LAMBORN PUBLIC P$INTIDB RULES REGULATING LOCAL AID BOARDS. 1. The local aid board shall require that. when- ever an injury occurs to-any workman he, or if pre- vented by the injury, some one in his behalf shall forthwith report such injury to a member of the local aid board. 2. It shall be the duty of the local aid board to see that all workmen within the provisions of the Workmen's Compensation Act shall have proper -and adequate care and treatment, as provided by Sec. 6604-35, Rem. & Bal. Code. If the workman is under contract, .said board shall see that he is forthwith placed under the care of the contracting physician. In case of non-contract, he shall be placed by said board under the care of some regu- larly licensed phyiscian and surgeon. 3. There shall be no delay in case of any in- jury in furnishing the prompt and efficient medical attendance and treatment provided by the law by reason of any disagreement or indecision on the part of any members of the local aid board. Any question affecting the action of the local aid board may later be submitted to the state board in ac- cordance with the provisions in section 6604-41. 4. The local aid board shall require that where an employer has no local aid board at his plant, he must report all injuries of his men to the local aid board of that district,. so that said board may take charge of the case and make proper report thereon. 5. The local aid board shall investigate all ac- cidents resulting in injuries, where the cause is un- 2 certain, and report the circumstances, cause, and extent of said injury to the medical aid board. 6. All answers to all questions on blanks must be written in full by the local aid board. 7. It shall be the duty of the local aid board to report to the medical aid board the commence- ment of every disability and the.cause of the same, within three days from the commencement of the same. 8., The local aid board shall promptly report the date of termination of treatment, and the date when the injured workman is able to take up some gainful occupation. 9. The local aid board shall promptly certify to the state board the correctness of all bills ren- t dered and the fact that the same conform to the extent and character of the service rendered. r RULES OF THE MEDICAL AID BOARD OF THE STATE OF WASHINGTON NON-CONTRACT SYSTEM Governing Procedure With Bogard to Claims for Medical and Surgical Expense Ren- dered Injured Workmen Who:Gome Under Its Provisions. Rule 1 Each injured employee shall, have the right to select any physician and surgeon who is legally qualified to practice medicine and surgery in the State of Washington, or the state where the serv- ices are rendered, whom he may desire to treat his. injuries provided that physician and surgeon re- sides within a reasonable distance of the injured employee. Rule 2 ~ An injured employee must follow the directions of his physician and comply with all reasonable re- quests of his medical attendant while he is under his care. Rule 3 An injured employee will not be allowed to change from one physician to another, or call an- other in consultation at the expense of the medical aid fund, unless he has first obtained permission from the Medical Aid Board. ~~~ Rule 4 An injured employee who is under treatment will not be allowed to leave the place of treatment and place himself under the care of a physician at a distance,. without first notifying the Medical Aid Board, setting forth the reasons for such change, and obtaining permission therefor. Rule 5 If it becomes evident to the Medical Aid Board that any injured employee, in order to hasten his recovery, or lessen his disability, or for any reason he needs special form of treatment which he is not receiving and cannot receive in that location, the Board will- reserve the right to transfer him to a suitable place where he may receive such treat- ment. Rule 6 Bills for medical and surgical care to injured workmen will not be considered until the .reports from the employer, claimant, and the physician have been completed .and received, and it is deter- mined that-the accident and injury sustained are within the scope and meaning of the Workmen's Compensation Act. Rule 7 In case an attending physician or surgeon re- fuses to fill out his report and itemize his fee bill on his claim for medical and surgical services ren- dered an injured employee, the claim for medical services shall not be considered during the period of such refusal. All -bills must be presented to the Local Aid Board for certification within thirty days. after the termination of treatment. Rule S All reports and fee bills shall .be made on regu- lar blank forms provided by the Medical Aid Board for this purpose. Such blanks must be properly filled out and set forth the condition treated. Rule 9 Fees, covering services rendered, shall not be paid from -the state medical aid fund unless such services are performed by a person permitted to render such services under the medical practice act of the State of Washington, or the state where the services are rendered. Rule 10 Fees, covering services rendered by interns con- nected with a hospital, shall not be paid from. the state medical aid fund. This, however, is not in- tended to refer to a regular surgeon who is on the hospital staff. ' Rule 11 Fees, covering services rendered by an assist- ant or an anesthetist, shall not be paid from the medical aid fund, unless such services are per- formed by a physician and surgeon regularly li- censed under the state medical act and a separate fee bill covering such services is presented by him. Rnle 12 Fees, covering services of consultant, assistant, or an anesthetist, will be allowed only when it is clearly apparent from the nature and extent of the injury that such services are necessary. Rule 13 Fees shall not be approved for more than one attending physician or surgeon in a case for treat- ment rendered over the saxhe period of time, ex- cept for services of a consultant, assistant, or -anes- thetist, unless it is clearly shown that the case is of such a serious nature that it demanded extra- ordinary medical attention. Rule 14 Fees, covering hospital treatment- or home treatment, shall not be approved or paid from the medical aid fund if the case is shown by the proof i ~on file to be an ambulatory one, but. will only be allowed the same as office dressings. Rule 15 Fees, covering daily dressings, shall not be paid from the medical aid fund, unless the nature and extent of the injury, as -shown by the proof on file, clearly indicates the necessity for same. Rule 16 Fees, covering ordinary dressing materials or • drugs used in treatment of an injury, shall not be considered separately, but shall be included in the amount allowed for office dressings. If the record of the case on file shows that it was necessary to use'an extraordinary amount of dressing materials, clearly indicating the necessity for same, this extra dressing material will. be paid for at cost. Rule 17 An injured employee who is under treatment f and who wishes to change physicians, must first notify the Medical Aid Board, giving his reasons for same, and may be granted permission by the Med- ical Aid Board to do so, within its discretion, Rule 18 Fees covering hospital bills shall not be in- cluded in the :medical and surgical services, but shall include fees for hospital services only. Rule 19 Fees for hospital care shall represent only the actual time the patient is in the hospital and shall not exceed nine dollars ($9.00) per week. Where it is plainly evident from the Gase on file that it was necessary to use the operating room, a fee of five dollars ($ 5.0 0) may be allowed for same; but , where it is plainly evident that all that was neces- sary to be used was the dressing room, such fee shall not be allowed. Rule 20 In a public hospital bed, or beds, used for an injured workman coming under this act, shall be separate and distinct from bed, or beds, known as charity bed, or beds; but fees for separate rooms will not be allowed unless it is clearly shown by the-files in the case that a separate room was ac- tually necessary under the circumstances. Rule 21 Where the files in a-case indicate that the case is so severe and plainly shows the necessity of a special nurse, a reasonable amount will be allowed for such services. If it is necessary that this spe- cial nurse shall continue more than three days; the Medical Aid Board must be consulted with regard to the continuance of same, or the bill will not be allowed. Rule 22 By a prearrangement with the Medical Aid Board where it is plainly shown that dental work has been made necessary as a direct result of the accident, a reasonable amount will be paid for the work made necessary by the accident; but if other work is done in connection with this, that part must be segregated from the part that has been made actually necessary by the accident. 8 Rule 23 Bills for drugs, special drugs, material, serums, etc., will not be allowed unless it is clearly evident from the. claim on file that these things were a necessity for proper treatment of the case. A rea- sonable amount may be approved by the Medical Aid Board, but only when the case considered as a whole shows an actual necessity for the articles prescribed and used, and in such case the articles prescribed and used must be mentioned. Rule 24 Re-operative work must be taken up with the Medical Aid Board before the work is done, or the bill will not be allowed. Rule 25 X-ray plates to be paid for must be forwarded to the Industrial Insurance Commission at Olympia, properly packed and shipped by express. Plates de- stroyed in transit will not be paid for. T~ f Rnles of the Medical Aid Board Governing Medi- cal and Surgical Treatment Rendered Work- men Who Adopt the Contract System As Provided for in Section 6604-45 .The fallowing rules are hereby promulgated by the-State Medical Aid Board, according to the prin- ciples set forth in section 6604-36, Rem. & Bal. Code, for the regulation and practices for the fur- nishing of the medical and surgical care of em- ployees who have seen fit to contract for such care, as provided for under section 6604-45: Rule 1 It shall be the duty of the contracting parties to provide suitable rooms, fracture-beds, splints and' appliances, and suitable nurses for the proper and efficient treatment of each individual case, accord- ing to the necessity of same, so that these furnish- ings shall be such as to fulfill the requirements made by section 24 of the Workmen's Compensa- tion Act, "that the treatment in all cases shall be suitable and wholesome," and this care shall ex- tend over the entire period of necessary treatment. Rule 2 It shall be the duty of the contracting parties to have radiographs made of all fracture cases, espe- cially in cases where there is any doubt as to the real condition existing, so that this doubt may be removed and the injured employee have the most efficient treatment that can be rendered him. under the circumstances. Rule 3 It shall be the duty of the contracting parties to furnish medical and surgical treatment by a phy- 10 sician .and surgeon who is regularly licensed to practice medicine and surgery in the State of Wash- ington, or in the state where-such services are ren- dered.. Rule 4 It shall be the duty of the contracting parties to furnish treatment by:a specialist in all cases of eye injury, or any other injury that cannot be efficiently handled by the. surgeon in charge. Rule 5 It shall be the duty df the contracting parties in cases where an injured employee has lost teeth as a direct result of the accident, to have same bridged, crowned, or put in as good condition as possible under the circumstances. This work shall be done by a dentist who is regularly. licensed to practice dentistry under the state law, and this service shall be paid for by the contracting party. Rule 6 It shall be the duty of the contracting parties to keep a permanent record of all the injured em- ployees who come under their care. This record shall show the man's employment; age; name of employer; date of accident; date of coming under care; provisional diagnosis; treatment,• operation, if any,, setting forth the condition found; summary of progress of case; final outcome; and date of dis- charge, giving name of physician in charge. This record shall be available for inspection. '' (over) ~~ _ Such contract shall not be for a longer period than three years. .Before any contract of this nature shall go into effect it shall be submitted to the State Board for- approval. Those firms and their employes who desire to contract for hospital and medical care, shall contribute to the MEDICAL AID FUND. ten per cent (10~) of .the amount which would be due such fund had not the contract been in effect. One-half of this ten per cent shall be borne by the employer and one-half by the employe. A uniform contract fcr this purpose will be required and furnished, on application, by the State Medical Aid Board.' As a workman is only entitled to .compensation on accoun~ of an ACCIDENT any contract that contemplates medical and- haspital ' care for both. ACCIDENT and SICKNESS cannot be recognized by the Board. Any contract for sickness must be separate. SECTION 6604-42. Any employer who shall knowingly misrepresent the amount of contribution due from him to, or collected by him for the medical aid fund shall be liable to the state in civil action for the benefit of said fund in ten times the amount attempted to be concealed or withheld by such misrepresentation, and shall be also guilty of a misdemeanor, Any person, firm, or corporation who not having previously reported to the secretary of the State Board, shall establish any new plant, or works, or enter upon the performance of any new build- ing'contract or construction contract and who shall fail to send written notice thereof to said secretary within five days after such establishing or entering, shall be guilty of a misdemeanor.
