The County Engineer, during the progress of the work, may by given notice to the contractors, alter any of the details of con- striction in any manner that may be found expedient or suitable; such alterations shall not invalidate the contract, and the contractor must accept and execute the same as if they were a part of the original cony tract, and at the completion of the work an allowance will be made for such alterations, etc, either for or against the contractor as the case may be, and the value of such alterations will be estimated by the engineer from the schedule of rates and prices attached to the contract, or should it not apply, the equitable amount will be estimated by the engineer. i. It is mutually agreed between the parties to the contract, that to prevent all dispute and misunderstandings between them in relation t o any o f the stipulations c onta ins d in these specifications , or their performances by either of said parties, that the county Engineer shall be an umpire to decide all matters arising or growing out of said contract between them. j. The contractor will be held responsible for the faithful execution of the work in accordance with the specifications. All work shall be neatly cleaned up on completion according to the engineers directions, and be left in a neat and orderly condition ready for use. 1. The contractor shall, for the same compensation as for other grading, grade a safe, proper and workmanlike connection with all intersecting public or private reads or driveways, according to the directions of the engineer. n. All material and workmanxship shall be of the best of its class or kind. All material which may be rejected shall at once be removed from the vicinity and. replaced by material oP approved quality. o. The contractor shall give his personal attention to the faithful prosecution of the work, shall not sublet the same or any part thereof without the written consent of the county. Copies of all sub»contracts must be filed with the County engineer. Contractor shall not assign, by power of attorney or oy6therwise, any of the moneys prayable under thdee spec ificationa. p. Whenevex the contractor is not present on the work, orders. will be given to the superintendent or overseeer who may have immediate charge thereof, and shall by him be received and obeyed. If any person employed on the work shall appear to be incompetent, disorderly or unfaithful, he shall, upon the requisition of the engineer, be at once discharged and not again employed upon any part of the work. q. The county engineer may suspend all work on any or all portions of the road for such periods as he may deem necessary. CLEAgING• The right of way will in general be cleared to the width of ~ feet on each aide of the center line but will be cleared togreat~ler widths where ordered by the engineer. Clearing outside of the right of way shall be done under the same specifications and b® paid for at the same price as clearing within the rightt of way. The clearing will in all cases conform to the stakes set by the engineer. 'R~'ithin the lines staked by the engineer and except as hereinafter spscif ied, all trees, brush, logs and other vegetable matter shall be removed and burned within the right of way. No stump shall be left in the cleared space with a height greater than its diameter. Under fill$ of more than thEee feet, the top of stumps shall be at least twa feet below grade. Trees designated by the engineer shall be left standing and care shall be exercised by the contractox not to damage such trees in fall» ing adjacent timber or in burning. All merchantable timber shall be cut into logs of standard lengths and decked along the edge of the clearing or within the right of way outside of the clearing, free from rubbish and worthless loge. At such times as the State or Government authorities prohibit burning, the refuse from the clearing shall be piled along the sides of the right of way at points where its burning will net damage stand ing timber, and when such prohibition is removed the piles of refuse shall be burned. Clearing must be carritd on and completed at least one-half rails ahead of the grading. Clearing will be paid for by the acre for the area actually cleared by the contractor in accordance with the stakes set by the engineer. -1- 2.GRUBBIIdG. A1.1 stumps, roots aad other wood embedded in the ground within the areas included between the slope stakes of all excavation and all fills shall be removed and burned withir, the right of way. Grubbing will be estimated and paid for by the acre for the area actually grubbed by the contractor within the 1 units above spec if fed. 3.GRADI1~G, Under this head is included all excavations and embankments required for the formation of the roadbed, the digging of drain ditches and cutting new channels for streams, either within or without the right of way, excavations or embankments for bridges and culverts and the grading of intersecting highways and private roads, and grading new approaches when ordered by the engineer. Grading will be paid for by the cubic yard of excavation and the price bid per cubic yard of excavation shall cover all materials excavated of whatsoever character, which price with the additional price paid for overhaul hereinafter defined shall be full compensate tion for excavating the material, hauling into embanlnnent or dispos~• ing of it as directed by the engineer and finishing the roadbed and slopes as hereinafter directed. The material required for the format ion of embankment not formed from the excavation tkaen from the .regular sections ~~the roadbed will 'oe obtained from the side ditches as shown on the iarofile or as staked by the engineer and from excavations outside of the roadbed known as borrow pits The side ditches shall conform to the stakes set by the engineer. Should it be necessary at any place to go below the level of the ground water in execavation such excavated material will be included under the heads of excavation or embankment and no additional com y pensation will wd~ be made for wet excavation or f'ns such mat~erail -2- I pieced in embankment, No shrinkage will be allowed for material placed in embankment from bnrroW pits and payment will be made on quantities computed from the cross-section of the embankment as staked by the~engineer. Grading will be measured in excavation. If the roadbed excavation of regular sections does not furnish sufficient material for forming the embankment, the additional material required will be obtained by .Widening the roadbed or from excavations outside of the roadbed known as borrow pits. If a borrow pit is of necessity so irregular in shape as to make an accurate measurement impossible, the settle embankment formed from such borrow pit may be taken as the measure of the excavation in the borrow pit. The price paid for excavation shall include hauling the material within and up to a distance of four hundred (400) feet. The excavation shall be hauled to any distance that the engineer may direct end as compensation for hauling excavated material to distances greater than the specified four hundred feet, '; the price given in the contract for overhaul will be paid on each yard for each one hundred feet that it is hauled beyond the above spec if ied four hundred feet . Side slopes shall be made as ste,ked by the engineer. In case slopes shall slide into the excavation during the progress of the work, the slide material shall be removed at contract prices per cultic yard for extra work. Overbreaks due to blasting will be reg. moved by the contraci~or at his own expense. The surface of the roadbed shall conform strictly to the final grades set by the engineer, and shall be composed of the best material obtainable from the ~~ .~~ excavation. No boulders shall be left protruding from the surface and all stones of greater diameter than tWO inches shall be removed from the entire surface of the roadbed. The materials composing the embankment must be entirely ire- perishable, and wherever the natural surface upon which the~em~ankment is to be placed is of such a nature as, in the opinon of the engineer could impair the stability or usefulness of the surface, it shall be removt;d to such Width and depth as the engineer may direct, and the _3„ material so removed, disposed of as ordered. ~Phenever the site of an embankment is covered with $now sufficiently deep to impair the utility of the work, the same must. be removed and deposited beyond the slope stakes. fork of this nature shall always be at least one hundred (100) feet in advance of the embankment. In all cases whenever the engineer may deem such a course necessary, the •cuttings shall be made below grade, and clean sand, gravel, or other material deemed proper for a roadbed, shall be procured by the contractA or and deposited as the engineer may direct, and such work shall be estimated and paid for at the same price per cubic yard as other grad- ing. A~1 excavations shall, if require3, be taken or hauled into the nearest embankment to the extreme distance required by the engineer. The~surplua beyond what is necessary to form the contiguous embankments, is to be disposed of in widening the embankments uniformly along one or both sides of the same, or is to be deposited in waste banks or other - wiae, or is to be hauled to form any embankment on the road to be improved, as the engineer may direct, In cases where the quantity of material taken from the regular cuttings shall not be sufficient to form the requisite embanlonent , the def is iency shall be supplied by taking material from cuttings within or without the right of way, at such places as the engineer may direct, or from an enlargement of the regular cuttings, made equally or unfarmly on one or both sides of the same, and-the sides of the excavation in all cases shall be dressed to such slope as the engineer m~it require, provided that if the contractor shall have. sloped such excavation by direction of the engineer before widening the same, he shall regeive for sloping the second time such compensation as the engineer may deem fair and reasonable. Borrow pits shall be connected with ditches and drained to thenearest natural outlet. 4.. Side elopes of borrow pits on the right of way shall be the same as` used in the cross-section of adjoining roadbed. A berm of not lass than six (6) feet in width shall be left between the slope stakes of the emban]nnent and the edge of the borrow pit; and a berm of not less than two (2) feet shall be left between the outaide elope of the borrow pit and the right of way line. The berm must consist of original unbroken ground. - In rock excavation the contractor shall be required to excavate eight (8) inches below the grade and to bank-fill with material approv- ed by the engineer, to true grade and crown. Allowance gill be made to the contractor, at contract prices for excavation and borrow, if necessary to borrow material for back fill 1~henever the right of wayis crossed by public or pri~rate ~¢oads, commodious passing places must be kept open and in safe condition for use~x at the expense of the contractor and in passing through farms the contractor must also keep up, at his own expense, such temporary fences as shall be necessary for the preservation of the crops, and .all damages resulting from a non-compliance with this specification will be charged to the contrao~or.. Contractors, when directed by the engineer, shall deposit on the side of the road, or at such convenient points as may be design aced any stone or rock that they may e~eavate, and if in so doing, they shall deposit material required for embankment, the additional number of cubic yards of excavation required in forming such embank- ment will be allowed and paid for. All stone. or rock excavated and deposited as above, together with all the timber removed from the line of the road, shall be the property of the county and the contract- or will be held responsible for its safe keeping until removed by the proper authority, or until. the contract is completed.. 4.CUI,V~TS. Culverts are to be of concrete and of wood as shown on the profiles. -5- Log culverts shall be built of sound cedar logs nat less than 16 feet in ~?.erlgth, not less then 12 inches in diameter with tie logs at~intervals of eight feet and between all courses, properly notched into the face of the log extending across the full width of the embankment, and anchored where necessary. Covering to consist of ' cedar slabs at least six inches in thickness and extending across and at right angles to the s logs. Log culverts to be construct.- ed and well drift»bolted together as shown by the plans furnished by the engineer. S.CONCRETA PYPL. Concrete pipe must be dense., smooth and free from any imperfection that would impair its strength. It shall be mixed in the propertions of one (1) part Portland cement, two '~~j° (2),parts sand and one and one~half (1~) parts clean pea gravel; or one (1) part Portland cement and three (3} parts of properly graded sand, ranging in size from one-half (~j inch down to one hundred (140) meshto the inch, thoroughly mixed and tamped into forms. ~daterial sha11 conform to the standards adopted august l6th, 1909 by the American Society for Testing ~daterials. A trench shall be dug to the lines and one (1) foot below the grade given by the engineer, if so ordered, and back-filled with gravel or suitable material and thoroughly tamped to give an unyielding foundation. After the pipe is placed, the trench shall be back-filled with gravel or other suitable material, and thoroughly tamped as back- filling progxeeses. Special attention shall be given to tamping joints. Hewed timber may be substituted for sawed timber, subject to the approval of the engineer, and shall be of cross section equal to that as shown for sawed timber in plans, exclsusive of sap or wanes. CgIBBING; Timber cribbing shall he built of sound,straight to s of the best kind of timber at hand. The bark shall be peeled g from loge before placing them in the cribbing. Where cribbing is placed on earth foundation, the lower course of logs shall be laid upon mudaills, which shall not be less than three (3) feet in length 12 inches thick with a twelve (12) inch face and placed not more than eight (8) feet apart and sunk in the ground so that the top of sill shall be level with the solid ground, The lower course of loge shall. be notched eo that the flat surface shall rest upon each sill and shall be drift-bolted with three fourth (~) inch drift bolts, extending at least six (6) inches into the sill. The. top course of Iogs shall be bolted to the course below at feet with three fourths (~) inch drift bolts intervals of eigkit (S) which shall extend at least ten (10) inches into the second long. gibbing shall be built of logs not less than sixteen (16) feet in length, and twelve (12) inches in diameter at the smaller end and _$_ each course of logs shall break joints with the adjacent courses, The crib logs shall be held in place by tie logs laid between each course at intervals of not more than eight (8) feet and at right angles with the face of the cribbing, extending toward the center of the road, and of such length as may be necessary to securely hold the cribbings in place. X. The contractor shall provide sufficient, safe and proper facilities at all times for the inspection of the work by the County or its authorized representeaives. The said contractor shall furnish the county or its authorized representatives, without charge, samples of materials used in construction as laid samples may be required, in order that the character of such materials may be determined,. Defective work or material may be condemned by the County engineer at any time before the final acceptance of the work, notice of such condemnation shall be given in writing by the County Engineer; such condemned work shall be immediately taken down or changed. Defective material shall be irrunediately removed or disposed of to the satisfact- ion of the County engineer. Failure or neglect oII the part of tYi~ county engineer to condemn unsatisfactory material or reject inferior workmanship shall in no way release the contractor, nor shall it be construed to mean the acceptance of such work, nor shall the final ~5~ acceptance bar the.eounty of Jefferson, ~Faahington from recovering damages in case fraud was practiced. Time lost in replacing such improper work shall furnish no ground to the contractor for claiming an extension of time for the completion o~ the work. Incompetent, careless or negligent employes shall be forwith discharged by the contractor upon the written request of the county engineer, or his authorized representative, and failure to comply with such requests shall be sufficient grounds for the termination of the contract, as provided for in this article or Article i~iere- of . Should the contractor be delayed in the prosecution or completion of the work by the act, neglect or default of the county or engineer in charge, or of any other cont~aetor employed upon the, work, or by any damge caused by fire or otYier casulty for which the Contractor is not responsible, or by combined action oi° workmen, in no way cause by or resulting from default or collusion on the part of contractor, then the time herein set for the completion of the work shall be ex~ tended for a period equivalent to the ti~ae lost by reason of any or all of the causes aforesaid, which extended period shall be determined and fixed by the county, whose determination shall be final, but no such allowance shall be made unless a a~laim therefor is presented in writing to the county within ten (10) days after the occurence of such delay, X1. It is further mutually agreed 'aetween the parties hereto that no certificate given or payment made under this contract, ex- cept the final certificate or final payment, shall be evidence of the performance of this contract, either wholly or in part and that no payment shall be construed to be an acceptance of defective workor improper material which may appear within two (2) years after such payment. -6- X11. The contractor shall. give his personal attention to the wads at all times, and shall be present, either in person or by duly authorized representative, on the site of the work continually during its progress and shall receive instructions from the engineer in charge, Any sub-contractor sha11 be considered the agent, of tha contract- or and the latter shall be responsible for any indebtedness incurred by such agent, If any sub>contractor fails to perform his work in a satisfactory manner, his sub»contract may be terminated by the County. X1V. The contractor shall be liable for all damages and injury which shall. be caused, or which shall occur to any person or persons or property whatsoever, by reason of any negligence of said contractor or any of his servants, employees or sub-contractors, or by reason of any breach or violation of any of the provisions of this agreement, or any of his duties or obligations thereunder. The contractor shall also assume all liabilities for and protect the county from any damages or claims arising from thle uses of s.ry patended articles or devices in any part of the work. It is further agreed that the contra.etor herein, or any sub-contractor or contractor employed by them, shall be subject to the provisions of said act as provided and required in Secion 17 thereof. It is part of the public policy of the State of Washington, that all work by contract or day labor done for it, or any political subdivision created by its law, shall be performed in work days of not more than eight (8} hours each, except in case of extrodinary emergencies. No case of extraordinar~r emergency shall be construed to exist in any case where other labor can be Found to take the place of the labor which has already been employed for eight (Sj hours in~any calendar day. In case of the violation of the provisions of this article, the county shall have the right to cancel this contract without notice, and shall have the right to complete the work in the mannerprovided in Article 1V hereof.
