Fischbach Clerk of the Board: Lorna Delaney MINUTES Week of October 15, 2007 Chairman Phil Johnson called the meeting to order in the presence of Commissioners David Sullivan and John Austin. PUBLIC COMMENT PERIOD: The following comments were made by citizens. A suggestion was made that the Commissioners establish a committee to review water issues and the need for a Clean Water District; there is no justification for a countywide Clean Water District; the Board needs to listen to the people who have made the County what it is; there is a new Supreme Court decision on Critical Areas Ordinances which the County should review carefully; the Board was urged to provide independent legal instruction to the Planning Commission so that the time frame that the Board has established can be met; the Board needs to look at cases in the Courts as well as what the costs of various regulations will do to homeowners on a fixed income; the meeting on the Clean Water District is being scheduled in the middle of the day, in a room that has been too small for the public in the past; people are costing the public money by asking to review so many public records; the need for electronic copies of public records, and an expression of appreciation for the work Herb Beck has done in the Quilcene community. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to delete Item 1 and to approve the balance of the Consent Agenda as presented. Commissioner Austin seconded the motion which carried by a unanimous vote. 1. DELETE: RESOLUTION re: Temporary Closure of McInnis Road, County Road No. 336109, Quilcene 2. HEARING NOTICE re: Intent to Declare Surplus County Property; Hearing Scheduled for Monday, November 5, 2007 at 10:00 a.m. in the Commissioners Chambers 3. AGREEMENT, Supplemental re: Post-Closure Landfill Gas and Ground Water Monitoring and Testing; Jefferson County Public Works; Aspect Consulting 4. AGREEMENT NO. G0800068 re: Stream Flow Gaging; Jefferson County Public Health; Washington State Department of Ecology 5. Payment of Jefferson County V ouchers/W arrants Dated October 8, 2007 Totaling $314,067.89 6. Payment of Jefferson County Payroll Warrants Dated October 5, 2007 Totaling $677,034.88 and AlP Warrants Done by Payroll Dated October 8,2007 Totaling $535,933. Page 1 Commissioners Meeting Minutes: Week of October 15, 2007 Interview Person Interested in Serving on the Parks and Recreation Advisory Board Representing District No.1: The Board interviewed Jane Storm who resides in Commissioner District #1 and has expressed interest in serving on the Parks and Recreation Advisory Board. At the conclusion ofthe interview Commissioner Sullivan moved to appoint Jane Storm to a 2 year term on the Parks and Recreation Advisory Board (term to expire October 15, 2009.) Commissioner Austin seconded the motion which carried by a unanimous vote. APPROVAL OF MINUTES: Commissioner Sullivan moved to approve the minutes of September 24, 2007 and Special Meetings of September 24, 2007 (Joint Clallam County/Jefferson County Commissioners Work Session), September 26, 2007 (Executive Session) and September 26, 2007 (Public Hearing) as submitted. Commissioner Austin seconded the motion which carried by a unanimous vote. County Administrator Briefing Session: John Fischbach reviewed the following items during the briefing. * There will not be a County Administrator Briefing at 1 :30 p.m. today. * There have been statements made that 13 of the 39 counties in the State are having financial difficultly. He handed out copies of pages from a book about City/County financial assistance funding from the State and there are actually 18 counties that get this assistance. Jefferson County does not qualify for this assistance. The parties involved in appealing the Hearing Examiner's decision regarding Port Ludlow are re- entering the mediation process. The County is not participating financially because the County doesn't have a part in this issue. The County will, however, be at the table with the appellants and PLA. If the Hearing Examiner decision is substantially changed it is subject to another appeal process. Peter Buck will be the mediator again. David Wayne Johnson from DCD will sit at the table with the appellant and PLA. The meeting with the Jamestown S'Klallam Tribe is scheduled on Saturday, December 1, 2007 (here in the Courthouse.) The meeting with the Quinault Nation will be held in Grays Harbor County with both Board's of Commissioners on Wednesday, November 28,2007. He asked the Board members to provide suggestions for items to be discussed in these special meetings. The City was asked to re-calculate the capacity ofthe Superior Courtroom. The occupant load for this courtroom has been increased to 173 per the floor plan provided to the City Planning Department. It could go higher with a new floor plan. The Courtroom will be posted with this new occupancy for the meeting on Wednesday. The sewer update was handed out. Commissioner Sullivan reported on the meeting of a sub- committee ofthe legislature that he attended and a bill being proposed. The draft bill would provide an amount from State sales tax for counties that border Puget Sound to use for funding water quality programs such as a clean water district. This is a very preliminary proposal. Commissioner Austin reported that he was told this proposed legislation is a work in progress and is limited in scope. * * * * Page 2 Commissioners Meeting Minutes: Week of October 15, 2007 * A copy of a letter from Richard Hild (presented last week) was handed out which states opposition to the National Animal Identification System. Commissioner Austin suggested that the County Administrator get an opinion from WSU Extension and the County Animal Control regarding this proposal. Commissioner Sullivan asked if Snohomish County has actually passed this resolution? Reminder - Wednesday - 9 to 11 a.m. the meeting on the Clean Water District will be held in the Superior Courtroom. Chairman Johnson asked for a briefing next week on the project that requires the temporary closure of McInnis Road in Quilcene. * * NOTICE OF ADJOURNMENT: Commissioner Sullivan moved to adjourn the meeting at 10:04 a.m. to 9:00 a.m. on Wednesday in the Superior Court courtroom.
