Fischbach Clerk of the Board: Lorna Delaney MINUTES Special Meeting October 17, 2007 Chairman Phil Johnson called the special meeting to order at the appointed time. Commissioner David Sullivan and Commissioner John Austin were both present. Deliberations and Possible Adoption re: Proposed Clean Water District Ordinance: Chairman Johnson asked staff to make a brief presentation. Neil Harrington, Environmental Health Supervisor, explained that the Clean Water District, as proposed, includes all of eastern Jefferson County. The District would be formed per RCW 90.72. This District is not a new management structure and the work will be done with existing management staff in the Health Department, the Conservation District and WSU Extension. The program the District will implement has 4 elements: 1) Water Quality Monitoring Plan - Fresh water monitoring will be done by the Conservation District and saltwater monitoring will be done by Jefferson Public Health 2) Pollution Degradation Correction - Conservation District and Public Health would handle this work. 3) On-site Septic System Operations and Maintenance Program - The PUD as of January 1, 2008 will no longer be doing this program in the County. 4) Education and Outreach - WSU Extension will be handling this element. Commissioner Sullivan asked if any of these things will happen if the program isn't funded and if any of these programs have been done in other counties? Neil Harrington answered that they have some grants for limited programs, but most of the work cannot take place without additional funding. These programs have been successful in other counties. Commissioner Sullivan then asked ifthe monitoring data will measure what is needed for life in a stream? Neil Harrington indicated that is correct, they are basic stream parameters. People are going to want this information in the future. In the late 1980s and early 1990s the Conservation District collected this type of data for some streams and they have been able to use that data to plan programs to improve the monitored streams. Commissioner Austin said that it appears the ordinance being considered is what was proposed earlier with the funding removed. Chairman Johnson asked how many rivers and streams would be monitored if this program was instituted to its optimum? Neil Harrington said there would be about 30 streams, some of which there is little or no data on currently. The Advisory Board is another issue, Commissioner Sullivan pointed out. Has the County heard anything from the City about their participation? County Administrator John Fischbach answered that he hasn't heard anything from the City. The Advisory Board will have to be established by resolution. Page 1 Commissioners Meeting Minutes: Week of October 17, 2007 Chairman Johnson noted that the County must do something with Discovery Bay no matter what. A 90 day extension has been granted from the original 180 day deadline. Neil Harrington reported that he believes the Board has until the 21 sl of October. Commissioner Sullivan said that this program depends on having a funding source. If the funding in the ordinance is not approved then the funding for this work will be in competition with everything else funded through the General Fund. Commissioner Austin moved to adopt ORDINANCE NO. 08-1017-07 establishing a Clean Water District as it is written with the funding to be discussed and authorized at a later time. Commissioner Sullivan seconded the motion. He noted that water quality affects everyone in the County and we need to look at this globally and say we're all in this together. The funding mechanisms we have will be ones that are paid for by everyone. Chairman Johnson called for a vote on the motion which carried by a unanimous vote. Discussion to Take Motion Off Table; Motion Tabled at September 24, 2007 Meeting to Fund Discovery Bay Clean Water Project Grant (#G0800056) Match for 2008 from Reserves: Commissioner Austin moved to take the motion that was tabled at the September 24, 2007 meeting to fund the Discovery Bay Clean Water project grant match from 2008 reserves off the table for discussion. Commissioner Sullivan seconded the motion. Chairman Johnson called for a vote on the motion. The motion carried by a unanimous vote. Continued Discussion of Motion to Fund Discovery Bay Clean Water Project Grant (#G0800056) Match for 2008 from Reserves: Commissioner Sullivan noted that he is concerned about taking this funding out of reserves. He feels that any money spent on this in 2007 will come out of reserves and in 2008 and 2009 the money will have to be budgeted. Commissioner Austin stated that he does not want this to come out of reserves every year just in 2008. The funding from reserves would be to match the grant from DOE and then the County will work hard to find another funding source. The first year match for the DOE grant is $55,000. Commissioner Sullivan feels that committing to use reserves in 2008 is premature and he is willing to make it part ofthe budget in 2008. County Administrator John Fischbach explained that the Board needs a resolution approving the grant and then it will be matched. It can be as a budgeted item in 2008. Commissioner Sullivan made a friendly amendment to the motion that the last two words "from reserves" be deleted. Commissioner Austin then restated his amended motion to fund the Discovery Bay Clean Water Project grant (#G0800056) match be funded. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Page 2 Commissioners Meeting Minutes: Week of October 17, 2007 AGREEMENT re: Hood Canal Clean Water Project #G0800055; Jefferson County Public Health; Washington State Department of Ecology and Discussion of Motion to Fund Hood Canal Clean Water Project Grant (#G0800055): Commissioner Sullivan moved to approve the agreement for the Hood Canal Clean Water Project (G0800055) with the State Department of Ecology. Commissioner Austin seconded the motion. Chairman Johnson called for a vote on the motion which carried by a unanimous vote. Commissioner Sullivan stated that this will be handled as other grants are handled and the funding will be budgeted. NOTICE OF ADJOURNMENT: Commissioner Sullivan moved to adjourn the Special Meeting at 9:32 a.m. until the next regular meeting on Monday, October 21,2007 at 9:00 a.m. in the Jefferson County Commissioners' Chambers.
