The LHHS and T-HUD bills were advanced by their respective subcommittees on Thursday. The full committee intends to consider the LHHS bill on July 10, 2024. We have included summaries and accompanying materials provided by the House Appropriations Committee for your review below. U.S. Department of Transportation The bill would provide $106.67 billion in total budgetary resources for DOT, a $1.856 billion decrease below the FY 2024 enacted level. This would include $25.131 billion in discretionary resources, a $1.856 billion decrease below the FY 2024 enacted level. Specifically, the measure would provide: * $807 million for the Office of the Secretary; * $63.544 billion in total budgetary resources for the Federal Highway Administration (FHWA), a $552 million increase above the FY 2024 enacted level, including $61.314 billion in obligation limitation from the Highway Trust Fund (HTF) and funding toward the following Highway Infrastructure Programs (HIP): * $200 million in additional funding for the Nationally Significant Multimodal Freight and Highway Projects, or INFRA Program, to support truck parking projects; and * $5 million to implement a new competitive program authorized by the Bipartisan Infrastructure Law (P.L. 117-58) to support bollard installation projects with direct eligibility for local government entities; * $21.657 billion in total budgetary resources for the Federal Aviation Administration (FAA), a $1.576 billion increase above the FY 2024 enacted level, including: * $13.588 billion for air traffic control operations and the hiring of 2,000 air traffic controllers; and * $3.549 billion for facilities and equipment, a $358 million increase above the FY 2024 enacted level; * $15.307 billion in total budgetary resources for the Federal Transit Administration (FTA), a $1.297 billion decrease below the FY 2024 enacted level, including: * $14.279 billion in obligation limitation from the HTF to fully fund Transit Formula Grants at levels authorized by the BIL, including; * $6.85 billion for Section 5307/5336 Urbanized Area Formula Grants; * $3.76 billion for Section 5337 State of Good Repair Grants; * $1.12 billion for Section 5339 Buses and Bus Facilities Grants, which includes: * $645.8 million for Section 5339(a) Bus Formula Grants; * $478.2 million for Section 5339(a&b) Bus Competitive Grants; and * $76.5 million for 5339(c) Low or No Emission Bus Competitive Grants, which would add to $1.05 billion in advance appropriations from the BIL for a total of $1.127 billion worth of funding for that program; * $935.85 million for Section 5311 Rural Formula Grants; and * $396.93 million for Section 5310 Seniors and Individuals with Disabilities Grants, which would add to $50 million in advance appropriations from the BIL for a total of $446.93 million for that program; and * $755 million in additional funding for the Capital Investment Grant (CIG) Program, with the Appropriations Committee Majority offering that “through utilizing unallocated balances from FY24 and $1.6 billion in advance appropriations available through IIJA, the bill provides funding for all projects ready for construction in 2025.” * The American Public Transportation Association (APTA) notes: “The bill significantly cuts total CIG funding. The THUD Appropriations bill and IIJA provide $2.4 billion for Capital Investment Grants, a cut of $1.5 billion (-38.1 percent) from the FY 2024 enacted level. The bill cuts the General Fund appropriation for CIG funding by 66 percent. Of the $755 million General Fund appropriation, $485 million is available for new fixed guideway projects and up to $265 million is available for Small Starts. Moreover, the bill provides no funding for Core Capacity projects.” * $2.758 billion in total budgetary resources for the Federal Railroad Administration (FRA), a $212 million decrease below the FY 2024 enacted level, including: * $228 million for rail safety and operations, a $20 million increase above the FY 2024; * $259.5 million in additional funding for the Consolidated Rail Infrastructure and Safety Improvement (CRISI) Program, which would bring the total funding available to $1.26 billion when combined with $1 billion in advance appropriations provided by the BIL; and * $1.123 billion in additional funding for the Amtrak National Network, which would bring the total funding available to $4.323 billion when combined with $3.2 billion in advance appropriations provided by the BIL; * $909 million for the Federal Motor Carrier Safety Administration (FMCSA), an $18.4 million decrease below the enacted level; * $1.272 billion for the National Highway Traffic Safety Administration (NHTSA) to support safety activities, a $34 million increase above the FY 2024 enacted level; * $384.5 million for the Pipelines and Hazardous Materials Safety Administration (PHMSA), a $13.2 million increase above the FY 2024 enacted level; and * $849 million for the Maritime Administration (MARAD), a $92 million decrease from the FY 2024 enacted level, including an additional $50 million for the Port Infrastructure Development Program (PIDP) beyond advanced appropriations provided by the Bipartisan Infrastructure Law. The bill does not provide funding for discretionary highway programs that have advanced appropriations from the BIL, including the RAISE and Mega grant programs. It does not provide additional funding beyond BIL contract authority or advanced appropriations for discretionary transit programs including the Buses and Bus Facilities, Low or No Emission, and Ferry Grants programs. The measure does not provide additional funding for rail programs with BIL advanced appropriations, including the Federal-State Partnership for Intercity Passenger Rail (FSP) Grant Program. Specifically, the THUD Appropriations bill, together with the IIJA’s advance appropriations, provides a total of $19.6 billion for public transit in Fiscal Year (FY) 2025, a cut of $1.3 billion (-6.2 percent) from the FY 2024 enacted level. This total funding is $2.4 billion (-10.8 percent) less than the amount authorized in the IIJA. In addition, the House THUD Appropriations bill and IIJA provide $16.0 billion for passenger and freight rail in FY 2025, a cut of $262 million (-1.6 percent) from the FY 2024 enacted level. This total funding is $4.6 billion (-22.4 percent) less than the amount authorized in the IIJA. APTA also noted the following policy provisions within the bill: “section 163 of the bill blocks the Rostenkowski Test, preventing a possible across-the-board cut of FY 2025 transit formula funds to each public transit agency. However, unlike prior years, the bill does not prohibit DOT from impeding or hindering a project from advancing or approving a project seeking a CIG federal share of more than 40 percent.” Transportation U.S. Department of Transportation Office of the Secretary * On Wednesday, the U.S. Department of Transportation (DOT) announced <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=8230c35f7b&e=7ccb4f03e2> project selections under the Fiscal Year (FY) 2024 Rebuilding American Infrastructure with Sustainability and Equity (RAISE) Grant Program. The agency awarded $1.8 billion in funding to support 148 regionally or locally significant surface transportation projects in all 50 states, four territories, and the District of Columbia. These projects will advance the Administration’s strategic goals of safety; equity; climate and sustainability; and workforce development, job quality, and wealth creation. A press release notes that the FY 2024 round of the program was once again heavily oversubscribed. DOT received nearly $13 billion in requested federal assistance. DOT expects to open the FY 2025 round of RAISE sometime this fall. * Transportation Secretary Pete Buttigieg issued <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=d9e029e595&e=7ccb4f03e2> a policy statement <https://watransit.us1 2.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=2a9523dc49&e=7ccb4f03e2> this week affirming that it is the official policy of DOT to maximize the use of agency resources to facilitate the delivery of projects that benefit communities with environmental justice (EJ) concerns. The statement notes that the agency supports the use of the best available science and tools in project design and environmental reviews as well as its research investments to analyze the direct, indirect, and cumulative impacts of proposed projects on safety, public health, and equity. The statement also underscores the agency’s commitment to assist project sponsors in identifying environmental documentation where needed, facilitating interagency coordination, and ensuring early and meaningful public involvement on EJ concerns stemming from proposed actions. * The House Transportation and Infrastructure Committee held a DOT oversight and budget hearing <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=dcd1d4d525&e=7ccb4f0 3e2> with Secretary Buttigieg yesterday. In his opening statement, the Secretary expressed enthusiasm that the Bipartisan Infrastructure Law (PL 117-58) is supporting over 50,000 transportation projects in all 50 states, the District of Columbia, Puerto Rico, and all U.S. territories. He highlighted specific investments from the law in bridge, freight and passenger rail, and aviation.
