G. Brown, Chairman Larry W. Dennison, Member Richard E. Wojt, Member Larry Fay, Director of Environmental Health David Specter, Administrator Nancy Gow, Director of Nursing Services J. Peter Geerlofs, M.D., Health Officer CITY OF PORT TOWNSEND REPRESENTATIVE: Sheila Westerman The meeting was called to order by Commissioner Larry W. Dennison. The following Board and Staff members were present: Commissioner Richard Wojt; David Specter; Larry Fay; and J. Peter Geerlofs. Chairman Brown was absent because of his involvement in union negotiations. APPROVAL OF MINUTES: Commissioner Wojt moved to approve the minutes of January 23, 1992 as presented. Commissioner Dennison seconded the motion which carried by unanimous vote. Health Board Minutes - February 20, 1992 Page: 2 ADMINISTRATOR'S REPORT Financial Report: David Specter explained that he met with the Auditor and the Treasurer to set up a new system that will interface, code and track the Health Department budget status reports. He wants to make sure they have the proper checks and balances in place. The new phone system was budgeted at $7,000. The actual cost was $10,000. The difference was taken from other budget lines. Facility Update: The move to Castle Hill Mall is on schedule. The Health Department will be closed on March 6th and 9th and the actual move will take place the 7th and 8th. The Department will reopen on March 10th. David Specter will give the Board a tour of the space after this meeting. APEX Status Report: At the last APEX meeting the work group identified priority areas and worked on problem statements. The next step is an action plan. In Phase two, a Community Health Plan will be developed. David Specter explained that there would be public meetings during this phase. There was a discussion about different methods of obtaining public input. DIRECTOR OF NURSING REPORT WIC Proaram: The four and five year olds in this program will be finishing up and their places will not be filled by new applicants. This reduction was necessary to make the workload more manageable for Staff. Statistics: There was a discussion about the Monthly Statistics Report for Nursing and Environmental Health. It was agreed that a consistent, clearer format could be developed. Commissioner Dennison suggested using "productivity indicators". Peter Geerlofs and David Specter said they would work on this project. Health Board Minutes - February 20, 1992 Page: 3 DIRECTOR OF ENVIRONMENTAL HEALTH REPORT Statistics: Larry Fay noted on the statistics report under the Food Service category, there was a decline in the number of inspections last month. He explained that Environmental Health Specialist Gwen Howard had been working on some long term problems with restaurant managers in January and her time for inspections had been limited. He expected this line to improve next month. Under the On-Site Sewage Disposal category, there were 25 permits issued in January compared to 68 last year. The on-site sewage revenues have increased because they are inspecting existing systems because of an increase in building permits for remodeling, and also because low interest rates are encouraging people to refinance. Setback Variance Reauest for a Drainfield: Brooks Hanford: Mr. Hanford, who was present, is building a house in Seamount Estates, Larry Fay explained. His variance request is for a setback for a drainfield from an easement and from a property line. In November, 1989, a septic permit had been issued but the location of the house had to be changed. Mr. Hanford bought Lot 8 for a building site because Lot 9 is not a buildable lot. The access easement that is in question will end at Lot 8 since that is where his house will be. There was a discussion about three options: 1) vacating the lot line, 2) vacating the easement or 3) applying for this variance. The first two options are costly, and because Mr. Hanford plans to maintain both lots as a single site, Larry Fay recommends the variance be approved. Commissioner Dennison suggested a notice to title on Lot 9 to protect any future buyer, by advising them that Lot 8 and Lot 9 are a single building site. Commissioner Wojt moved to approve the variance for a five foot setback from the easement and a five foot setback from the lot line with the condition that a notice to title be put on Lot 9. Commissioner Dennison seconded the motion which carried by unanimous vote. Drainfield Variance Reauest: Bumaarner: Larry Fay explained that he had been working with Norman Bumgarner at Beckett Point for over a year on this variance. Mr. Bumgarner's cabin was almost washed away in the December, 1990 storm and his septic system was washed away. He has not been able to use the cabin for a year. Mr. Bumgarner wanted to use the same site for his septic system, but the Health Department advised against it. However, there is a category of marine repair that will allow a septic field within 25 feet of the bulkhead. In this catagory, a shallow pressure distribution system would work and also meet the other criteria. A second option may be an infiltrator system which could gain a foot on each side. They want to use existing tanks. The variance would include a setback from the tanks, a setback from the house, a setback from easement road, and a setback from the east property line. Health Board Minutes - February 20, 1992 Page: 4 Director of Environmental Health - Continued A condition of this variance would state that this is a marine repair and no expansion can be made on the house, except possibly a loft or second floor bedroom. The configuration of the house can't be changed. This would be a notice to title. Commissioner Dennison asked that runoff from the roof and road drainage also be taken into consideration in the plan. Commissioner Wojt moved to approve the variance with the above conditions. Commissioner Dennison seconded the motion which carried by unanimous vote. Adoption of Food Service Waiver Policy: Larry Fay explained that this policy has been discussed several times before. It is a waiver for selling non- potentially hazardous foods for events that last 3 days or less. The Farmer's Market vendors had requested the waiver because the County had required a licence. There is a fee for requesting a waiver. The staff reommendation is to have the permit will expire at the end of the calendar year. Commissioner Wojt moved to approve the Food Service Waiver Policy as amended. Commissioner Dennison seconded the motion which carried by unanimous consent. Proposed Amendment to Operatina Policy: Determination of Bedroom Buildina Plan and Sewaae Disposal Permit Consistency: This is an amendment to an existing policy, Larry Fay explained. In 1985, this policy was adopted showing criteria to identify a bedroom for the purposes of reviewing a building plan and how it relates to a septic permit. There are two methods in determining a bedroom. 1) Does the room have a window, a closet and a door? or 2) What is the square footage of the house? This policy states that a two bedroom house is under 1,500 square feet, a three bedroom is 1,500-2,000 square feet. Each addition of 500 square feet is a bedroom. If there is more than 1,500 square feet in a two bedroom house, it would require a notice to title. Since the time this policy was written the square footage on houses in Jefferson County has increased, with fewer bedrooms. Larry Fay proposes to amend the policy. The "closet, window and door" rule would still apply, but he would like to raise the square feet threshold. This would decrease the number of notices to title. Commissioner Dennison commented that he would like to wait until Chairman Brown is present to make a decision. Health Board Minutes - February 20, 1992 Director of Environmental Health - Continued Page: 5 Proposed Environmental Health Services Fee Structure: Larry Fay explained that he had put together a table averaging fee schedules of other counties in Washington State. The chart also showed how our fees compare. He would like to make modest increases across the board, keeping the average fee increases at $25- $29. These increases could add as much as $50,000 in revenue. At the present time, some necessary staff members are being paid from grants. If staff has to be cut, much of the time would be spent writing permits in the office, not out in the field. The public process for adoption of this ordinance would go to public hearing and on the Board Of County Commissioners agenda. Commissioner Dennison commented that he would like to get Chairman Brown's opinion on pursuing this ordinance. ******* The next regular meeting will be held Tuesday, March 17, 1992. " '\ ' I' JEFFERSON COUNTY HEALTH DEPARTMENT ENVIRONMENTAL HEALTH SERVICE POLICY STATEMENT NUMBER 1-92 Program - Food Service Subject - Waiver from a Temporary Food Service Permit Effective this date, the following policy shall be adopted concerning a waiver from a temporary food service permit for non-potentially hazardous foods. WAC 248-84-065, Temporary Food Service Establishments The health officer, when no health hazard will result, may waive or modify requirements of these regulations. 1) A waiver from a temporary food service permit may be issued for the preparation and serving of non-potentially hazardous foods at events lasting 3 days or less within the week. The waiver shall expire at the end of the calander year. 2) Applications for a waiver shall be filed in person on forms provided by the Jefferson County Health Department a minimum of two working days before the event. 3) A fee shali be charged. Box 1220 Port Townsend, WA 98368 Dear Commissioners, It is my understanding that the Health Department has on their agenda when they meet with you February 20th, the approval of the guidelines allowing people to sell non-hazardous foods at the Farmers' Market. I understand that this pro<:ess will allow those people to pay a $1 0 annual fee for a temporary food service permit waiver. Although the health department has assured me that there shouldn't be any problem having this approved, this will be the third time it has come up at the monthly meeting and it has yet to be approved. I would like to say, on behalf of those people who would like to sell prepared food at the Market, that the effort that the Health Department has put into this pro<:ess is greatly appreciated. Selling home prepared baked goods is one way in which a person can supplement their income, or in some cases derive a major part of their income. Since one of the goals of the Market is to provide a local market for Io<:al food producers, it is important to include those who want to sell prepared food as well as locally grown produce. Another goal of the Market is to provide quality food for local customers. The Market has guidelines that prohibit anyone from selling anything that is not of top quality. This currently applies to produce and crafts, and will apply equally to prepared food. Passing the guidelines that the Health Department has set up to allow home prepared food to be sold would be an asset to the Market, benefiting both the vendors and the customers. I hope you will consider its approval this month. The Market intends to open in April and we would like to have the Health Department guidelines end forms ready to give to interested people sometime in March.
