" The specifications under the heading of "gravel" have been .changed as follows; A rider has been attached which provides that the price to be ~~aad for additional gravel shall be based upon the price in the preliminary estimate, which price shall be adjusted in the same ratio that the lump sum price bears to the preliminary estimate. The sentence describing the location of the gravel pit near station 4 has been stricken. It is not advisable to specifjT gravel pit in your specifications, the idea being that the con- tractor shall assume the responsibility of finding gravel that wi~~. conform with the specifications. In the event that a gravel pit were specified and did not. prove satisfac- tory, the contractor might be put to an additional expense, and file a claim for such extra expense against the county. The atbarney general has ruled that an appropriation cannot be anticipated, therefore, you cannot. at this time ob- ligate permanent highway funds that may become available in the future. It is probable that the legislature now in session will pass the permanent highway appropriations with an emergency clause attached, and that the funds will become available about April lit, 1917.- Part of the cost of a permanent highway may be paid from your general road and bridge fund. Estimates should be submitted to this office in triplicate. One copy when approved will be returned to your county auditor for pay- merit of the county's portion of the cost. No case of extraordinu•ry emergency sha?1 be construed to exist in a~ case where other labor can be found to take the place of labor which has already been employed for eight hours in any calendar day.
