The Contractor shall provide and be at the expense of all materialse! labor, carriage~tools~implements and conveniences and things of every description that may be required for the transfer of materials and for improving,oonat rutting and completing the work above described. IIIe It is understood and agreed by and between the parties hereto that the work included in this .contract is to be done under the direction and supervision of the County Engineer dr construct ion engineer, who may be designated ae the Engineer in Charge by the Bow, and hereinafter called. the Engineer, and-hie decision as to the true construction and meaning of ,the. profiles, maps, plans, and specidication$, and a;stimatesa shall be final.. It is also understood and agreed that such additional drawings and explanations as may be necessary to detail. and illustrate the work are to_be furnished by the engineer, and the. Contractor agrees to conform, to and abide .by .the same, so far as xaay be consistent with the purpose and intent of the ,original drawings and pecificationa. IV. Should the Contractor at any time refuse or neglect to supply a, sufficiency of .proper. skilled workmen or of material$ of the proper. quality, or fail in .any respect to prosecute the work with promptness and diligence, or fail in any respect in the performance of any of the agreements herein contained, the Board. shall be at liberty, after three days written notice to the Contractor, to provide any such labor or materials and to. deduct the cost thereof from any money then due or there-~ after. to deeome due to the Contractor under this agreement; and if the Engineer Shall certify that such refusal, neglect or failure, is suffic- ient ground for such. act ion, the .Board nay= by written notiQe, terminate the employment of the Contractor for. the said work, and enter upon the premises and take possession of all the materials,tools, and appliances thereon for the purpose of completing the work included under this contrac~ and employ by contract or otherwise, any other person or persons ~o finish the work and provide the. materials therefor; and. in case of such discontinuance of the employment of the eantractor, he shall not be entitled to receive any further balance of the amount to be paid. under this. contractuntil the work shall be whaxlly finished, at which time, if the unpaid balance of the amountto be paid under this contract. shall exceed the expense incurred by the Board in finishing the work, aueh'excess shall be paid by the Board to the Rontractor; but if such expense shall. exe.eed such unpaid balance, the Contractor shall pay the difference t© the Board, The Contractor agrees to complete all the work called for under this f eommtract, in all .parts and requirements .before the 30 ~- .
