The meeting was called to order by Chairman B.G. Brown. The following Board and

ADMINISTRATOR'S REPORT
FINANCIAL REPORT: David Specter reported that 73.7% of the budget has been
expended and 70.4% of budgeted revenues have been colk'cted as of October 1, 1992. He
stated grJ.Ilts and programs have been initiated that involve budget extensions, however, before
reque:;ting any extensions he will review the budget to see if the costs can be covered
through transfers. He reported grants are in good shape and environmental health fees are
beginning to pick up.

DIRECTOR OF NURSING RECRUITMENT: There were 5 applicants for the position
of Nursing Director. Some minimum requirements were established for background
experience. Jean Baldwin met all the requirements and was the best primary candidate. She
was interviewed on October 15, 1992 and was appointed the new Director of Nursing.
PROGRAM/GRANTS UPDATE: David Specter reported there are a number of contract
and grant continuations that need signatures. He will review contracts and grants to insure
that escape clauses exist for decisions made in 1993. The strategy for budget cutbacks in
1993 is reduction in programs. David Specter will be meeting with the Board members
individually to discuss this matter further.
ENVIRONMENTAL HEALTH DIRECTOR'S REPORT
PROPOSED FEE SCHEDULE: Larry Fay presented to the Board the proposed 1993
fee schedule for environmental health services. He has reviewed the fees and services to
determine the impact if they are adopted. The cost of services provided need to justify the
proposed fee increases. David Specter has calculated the total direct and indirect cost of
operating all Environmental Health programs to be $160,471 for 1993. The current fee
schedule will only yield approximately $120,000 in revenue at the service levels prQjected.
If the proposed fee schedule is adopted it would yield approximately $162,000, enabling
Environmental Health Activities to be self-supporting.
Larry Fay researched how the current and proposed fees compare to neighboring Counties.
He reported that it is difficult to directly compare, since each County conducts their business
differently. The projected program cost for food service will be approximately $18,000.
Adoption of the proposed fees would generate approximately $24,000. David Specter stated
the proposed fees are justifiable and would generate an additional $43,000 in revenue. Larry
Fay then asked the Board for direction on this matter.
The Board stressed the importance of justifying the fee increases by determining the costs of
providing the services, rather than increasing fees by a certain amount across the board.
Chairman Brown stated rather than averaging the fee increases to subsidize low revenue
prognuns, it would be more appropriate to receive a higher level of funding from general tax
dollars for programs that benefit the general public (ie. food service). Onsite septic permits
benefit the person applying for the permit, not a large percentage of the public. Larry Fay
stated be would review the proposed fee increase figures to make sure they reflect the
program expenses.
RECREATIONAL SHEl.LFISH AGREEMENT/PLAN: This is an interagency
agreement between the State Department of Health and the local Health Department to
provide services for shellfish activities. The services are broken down into two categories
(I) "Closure Response and Information" which the Health Department is already doing and
(2) "Education, Monitoring, and Voluteer, Interagency Coordination. Larry Fay stated that
they will be working with the Cooperative Extension office on this. There has been $8,000
allocated to Jefferson County for doing these activities. By signing the agreement the County

receives $1,000 for doing item (I). The balance would be received for doing item (2).
After further discussion of the activities and the costs, Commissioner Dennison moved to send
the agreement to the Board of County Commissioners for signing. Commissioner Wojt
seconded the motion, which carried by a unanimous vote.
The next meeting will be November 17, 1992.

SCOPE OF WORK
A: TITLE:
Recreational Shellfish Joint Plan of Operation, Jefferson
County Health Department, Washington state Department of
Health.
B: DESCRIPTION: The purpose of the project is to develop a plan
designating the roles of the Jefferson County Health
Department and the Department of Health in
administering recreational shellfish programs and
provide a funding mechanism to the Jefferson County
Health Department to carry out its identified
activities.
C: JEFFERSON COUNTY ACTIVITIES:
1) Closure Resoonse and Information
Jefferson county Health Department will continue to provide
general health and safety information to the public concerning
recreation shellfish harvesting and to provide for local response
to emergency closures. Specific activities will include:
a) Provide for response to public inquiries by direct
contact, phone queries and written reports.
b) Assure that public beaches are adequately posted in
response to emergency closures as determined by the
Department of Health or Jefferson County Health
Department. Posting may be accomplished by Jefferson
County Health Department staff, or other agency staff
(Parks & Recreation, Cooperative Extension, etc.).
2) Education. Monitorinq and Volunteer. Interaqencv Coordination
The Jefferson County Health Department will provide staff support
for the recruitment and training of volunteers for shellfish
monitoring of six to seven public beaches, provide for
coordination between local health, volunteers, and other water
quality agencies (ie Cooperative Extension, Adopt-a-Beach, etc.).
Specifically, the Jefferson County Health Department will perform
the following:
a) The Jefferson County Health Department will work with
the WSU Cooperative Extension Service to recruit,
train, coordinate and enhance the volunteer activities
in Jefferson County. The Jefferson County Health
Department may utilize the resources of other agencies
for education and training purposes and will attempt
to maximize communication and efficiencies and reduce
duplication.

b) Using volunteers, additional PSP and bacterial/chemical
monitoring will be performed at targeted public
beaches. Jefferson County Health Department will
assist in scheduling sample periods, assuring targeted
beaches are covered and handling samples.
c) Jefferson County Health Department will schedule
sampling periods in conjunction with the DOH
laboratory's work load and provide transportation of
samples to the lab.
d) The Jefferson County Health Department, working with
volunteer groups and other county agencies, will
provide for the posting and maintenance of shellfish
advisory signs on beaches identified by the Department
of Health.

INTERAGENCY AGREEMENT
between
STATE OF WASHINGTON
DEPARTMENT OF HEALTH
and
LOCAL HEALTH DEPARTMENTS
THIS AGREEMENT, pursuant to Chapter 39.34 RCW, is made and
entered into by and between the DEPARTMENT OF HEALTH, hereinafter
referred to as "DOH," and the 12 Puget Sound Local Health
Departments and jurisdictions hereinafter referred to as the
"LHDs".
IT IS THE PURPOSE OF THIS CONTRACT TO provide a joint plan of
operation designating the roles of each agency for administering
a recreational shellfish program, as described in WAC 246-280.
IT IS, THEREFORE, MUTUALLY AGREED THAT: The Local Health
Departments will continue to provide services that are part of
their overall mission toward protection of public health. The DOH
will provide additional funds to the LHDs to perform recreational
shellfish program activities as outlined in the Scope of Work,
marked as Exhibit A attached hereto and by reference incorporated
herein.
The DOH will continue to assume the primary role for tasks such as
classification, data management, monitoring protocols, laboratory
analysis and coordination and regulation revision.
STATEMENT OF WORK
The LHD shall furnish the necessary personnel and services and
otherwise do all things necessary for or incidental to the
performance of the work set forth in the Scope of Work attached
hereto and incorporated herein. Unless otherwise specified, the
LHD shall be responsible for performing all fiscal and program
responsibilities as set forth in the Scope of Work.
TERMS AND CONDITIONS
All rights and obligation of the parties to this contract shall be
subject to and governed by the SPECIAL TERMS AND CONDITIONS
contained in the text of this agreement.
PERIOD OF PERFORMANCE
Subject to its other provisions, the period of performance of this
agreement shall commence on October 1, 1992, and be completed on
June 30, 1993, unless terminated sooner as provided herein.
IN CONSIDERATION WHEREOF:
DOH shall pay to the LHD for those services provided herein as
follows:
An amount not to exceed $1,000.00 to prepare a Joint Plan
of Operation.
An amount OF $8,000.00 to perform tasks as outlined in
the Scope of Work.
BILLING PROCEDURE
DOH will reimburse the LHD upon receipt of properly executed
vouchers. Claims for payment submitted by the LHD to DOH for costs
due and payable under this agreement that were incurred prior to
the expiration date shall be paid by DOH if received by DOH within
120 days after the expiration date.
NON-DISCRIMINATION
In the performance of this agreement, the LHD shall comply with the
provisions of Title VI of the civil Rights Act of 1964 (42 USC
200d), Section 504 of the Rehabilitation Act of 1973 (29 USC 794)
and Chapter 49.60 RCW, as now or hereafter amended. The Local
Health Department shall not discriminate on the grounds of race,
color, national origin, sex, religion, marital status, age, creed,
Vietnam era and disabled veterans status, or the presence of any
sensory, mental, or physical handicap in:
a. Any terms or conditions of employment to include taking
affirmative action necessary to accomplish the objectives
of this part; and
b. Denying an individual the opportunity to participate in
any program provided by this agreement through the
provision of services, or otherwise afforded o~hers.
In the event, the LHD is in noncompliance or refusal to comply with
the above provisions, this agreement may be rescinded, canceled,
or terminated in whole or in part, and the LHD declared ineligible
for further agreement with DOH. The LHD shall, however, be given
a reasonable time in which to cure this noncompliance. Any dispute
may be resolved in accordance with the "disputes" procedure set
forth therein.

RflCORDS MAINTENANCE
The LHD and DOH shall each maintain books, records, documents and
other evidence which sufficiently and properly reflect all direct
and indirect costs expended by either party in the performance of
the services described herein. These records shall be subject to
inspection, review or audit by personnel of both parties, other
personnel duly authorized by either party, the Office of the State
Auditor, and federal officials so authorized by law. The LHD will
retain all books, records, documents, and other material relevant
to this agreement for five years after expiration and the Office
of the state AUditor, federal auditors, and any persons duly
authorized by the parties shall have full access and the right to
examine any of these materials during this period.
CONTRACT MANAGEMENT
The work described herein shall be performed under the coordination
of the Program Manager, Derry Suther, of DOH and the LHD or their
successors, who will provide assistance and guidance to the other
party necessary for the performance of this agreement.
INDEMNIFICATION
Each party shall defend, protect and hold harmless the other party
from and against all claims, suits and/or actions arising from any
negligent or intentional act or omission of that party's employees,
agents and/or authorized subcontractor(s) while performing this
contract.
AGREEMENT ALTERATIONS AND AMENDMENTS
DOH and the LHD may mutually amend this agreement. Such amendments
shall not be binding unless they are in writing and signed by
personnel authorized to bind the LHD and the Secretary or hiS/her
delegates for DOH.
TERMINATION
Except as otherwise provided in this agreement, either party may
terminate this agreement upon 30 days written notification. If
this agreement is so terminated, the terminating party shall be
lia~le only for performance in accordance with the termg of this
agreement for performance rendered prior to the effective date of
termination.
SAVINGS
In the event funding from state, federal, or other sources is
withdrawn, reduced, or limited in any way after the effective date
of this contract and prior to normal completion, the department may
terminate the contract under the "termination" clause, subject to
renegotiation under those new funding limitations and conditions.

DrSPUTES
In the event that a dispute arises under this agreement, it shall
be determined in the following manner: The Secretary of DOH shall
appoint a member to the Dispute Board. The LHD shall appoint a
member to the Dispute Board. The Secretary and the LHD shall
jointly appoint a member to the Dispute Board. The Dispute Board
shall evaluate the dispute and make a determination of the dispute.
The determination of the Dispute Board shall be final and binding
on the parties hereto.
ORDER OF PRECEDENCE
In the event of an inconsistency in this contract, unless otherwise
provided herein, the inconsistency shall be resolved by giving
precedence in the following order:
a. Applicable Federal and state statutes and Regulations;
b. Special Terms and Conditions;
c. General Terms and Conditions;
d. Statement of Work; and
e. Any other provisions of the contract whether incorporated
by reference or otherwise.
ALL warTrNGS CONTArNED HERErN
This agreement contains all the terms and conditions agreed upon
by the parties. No other understandings, oral or otherwise,
regarding the subject matter of this agreement shall be deemed to
exist or to bind any of the parties hereto.
