Fischbach Clerk of the Board: Lorna Delaney MINUTES Week of August 6, 2007 Chairman Phil Johnson called the meeting to order in the presence of Commissioner David W. Sullivan and Commissioner John Austin. PUBLIC COMMENT PERIOD: The following comments were made by citizens. The Olympic Farm Bureau requested that the County mail public hearing notices to all property owners who will be affected by the Critical Areas Ordinance; several people voiced concerns about the proposed Clean Water District fees; the County needs to have a representative at Puget Sound Partnership meetings; concerns were voiced about the expansion at Indian Island, the way the Indian Island protester's court cases were handled, and the outdated ammunition that was recently trucked off the island; the Economic Development Council should be the Associated Development Organization for the County; concerns were expressed about the proposed equestrian park near the transfer station; the 4-H program in Quilcene and Brinnon has done a lot to help the kids; the County should regulate runoff from houses and yards that pollutes the saltwater; and, a comment was made about redacting personal information from documents and public records requests. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to delete item #1 and approve the balance of the Consent Agenda. Commissioner Austin seconded the motion which carried by a unanimous vote. 1. DELETE RESOLUTION NO. 74-07 re: Agreeing to Hold Harmless, Defend and Indemnify a Firm Known as E. D. Hovee and its Agents, Employees or Directors Against Any Claim Arising from the Disclosure Pursuant to a Public Records Act Request for the Questionnaires Relating to the Jefferson County Business Needs Questionnaire Summary Report of May 2007: (See Item #1 on the Consent Agenda.) The County Administrator explained that the cover letter for the questionnaires that was sent to all businesses stated that responses would be kept confidential because many businesses could be easily identified by their responses. A public records request was submitted requesting a copy of the responses. The consultant hired to do the project currently has the responses and is concerned about a possible lawsuit ifthey are released. Hovee and its agents, employees or directors against any claim arising from the disclosure pursuant to a public records act request for the questionnaires relating to the Jefferson County business needs questionnaire summary report of May 2007. Commissioner Austin seconded the motion which carried by a unanimous vote. COMMISSIONERS BRIEFING SESSION: The County Administrator discussed the following items. · There will be an Executive Session regarding potential litigation at 11 :00 a.m. · Informational meetings on the proposed Clean Water District are scheduled in several communities in the County over the next few weeks. · The State Department of Health has completed the review ofthe UGA Sewer Report and will be sending a letter approving the report with suggestions for a few minor changes. · The State Department of Ecology will be making a decision this week on the grant for the Beckett Point Sewer Project. There were eleven applications submitted for two grants for $250,000 each. · The Quinault Indian Nation has requested a meeting with the Board regarding land use issues. The Board suggested that they could meet with the Tribe and also meet with constituents on the West End on the same day. · The report on the Port Ludlow Mediation will be forwarded to the County this week from the Consultant. · The State Department of Revenue has acknowledged receipt ofthe ordinance increasing the County's revenue from the State's portion of the Distressed Counties Sales and Use Tax. They are not sure when it will go into effect. This revenue goes into the County's Public Infrastructure Fund. · Several counties are having to make budget cuts due to a decrease in anticipated revenues. · People who smoke at the back of the Courthouse will have to move further away from the Records Building. This is a State law. APPROVAL OF MINUTES: Commissioner Sullivan moved to approve the minutes of the July 2,9, 16, and 23,2007 Regular Meetings and the Special Meeting Minutes for July 11,2007 as presented. Commissioner Austin seconded the motion which carried by a unanimous vote. Ed Bowen, Veteran's Conservation Corps, State Department of Veteran Affairs re: Outreach to Jefferson and Clallam County Veterans: Ed Bowen explained that he is a Field Coordinator for the State Department of Veteran Affairs (DV A) for Clallam and Jefferson Counties. The DV A began a program in 2005 to help veterans with Post Traumatic Stress Disorder through involvement in outdoor habitat restoration projects. In 2007, the program was amended to include funded certification training atsEvergreen Community College. Page 3 Commissioners Meeting Minutes: Week of August 6, 2007 The Veteran Conservation Corp projects include work for heavy equipment operators, upland management (pastures), game management, invasive weed removal, and clerical work or grant writing for restoration projects. Oil spill response training has also recently been suggested. Ed Bowen noted that this isn't a volunteer program for restoration efforts. The goal is to find positions to help the veterans and the environment. His office is located in the West End and the majority ofthe veterans he has helped don't want to be involved in a large group. He reviewed several areas where Jefferson County could help the Corp: · Currently, there is limited interest in the program from veterans in East Jefferson County. The best way to get the word out is through service organizations. · He offered to recruit an intern from the Veterans Vocational Rehabilitation Training Program to help coordinate the program in East Jefferson County if office space can be provided. The intern would be paid a minimal amount by the State. · The 2007 Legislation includes finding jobs for veterans and encouraging them to start small businesses that agencies would hire for restoration projects. The State will train the veterans so that they are fully qualified and they would like the training at local educational institutions. They would also like the Economic Development Councilor a similar organization to help veterans set up their businesses. · The Environmental Certification Program has openings for 35 veterans and 20 are signed up. He would like to see 15 veterans from Jefferson County sign up for the training and needs to have the positions filled by mid-August. The training is paid for by the State, there is a living stipend, and there are some relocation expenses. Al Scalf, Community Development Director re: Authorization to Select WSU as the County's Associated Development Organization (ADO): The County Administrator explained that there were five responses to the Request For Proposals for the County ADO. WSU, Diversified Resources and the Economic Development Council were interviewed. The interview team unanimously chose WSU as the preferred consultant. Director of Community Development Al Scalf explained that the designated ADO implements the workforce development system, conducts public outreach and education and fosters partnerships with other agencies and other County departments. Specific duties include: attending community economic development activities, participating in workforce development, seeking future project partnerships, developing a Peninsula Leadership model, and participating in the commercial and industriallandbank analysis and the future designation of the industriallandbank in the County. Page 4 Commissioners Meeting Minutes: Week of August 6, 2007 Katherine Baril, Extension Agent, reviewed the projects that WSU has been involved in to promote economic development in the County. The members of the ADO Team told the Board about their business backgrounds. Commissioner Sullivan moved to select WSU as the County's ADO and direct staffto develop a contract. Commissioner Austin seconded the motion which carried by a unanimous vote. Discussion and Possible Action re: Third Amendment to Second Settlement Agreement - Extending Time Frame; Washington Environmental Council (WEC) vs. Jefferson County: Al Scalf explained that the Critical Areas Ordinance is currently being reviewed by the Planning Commission and they recently sent a letter to the Board requesting additional time for the review. The Board agreed and asked staff to contact the Washington Environmental Council to request an extension. Outside Counsel contacted WEC and they agreed to an extension from October 15 to January 18, 2008. Commissioner Sullivan moved to authorize Outside Counsel Mark Johnson to sign the third amendment to the Second Settlement Agreement with the WEC. Commissioner Austin seconded the motion which carried by a unanimous vote. The Board met in Executive Session from I I :00 a.m. to12:00 p.m. with the County Administrator, Prosecuting Attorney, Deputy Prosecuting Attorney, Central Services Director, and Director of Community Development regarding potential litigation per RCW 42.30.11 O( I )(i).
