HomeMy WebLinkAbout06 June County Health & Human Services HEALTH BOARD MINUTES JUNE 23, 1997 BOARD MEMBERS: Glen Huntingford, Chairman Richard Wojt, Member Dan Harpole, Member STAFF MEMBERS: David Specter, Health Department Director Jean Baldwin, Director of Nursing Services Larry Fay, Director of Environmental Health Chester Prudhomme, Director of Substance Abuse Thomas Locke, M.D., Health Officer CITY OF PORT TOWNSEND REPRESENTATIVE: Ted Shoulberg The meeting was called to order by Chairman Glen Huntingford. The following Board and staff members were present: Commissioner Richard Wojt, Commissioner Dan Harpole, David Specter, Jean Baldwin, Chester Pruhomme, Randy Marx, Thomas Locke, MD and Judi Morris. Larry Fay and the City of Port Townsend's representative Ted Shoulberg were not present. APPROVAL OF MINUTES: Commissioner Harpole moved to approve the minutes of May 28, 1997 as presented. Commissioner Wojt seconded the motion which carried by a unanimous vote. PUBLIC COMMENT PERIOD: Jim and Janice Schauer stated they own property adjacent to Linda Sexton's property located in Chimacum. (Background: Ms. Sexton has been collecting and storing such an abundance of solid waste on her property that she has been notified by the Health Department that she must either begin the permitting process for a solid waste facility or initiate a plan to clean up the property. She appealed the Health Department's decision to the Jefferson County Health Board (see minutes of May 28, 1997). The Board directed the Health Officer to work with Ms. Sexton on a compliance schedule and ordered Ms. Sexton to stop collecting solid waste materials until an agreement is reached.) The Schauer's property has been on the market for over two years. The Schauer's and their Real Estate agent believe that the condition of Ms. Sexton's property is the main reason that their property has not sold. Both Mr. and Mrs. Schauer have tried to talk to Ms. Sexton about cleaning up her property, but she will not listen. They hope that the Health Board can get her to clean up her property to the standards maintained by everyone else in the community. Mrs. Schauer stated that there are two gentlemen currently staying on the property and she witnessed one of them throw the remainder of an unwanted sandwich into the yard. With food being brought onto the property they are concerned that this could cause a huge problem with rats. In the past, the property was overrun with cats which the Schauer's trapped and removed at their own expense. David Specter replied yes. Commissioner Huntingford suggested the progress report be moved up on the agenda and discussed now. Everyone agreed. OLD BUSINESS PROGRESS REPORT - LINDA SEXTON SOLID WASTE AGREEMENT: In the absence of Larry Fay, Randy Marx explained that the Health Department has developed an outline of a plan for Linda Sexton to complete. The plan has been forwarded to the Prosecuting Attorney for legal review. Randy Marx stated that Ms. Sexton is still advertising for the collection of solid waste material even though the Board ordered her to stop. He believes that she will continue to ignore the County until it is legally enforced. Commissioner Harpole asked if the plan includes strategy which addresses the need to clean up the property or specific language regarding what is expected in terms of cleaning the site? Randy Marx presented the Board with a copy of the plan and stated that they are focusing on preventing her from collecting any additional solid waste material and getting her to recycle or reuse the items she already has, with a deadline to have everything cleaned up by August 31, 1997. Commissioner Harpole read a portion of the plan to inform Mr. and Mrs. Schauer of the actions being taken by the County. The plan states: ... Have all remaining solid waste that is not enclosed within a building, disposed of at a permitted solid waste facility by August 31, 1997. As of September 1, 1997, no outdoor piles or outdoor storage of solid waste, including used or discarded commodities, shall be allowed to exist. Mr. Schauer stated that they have decided to take their property off the market until something is done about the neighboring property. Commissioner Harpole suggested a letter be drafted to Ms. Sexton, for David Specter's signature, stating that she is in violation of the agreement. This would give her a warning and serve as a paper trail for future reference in the event legal action is necessary. Thomas Locke, MD stated that the Board has two options in which to handle this situation. The first is as a nuisance abatement, which is a weak and vague area of the law. The second, is as an illegal solid waste facility, which is a criminal violation. He believes that the Board is taking the strongest enforcement tact available by proceeding with the second option. BOARD OF HEALTH EXPANSION: NEW MEMBER SELECTION PROCESS: David Specter stated that the subcommittee met last week to review the 17 applications which were received. The subcommittee chose 6 of those applicants to be interviewed on July 23, 1997. After conducting the interviews the subcommittee will make a recommendation to the Board of Commissioners for appointment of the new members. The new members will be appointed prior to the Health Board meeting in August. David Specter presented "Thank You" letters for the Chairman's signature. These letters will be sent to the individuals who were not chosen to be interviewed. HEALTH BOARD MINUTES - JUNE 23,1997 Page 3 NEW MEMBER ORIENTATION: Thomas Locke, MD stated that he believes there are three main topics which will provide useful information to the new members. 1) State Public Health System 2) Laws, Powers, & Duties of Local Board's ofHealthlFederal and State Health Reform 3) Local issues in Jefferson County/Community Health ReportlProgramslBudget/Staff/Groups/etc. In addition, the National Association of Local Board's of Health produced a two hour video tape regarding policy making, which is available for the members to view at their leisure. Dr. Locke stated that the Health Department will prepare a handbook with information on legal citations and the public health system. He has also been developing a list of web sites that relate to public health which are excellent sources of information for individuals who are computer oriented. Commissioner Harpole asked if the orientation will include the current Health Board members as well as the newly appointed members? David Specter replied that the Health Department was hoping to get some feedback from the Board regarding whether or not they wanted to attend. Commissioner Wojt recommended that the current members attend the orientation. Commissioner Harpole stated that he will be attending. . DIRECTOR'S REPORT FINANCIAL REPORT: David Specter reported that salary and benefit expenses are higher than budget projections. Once the changes resulting from the consolidated contract have been factored into the report the figures be in line with budget projections. PROGRAM/GRANTS: The Community Network has allocated $37,000 in grant funding to nine different agencies. Three of those agencies are Jefferson County departments. The Public WorkslRecreation department will be receiving $10,200 for various projects, Juvenile and Family Court Services will be receiving $3,000 for a summer probation program, and the Health Department will be receiving $750 to publish two issues of the "Family Times". The Health Department received approval for the continuation of the local partnership grant funding. They will be receiving a total of$20,000 which will pay for the Health Department's assessment functions. NEW BUSINESS David Specter discussed a letter which was faxed to the Health Department on Friday, June 20, 1997 and faxed to the Commissioners' office this afternoon just prior to the Health Board meeting. He stated that the letter from Dennis Bizek is an appeal of the Environmental Health Director's decision regarding his request for a waiver of the minimum land area requirements for a septic system. Due to the untimely receipt of the letter, Health Department staff was unable to prepare the appeal to be heard by the Board during the meeting today. Additionally, the agenda had already been prepared and distributed, and Linda Atkins and Larry Fay were not available to attend this meeting. The appeal will be scheduled to be heard during the meeting next month. HEALTH BOARD MINUTES - JUNE 23,1997 Page 4 Commissioner Harpole noted that the appellant Mr. Bizek writes that he wants to expedite the appeal since his builder's negotiated contract price has an expiration date of Wednesday, June 25, 1997, at which time his cost to build goes up due to the builder's increases. He noted this to insure that the Health Department is aware of the urgency and that they may get a negative comment back. ~ NURSING DIRECTOR'S REPORT PROGRAM UPDATE: Jean Baldwin reported that a member ofthe nursing staffwill be leaving employment with Jefferson County and going to work in Africa. The Health Department will be advertising to fill the vacant position and adjusting nursing hours in the interim. STATE CONSOLIDATED CONTRACT AUDIT: The Health Department is currently undergoing the State Department of Health Consolidated Contract audit, which occurs every three years. Auditors will observe clients, read charts, and review: programs, billings, fiscal forms, goals, and program manuals. Jean Baldwin stated that she will keep the Board informed on what is taking place. T HEALTH OFFICER'S REPORT LEGISLA TIVE UPDATE: Thomas Locke, MD updated the Board on regulatory reform. During the legislative session in late March, the Governor issued an executive order that directed all State agencies to put their regulations, and policies that have effective regulations, through a stringent review for clarity, cost, benefit, public welfare and statutory authority and target which regulations need to be revised or rescinded, by the end of summer. The agencies must then provide an initial progress report by the middle of October, listing which regulations have been revised or recinded. Dr. Locke stated that by State standards, this is a very rapid time-line. Virtually, all of the State agencies have made this a high priority. This affects local health jurisdictions because they are regulated by the Washington Administrative Codes (W.A.C. 's) such as drinking water standards, onsite codes, food safety, and solid waste. While R.C.W.'s just layout broad areas of the law, the technical standards are set forth in the W.A.C.'s. It is the W.A.C.'s. or technical standards which are up for review. The Health Department has indicated problem areas to be reviewed and as the summer progresses there will be numerous opportunities for the Health Board to participate. This reform is not confined to Health. All State regulations, including those dealing with land use and criminal justice, are up for review and now is a good time to express concern or recommendations for revision. Dr. Locke explained the reform process and discussed the areas the Health Department is targeting. David Specter added that Dr. Locke has been selected to Chair a committee that is working on revisions to the Public Health W.A.c. 's. The Health Department is pleased to have him in that position. HEALTH BOARD MINUTES - JUNE 23,1997 Page 5 NEW BUSINESS - CONTINUED Commissioner Huntingford asked if the Health Department would look into a complaint received from a Gardiner resident about waste water draining down a County road which is coming from the property of a neighbor that has several birds? David Specter will look into the matter. David Specter and Chester Prudhomme briefed the Board on the Tobacco issue. Meeting adjourned. Soils on the site showed at least 24n of suitable material but due to mottling in soils below the 24" level indiciiUng a high seasonal w;2ter table it was determined that a wet season 8vaJ,uation could be conducted to verify the type of system required. Based on the wet season evaluati on results the engineer determined that a pressllri zed system could be installed on the loL and an application was received May 20, 1997. During review of t:.e appl i.cation I noted that the lot does not mee t the mini..mu..'lI. land area requirements of the onsite sewage cr)de. The minimum IFmd area requ.ired given the water supply and soil type is 15,000 square feet. The lot is approximately 13,200 square feet. DUe to this ~ack of land area the permit cannot be approved at this time. Appeal from a dedslon by the Health Officer pursuant to this Ordinance may be made by filing a written request with the Jefferson County .soard of Commissioners wi thin fifteen (15) days following the decision. The site is located on the north side of the Tyee Lane cul-de-sac, The site is unimproved The easterly adjoining parcel is improvcd with a single fan) ily residence, the westerly adjoining parcel is unimproved. The southeasterly property boundary line is well defined by the neighbors clearing and driveway, which is parallel to the property line. The northwesterly property boundary is not evident, vegetation being similar throughout the area, Both irons along the north eastern portion of thc parcel were located, prior to the rccent survey. Currently all corners are evident, a slU'Vey having been commissioned and completed by R.H. Winters Co., lnc. The site gradually slopes from the northeast to the southwest. '/Vegetation: '\ " ./ ----- ---- Other Information: ~7 -- .---- WAMU PROCESSING 141011 The site is an area mapped by the SCS (pg. 52) as Alderwood gravelly sandy loam (AIC) and Swantown gravelly sandy loam(StB). Six test holcs were dug by Mike Graves in October, 1996. The initial soil eValtUl.lion was conducted on October 30, 1996. The soil logs were found to bc consistent with the exception oftbe two holes located in the most northern portion of the property, Soils were similar to those described in the soil slU'Vey. The soils in the arca of the drainficld design can be generally described as follows: The upper horizon is a dark brown, sandy loam topsoil 10 between 2 and 4 inches. The second horizon ;$ II tan, gravel1y, loamy sand/sandy loam 10 between 15 and 24 inches. In some of the holes faint monling was found in this horizon. The third horizon is a light tan/grey, slightly compacted, mottled, sandy loam to between 30 and 36 inches, The lowest horizon was restrictive, being a grey compact, distinctly mottled, gravel1y, sandy loam. Roots were found between 28 and 36 inches. the site vegetation is predominantly comprised of a combination of second growth cedars and Douglas fir. The undergrowth is dense vvith Oregon grape, salal, sward fern and evcrgreen huckleberry. Susan Porto, Tillman Engineering and Linda Atkins, Jefferson County Health Department met on site to confer on soils and design criteria, Without the benefit of check the soils through the winter wet season, a sand filter/ pressure system would be needcd due to the mottling evident in the soils between 24 and 36 inches. A wet season evaluation was conducted, the results encloscd. Water tables in the vicinity of the drainfield design during January were between 33 and 43 inches. By the March evaluation the water table dropped to between 42 and dry.
