Joseph Fischnaller, M.D. Gael Stuart, Administrator All members, except Mrs. Bee, were present when Chairman Brown called the meeting to order. MINUTES: Commissioner Pitts seconded Commissioner O'Meara's motion to approve the minutes for the December 15, 1982 meeting. Unanimous. WAIVER REQUEST, WATER SYSTEM, LITTLE LEAGUE PARK, QUILCENE: Mr. Stuart read a letter to DSHS, Water Supplies and Waste Section (attachment 1) re- questing a waiver to the 100 foot control radius for the well. This request is made as a result of a survey which indicates the well is located only 85 feet from one of the property lines. VARIANCE REQUEST, BREAD AND ROSES BAKERY: Frank D'Amore was present when Mr. Stuart read his written request (attachment 2) for a variance to Section 4.1.a of Ordinance 2_77, allowing this business to operate with only one restroom facility. Mr. Durant recommended approval of the variance, since there will be no food served for consumption on the premises, restroom facilities will be available for employees, and public restrooms are located a short distance away. Commissioner O'Meara made the motion, seconded by Commissioner-Pitts and unanimously approved, to grant the variance. ON-SITE MANAGEMENT AGREEMENT, GARDEN COURT APARTMENTS: Mr. Durant reported that this agreement is not ready tor approval at this time. PROFESSIONAL SERVICES CONTRACT, JOSEPH FISCHNALLER: On che motion by Com- missioner O'Meara, seconded by Commissioner Pitts, Chairman Brown signed this contract (attachment 3) for services as Health Officer for the calen- dar year 1983. Mr. Stuart reported that he is negotiating the contract with Clallam County for West End services and for Environmental Health Specialist John Hayes. All other professional services contracts for 1983 will be acted upon by j the Board of County Commissioners at their regular meeting. NURSING DIRECTOR REPORT: A written report (attachment 4) of services for December, 19~2, as well as year-end figures, was reviewed by Mr. Stuart. Health Board, January 19, 1983 Page 2 ENVIRONMENTAL HEALTH DIRECTOR REPORT: Mr. Durant briefly reviewed figures ~n ~s wr~tten report attac ment for the month of December and for 1982 as a whole. He pointed out that actual revenues for 1982 exceeded antici_ pated revenues. Mr. Durant noted that the two mound systems in the County have some water infiltration due to the heavy rains, but that the problem can be Corrected. One of the mound systems is not in use yet, and the effect of construction around it is being monitored. PROPOSED AMENDMENTS TO WAC 248-96: Mr. Durant presented a draft of the pro- posed amendments to the State regulations regarding on-site sewage disposal (attachment 6) which will be adopted by the State Board of Health on February 9, 1983. Amendments which will impact on Jefferson County were discussed. Mr. Durant stated that any comment regarding these proposed revisions should be forwarded to the State Board of Health as Soon as Possible. No comments were formulated. ORGANIZATION OF BOARD OF HEALTH: Following brief discussion, Commissioner O'Meara made a motion to retain Commissioner Brown as Chairman of the Health Board. Commissioner Pitts seconded the motion. To: The Jefferson County BObrd of health Jefferson County Court House Fort Townsend, WA I am submitting this letter to the Jefferson County Board of Health to request a varience from Jefferson County Ordinance 2-77, Section 4.1.a, requiring toilet facilities for each sex in all food service establishments. I make this appeal based upon Section 7.3, which permits 6 waiver of any section of this ordinance if it causes a hardship on the operator and it can be shown that no health hazard will result. As I will not be offering "sit down" dining or providing utencils for the consumption of baked goods on the premises, I feel that one restroom, as per plans, will be adequate. To require the construction of a second restroom would create an extreme financial hardship for me. In addition, this bakery is in close proximity to the public bathrooms at the police station. The bakery is called Bread and Roses, and is located at 230 Quincy. Take such action as is necessary to maintain health and sanitation supervision over the territory within his jurisdiction; C. As an independent Contractor. it is understood that the Department is not responsible for payroll deductions such as Income Tax. Social Security. etc.. and the Contractor must make arrangement. according_to Internal Revenue Service directives. for payment of such tax as may a?ply. 5. The Department will pay the premium for Professional Liability Insurance necessary for the Contractor to carryon the duties of the Health Officer. If the Contractor accepts employment with another agency. the ~epartment will be reimbursed for the premium in an amounty directly proportional to the amount of time employed in the new agency.
