Updates:
The agenda request submitted this week will include references to changes made from the last SMP line-in/line-out iteration to this one.
Also, during this morning’s public comment, the following issues came up that merit clarification:
1. Contention: Shoreline armoring and other impactful uses require less process and/or simpler permits than aquaculture. To clarify, the Shoreline Management (SMA) contains a shoreline
permit exemption (since the original act adopted 1970-71) for shoreline armoring to protect single-family residences. Since then, the WAC has changed to integrate habitat protection
more firmly into review of shoreline armoring proposals (even though the SMA exemption hasn’t changed). Our existing and proposed SMP includes armoring standard updates per Ecology.
2. Requiring a Conditional Use Permit (CUP) for new geoduck aquaculture is burdensome: As explained in a single-issue memo to the Planning Commission, the Washington Administrative Code
(WAC) was changed to require a shoreline CUP for new geoduck aquaculture. That same WAC provides discretion to local government on the permit type (and, by extension, process) for conversion.
Finally, the WAC is silent on whether expansion is “new” or not. Thus, we have prerogative on that policy. The type of process to get to a shoreline CUP is also our prerogative, as
has been discussed during deliberations.
We will be prepared to discuss these issues further, as needed, on Monday.

We are set to continue deliberations on proposed SMP amendments on Monday, February 26 at 9:30 AM (lasting until noon, if need be). This session will include continuation of the public
hearing initiated earlier this year. In order to provide ample time for public review, I have posted the latest iteration on the SMP Periodic Review webpage <https://www.co.jefferson.wa.us/1481/Shor
eline-Master-Program-Periodic-Review> . The February 16 version is the Planning Commission recommendation plus changes/additions made by staff/consultants in order to implement Board
direction from deliberations to date. Look for edits highlighted in green, along with corresponding comments in the margins.
The goal of the February 16 26 session is for you to receive input from the public on the latest version, deliberate on same, and provide direction to staff to make any Board-directed
changes for the “final” version to come before you at a later date, along with an adopting ordinance. That final version could have additional staff-generated changes as a result of
risk/legal review; any such changes would be identified in a staff report accompanying the final version and the adopting ordinance. We are targeting Monday, March 18 for Board consideration
of that ordinance, with that final version posted on the web on or around March 6.
