Chairman B.G. Brown called the meeting to order with all Board
members present.

Commissioner Pitts reported that the Washington Lung Association has
a film available which is specifically designed for teenage girls
called the "The Feminine Mistake", which talks about the effect of
nicotine and smoking on the body.
DIRECTOR OF NURSING REPORT: Charleta Handly, Public Health Nurse
reviewed the Nursing Report prepared by former, Director of Nursing,
Gretchen Gephart, noting the following:
* Well Child Clinics were down due to the holidays.
* Immunizations were down, but the flu season is almost over.
* School services were down due to school closures for snow.
* Nancy Smith is continuing the pre-school and school classes
since Gretchen Gephart left. She will be presenting the
Buckle Up Program and the "My Body Machine" program.
* Adult health services were up last month.
* Gretchen Gephart did a presentation on AIDS for the
community.

HEALTH OFFICER REPORT: The Tuberculosis patient in the West
End of the County will be recovering for the next 18 months but will
be able to return to work in a month or two. The Clallam County
Nurse that works in the West End is monitoring this patient.
Dr. Fischnaller then reported that a new test is available for
Chlamydia trachomatis which is becoming a increasing public health
problem, and asked if the Board would consider offering this test
through the Health Department. The Board indicated that they would
put it on a future agenda when medical items are assigned a priority.
ENVIRONMENTAL HEALTH DIRECTOR REPORT: Randy Durant reported in
addition to his written reported that the following services were
provided by the Environmental Health Section in November:
* Only two food inspections were performed in the County
during November.
* Nine septic tank permits were issued.
* There were 27 site evaluations performed during November
compared to 11 in November of 1984.
* Two short plats were reviewed and approved.
* Two well site inspections were performed during November.
* One final inspection of an on-site sewage disposal system
was performed.
* Training of the new staff person continued during the month.
* The workload increased in November and further workload in-
crease is anticipated through the month of January. Some
special projects that are coming up include the Port
Townsend Paper Company Sludge site application for next year
as well as solid waste permit renewals for the County
Landfill and the Port Townsend Paper Company, and the
Quilcene Bay project.
Gael Stuart added that there has been an increase in the income over
what was anticipated and budgeted for 1985, for the entire Environ-
mental Health Program. The only place in this program that had an
income drop was in the grocery and meat market permit which renew in
December.

complimented Public Health Nurse, Char1eta Handly on the job she has
done since Gretchen Gephart left, in keeping the Nursing Service on
an even keel.

Time Oil Company re: Appeal of Jefferson Co. Ordinance 2-77,
Sec.4.1A; Public Restrooms: Gael Stuart read a waiver request letter
submitted by Dale D. Hendrickson, Project Coordinator for the Time
Oil, Jackpot Food Mart proposed for Port Townsend, which outlined
thecompany's proposal for one unisex restroom inside the store
instead of the two restrooms required.
Randy Durant reported that there is no seating in the store for on-
site food consumption and he supports the issuance of this waiver.
After discussion of this requirement of Ordinance 2-77, Commissioner
Dennison moved to grant the variance as requested by Time Oil, and
supported by the Environmental Health Director. Commissioner Pitts
seconded the motion.
Letter from Communi tv Action Council re: Consolidation of
Senior Citizens Activities in the Recreation Center in Port Townsend:
Peter Simpson, Director of the Clallam-Jefferson Community Action
Council, has submitted a letter requesting that the
Health Department assist in making the Port Townsend Community Center
(Recreation Center) a focal point for Senior Citizen services and
activities, Gael Stuart reported.
Currently the Foot Care program is taken into the area Nursing Homes
and Senior Citizens apartments and provided at the Episcopal Church,
Gael Stuart added. Charleta Handly will check into the effects
moving this program would have on the services provided, and discuss
a possible move with Warren Steurer, Director of Parks and Recrea-
tion.
Letter from Clallam County Health Department re: Contractual
Agreement to provide Nursing Services to the West End of Jefferson
County: Clallam County will provide nursing services for the
residents of the West End of Jefferson County for the same
contractual amount as last year, Gael Stuart reported. Gael Stuart
will complete a contract for the approval of both Counties' Commis-
sioners.
Status of Quilcene Bay 205 J proposal: The 205-j grant has
been approved and should be forth coming, David Goldsmith, Director
of Planning/Building Department reported. A proposal is also being
submitted for a grant through the DOE for shellfish protection. If
this grant is approved it will be used to deal with Quilcene Bay and
the 205-j grant will be rewritten to deal with Hood Canal, which is
what it was originally meant to do. The State has indicated that
they would agree with this.

Gael Stuart reported that a system for reporting time spent on
working on activities related to the 205j Grant will have to be
designed, so that this time can be used for the County's matching
funds.
Environmental Health Position: David Goldsmith reported that
the Environmental Health position has been offered to a Mr. Joseph F.
Herzig from Oregon. Mr. Herzig will advise of his acceptance or
rejection of the position by the end of the week. If he accepts the
job he will not be able to start work until February.
Household Wastes: Randy Durant handed out information on
Household wastes that are available to the public through the Health
Department.
APPEAL re: Site Evaluation unacceptabilitv - Lot 79, Irondale
Acre Tracts: D. Schultze: Mr. & Mrs D. Schultze were present when
Randy Durant explained that a site evaluation was made for Lot 79 of
Irondale Acre Tracts in September of this year. The lot is 4.8
acres, which is currently divided into two tax parcels. One parcel
is owned by Mr. and Mrs. Schultze and the other is owned by their
son. Twenty two soil log holes were evaluated on the upland portion
of the property which found the soils unacceptable for on-site sewage
disposal with a high seasonal water table also noted. On 9/26/85 a
second site evaluation was done on the east end of the property which
was in an area where dredging from the canal that runs between Indian
Island and the mainland were dumped, and the soils were found to be
excessively permeable and unacceptable and the proposed drainfield
area was within the 100 year flood boundary.
Randy Durant further reported that he and Dr. Fischnaller
had meant with Mr. & Mrs. Schultze in November regarding these
evaluations and discussed the possible alternatives for this lot and
suggested that they provide additional soil lots from another portion
of the property. The Schultze's were advised that they could make an
appeal at this meeting.
Mrs. Schultze, speaking for herself and her husband, presented an
aerial map of the area which was done in 1984 by the Army Corp of
Engineers. This Canal, Mrs. Schultze stated was built in 1915 by the
Army Corps of Engineers and the State owned the tidelands. Twelve
feet of dredgings was dumped on these tidelands. Mrs. Schultze asked
that the County records be corrected to reflect the correct section
and township which should be Section 7, Township 29N Range 1E
(County's records show Section 12, Township 29N, Range 1W).

Schultze stated that they are confused about the denials they
given by the Health Department because:
The soil types are supposedly unacceptable because of a
possibility of contamination of drinking water, but a water
supply is currently being brought into this area by the County,
City of Port Townsend and local residents.
* Being within the 100 year Flood boundary: At high tide Mrs.
Schultze advised that they had checked the lower eight soil log
holes and none of them had standing water in them. These holes
were checked once a week from October through November and they
never had water in them.
* Mrs. Schultze also questioned the building being permitted on
the Bridgehaven spit which is all on a filled area.
* Mrs. Schultze further stated that they feel and hardship is
being placed upon them which they do not understand.
* a printed explanation sheet telling the property owner of the
procedures for appeal and what their options are if they are
denied would be a good thing for the County to provide to
people, with a list of engineers who do acceptable work in this
area.
Chairman Brown thanked Mrs. Schultze for the effort she put forth in
putting together her presentation. Commissioner Pitts advised that
he would like to see the site before making any decision on this
appeal. Commissioner Dennison added that he feels Mrs. Schultze
point was well taken about a written information sheet to given out
to property owners regarding procedures if property is denied.
Randy Durant will set up a site inspection for the Board after the
first of the year, and notify the Schultze"s so they can be present
if they wish.
APPEAL reo Lots 1 and 2, Edsal Short Subdivision: Unacceptable
for on-site sewage disposal: Roy Robeck, Ed Haycock and Pat Thompson
all representing Port Ludlow Realty were present when Randy Durant
outlined this appeal regarding the Edsal Short Subdivision.
In October 1984, this short subdivision was first evaluated for a
sewage disposal permit requested by Michael and Suzanne Kirkum on Lot
2. This parcel is approximately 2 acres in size with an area usable
for a home and an on-site sewage disposal system located on the upper
west end of the lot. This usable area is 123 feet wide by
175 feet to a steep drop off. Four soil log holes were evaluated and
found to be unacceptable because of poor soils, high seasonal water
table and lack of sufficient usable area for a three bedroom home
which was proposed for the site.

An application was made for a sewage disposal permit on Lot 1 in
October of this year. The lot is approximately the same size as lot
2. Six soil log holes were evaluated, three of which were accept-
able. The three soil logs that were acceptable, however were on or
bordering the property line which borders the Jefferson County right-
of-way. Randy Durant recommended that an off site sewage disposal
system be considered or the possibility of hooking into the Pope and
Talbot sewer system. The original short plat was approved in 1981
with a "Notice to Potential Purchasers" attached.
Mr. Roy Robeck stated that this short subdivision is basically 4
acres which in order to be subdivided had to have Health Department
approval and now when people want to build on these parcels they are
getting denied by the Health Department.
Dr. Fischnaller asked if Mr. Robeck was aware that the second notice
to potential purchasers states that "approval of this subdivision
does not constitute approval of each lot for on-site sewage disposal
systems". Mr. Roy Robeck advised that he is aware of this notice.
A few activities has occurred that have changed the site conditions
of these lots since 1981, Randy Durant reported. A portion of one of
the lots has been logged and cleared and a driveway has been put into
the lot. Mr. Ed Haycock disagreed with this information stating that
the driveway was placed on the property before the application for
short plat. at which time the property in that area was cleared.
Nothing has been done to the property since the application for short
plat.
Mr. Robeck further stated that the situation with the Pope and Talbot
sewage system is such that it will not be extended to ever include
this area for addition to the system.
Pat Thompson also stated that the option of seeking an off site area
for sewage disposal can not be used because there is no property
available for sale in the area. The basic issue of this short plat
is that people go through the time and expense of short platting a
piece of property and they believe that it is approved for a certain
number of lots that can be a homesite, the idea then is to not have
to purchase additional property somewhere else to put a drainfield on
so that the plat is usable. In this case, Ms. Thompson added, there
is a short plat which was given approval by the County, and now there
is no usable property in that short plat.
After further discussion of the conditions of the property when it
was short platted and the meaning of the term "conditional approval"
and the County's responsibility or liability in this regard, Mr.
Robeck finally added that he has read that the County can use some
additional tax dollars and by helping with this short plat two houses
could be built on two sites that were approved for a short plat and

the County can get additional tax dollars, but by denying this the
County will lose these additional tax dollars. Commissioner Pitts
reminded Mr. Robeck that the County Commissioners' charge is health
and safety and that the Commissioners can not trade revenue for a
potential problem.
Chairman Brown advised that a site inspection of this short plat
could be done the same time that the Board will be inspecting Mr. &
Mrs. Schultze's site since they are in close proximity. Mr. Haycock
will be advised when this inspection will take place.
