Fischbach Clerk of the Board: Lorna Delaney MINUTES Week of August 27, 2007 Chairman Phil Johnson called the meeting to order in the presence of Commissioners David Sullivan and John Austin. PUBLIC COMMENT PERIOD: The following comments were made by citizens. Several people expressed concerns about the increase in their property valuation determinations by the Assessor's Office and asked that the Commissioners extend the appeal deadline to the Board of Equalization for an additional thirty days; several people stated their concerns about the proposed Clean Water District fees; a petition was submitted opposing the re-zone application submitted by Security Services Northwest; new businesses would provide needed revenue so that the County wouldn't have to rely on property taxes; and a request was made that the Board support the City of Port Townsend's draft letter requesting that an Environmental Impact Statement be done for the expansion of the naval facilities at Indian Island. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to delete Item # I and approve the balance of the Consent Agenda. Commissioner Austin seconded the motion which carried by a unanimous vote. I. Letter Responding to Request for Wage Increase For Jefferson County Public Health Nurses; Wendy White, ARNP COMMISSIONERS BRIEFING SESSION: The following items were discussed. · County Assessor Jack Westerman explained the property valuation determination process. · A County CommissionerslPort Townsend City Council Work Session is scheduled tonight at 6:30 p.m. in the Superior Courtroom. · The Board discussed a draft letter submitted by the City of Port Townsend requesting that Naval Magazine Indian Island prepare an Environmental Impact Statement that addresses ongoing and planned future actions that intensify the use ofthe facility. · The State Department of Ecology (DOE) has a new grant program that can provide applicants with up to 75% ofproject costs for feasibility, assessment, planning, design and construction of water reclamation facilities in the Puget Sound area. The County is looking into the grant for the Port Hadlock UGA Sewer System. · A joint BOCC workshop with Clallam County is scheduled for September 24 at 1 :30 p.m. at the Clallam County Courthouse. · The State DOE has awarded a $50,000 grant to the County for the archeological services on the Beckett Point Sewer System project. Page 2 Commissioners Meeting Minutes: Week of August 27,2007 The Board met in Executive Session from 10:00-11 :00 a.m. with the Deputy Prosecuting Attorney, County Administrator, Director of Community Development, Central Services Director, Public Works Director, County Engineer, Wastewater Manager, Engineering Services Manager, and Development Review Planning Project Manager regarding actual litigation, an exemption as outlined in the Open Public Meetings Act, RCW 42.30.110(1)(i). Workshop re: Clean Water District Proposal: Deputy Public Health Director Mike McNickle reported that staffhas developed a draft proposal to address water quality issues and shellfish protection in the County. Comments received at six public meetings, held in communities throughout the County, have been incorporated into the proposal. Five options were developed for the Board to review. 1) No action and no Clean Water District. 2) All parcels (minus legislatively exempted parcels - timberland) pay $18 per year. 3) Parcel owners would pay $18 per year unless they are exempted by policy. (Low income senior/disabled exemption and timberland.) 3a) Parcel owners would pay $18 per year with exemptions for low income seniors/disabled, and timberlands, small lots, and a multiple parcel discount. 4) Plan funded through the County's General Fund. Deputy Prosecuting Attorney David Alvarez explained that earlier this year the State Department of Health prohibited shellfish harvesting in a portion of Discovery Bay due to water pollution. The State required that the County designate a Shellfish Protection District within 180 days of the closure. Mike McNickle stated that the County has received a ninety day extension because the State is aware that a Clean Water District is being proposed. Mike McNickle discussed the four major elements of the Clean Water District. 1) Implementation of a 5 year baseline water quality monitoring study to collect data. 2) Implementation of a Pollution Identification and Correction Program. 3) Implementation of an On-site Septic Operations and Maintenance Program. 4) Education and outreach by WSU/Extension. There was a discussion about possible exemptions to the proposed fee. Neil Harrington, Environmental Health Supervisor, stated that they have not had time to determine how many parcels would be exempt because the perimeters have not been set yet. The County Administrator noted that the Treasurer has indicated that the perimeters need to be simple in order to have the fee on the tax statements that will be sent out in February, 2008. Ifthe perimeters are complex, the County would have to wait until 2009 to implement the fee. Page 3 Commissioners Meeting Minutes: Week of August 27,2007 The Clean Water District fees for adjacent counties were reviewed. Jean Baldwin stated that the shellfish industry makes a major contribution to the economy of the County. Jefferson County wants to prevent widespread shellfish beach closures similar to those in Mason County. Commissioner Sullivan noted the importance of water quality monitoring to establish a baseline and find out the areas that are declining. He is aware that there is a tight timeline to get something in place for 2008. He suggested that a draft ordinance be advertised and a hearing be scheduled. Commissioner Austin stated his concerns about the cost to property owners who own multiple parcels or a small lot versus acreage. He would like to see the data on possible exemptions. Other funding options and sources were discussed. It was suggested that an option could be chosen for 2008 with a possible revision in 2009 after more data on exemptions is collected. Chairman Johnson reiterated that staff needs direction to move forward on a draft ordinance and public hearing. The County Administrator stated that staff may also need direction for the presentation they will be making at the Port Townsend City Council/County Commissioners Work Session this evening. Commissioner Sullivan moved to direct staffto draft a Clean Water District ordinance based on Option 3 and advertise a public hearing. Commissioner Austin seconded the motion which carried by a unanimous vote. APPROVAL OF MINUTES: Commissioner Sullivan moved to approve the minutes of the August 20, 2007 meeting as presented. Commissioner Austin seconded the motion which carried. Direction to Staffre: Port HadlocklIrondale Urban Growth Area (UGA) Boundary: Commissioner Sullivan moved to direct staff to re-examine the Urban Growth Area (UGA) boundary and review and revise all sections of the Comprehensive Plan, development regulations and sewer planning documents that would be affected by the adoption of a different UGA boundary than the one currently in place because the Western Washington Growth Management Hearings Board has set a deadline of April 2, 2008 for the boundary ofthe Port HadlocklIrondale UGA to include only those areas within the UGA boundary that will be, according to the sewer plan, provided with sewers by the end of the current planning period which is 2024. Commissioner Austin seconded the motion which carried by a unanimous vote. Page 4 Commissioners Meeting Minutes: Week of August 27, 2007 County Administrator Briefing Session: The following items were discussed during the briefing. · Recommendation from Elected Officials to Add Non-Accrued Vacation Days for Exempt Employees: Commissioner Austin moved to direct staff to prepare a resolution that would amend the Personnel Administration Manual for Jefferson County Employees to rrovide up to three non- accrued vacation days for exempt employees depending on length of service.
