chapter 18.22 JCC)
Fish and Wildlife Habitat Conservation Areas (marine habitat for listed species, potential eelgrass and/or
kelp beds, and/or forage fish habitat) – proposal must protect fish and wildlife habitat conservation area
and associated buffer. Submit a report that complies with Chapter 18.22 JCC.

If any portion of the project is in the FEMA flood boundary, then federally-listed species needs to be
addressed. This can be done by Corps permitting or by submitting a Habitat Assessment to the County.
18.22.430(2) Compliance with National Marine Fisheries Service Biological Opinion. Development
proposed within regulated frequently flooded areas and floodplains shall ensure no impacts to listed fish
and wildlife habitat as required by the National Marine Fisheries Service (NMFS) September 22, 2008,
final Biological Opinion (BiOp) under the Endangered Species Act (ESA) on the National Flood Insurance
Program (NFIP) in Puget Sound (NMFS Tracking No.: 2006-00472 (or as amended by NMFS)).

(a) A habitat assessment that meets all the requirements of JCC 18.22.940 shall be submitted to
the department for review if any portion of the proposed project occurs within a special flood
hazard area (floodplain), as mapped by the Federal Emergency Management Agency (FEMA).
(b) The administrator may request federal assistance in reviewing the submitted habitat
assessment.
(c) The administrator may waive the requirement to submit a habitat assessment only if:
(i) The entire proposal meets one of the exemptions listed in Chapter 15.15 JCC and
does not require a state hydraulic permit;
(ii) The proposal requires a federal permit that is reviewed by federal agencies
responsible for ensuring compliance with the Endangered Species Act (this could include,
but is not limited to, project actions covered by separate consultation under Section 4(d),
7, or 10 of the Endangered Species Act);
(iii) A habitat assessment previously has been prepared and the proposed project clearly
fits within the nature and scope of that habitat assessment; or
(iv) If FEMA approves an alternate process for Jefferson County to demonstrate
compliance with the Biological Opinion (such as a programmatic review), this department
may waive the requirement to submit a habitat assessment. [Ord. 5-20 § 2 (Appx. A)]
D. Other Regulatory/Land Use Considerations
• The project must comply with the Shoreline Management Act and will be reviewed by the
Department of Ecology, and receive final approval from Department of Ecology.
• The project may need a Hydraulic Project Approval (HPA) from Washington Department of Fish
and Wildlife (for permanent structures).
• The project will be reviewed by Washington Department of Natural Resources.
• The project will be reviewed by Washington Department of Health.

• The project may require a permit from the U.S. Army Corps of Engineers. This agency has
jurisdiction over waters of the U.S., including wetlands, and issues permits pursuant to the Clean
Water Act.
