Permanent Highwa.y No.4.-B, Final Aooeptanoe.
There is herewi th enolosed oOPY of report of
Mr. W. H" Yeager, Jr., D1striot Eng~,er for this department,
on Permanent Highway No.~-B relat1ve^~ocepting this improvement
as completed in aooordanoe with the plans and speoifioations.
It appears that the ditohes are not oonstruoted in
aooordanoe wi th thi~ seotion shown on the plans and that the
gravel surfaoing oontains 50% o lay, making 1 t unsuitable for
surfaoing material. The maximum amount of olay in the
surfacing should not exceed 15~.
I wish to adv1se that prior to the aooeptanoe of
this 1mprovement by this Departpleat, it will be neoessary
to oonstruot the ditohes to the full ditch seotion as shown
on the plans and to plaoe three or tour inohes of fine gravel
on the present surfaoing in order to eq~l1ze the surplus of
clay in the material that has been plaoed.

aocepting this permanent highway as completed, and find the

The material used for surfaoing is a very poor grade
of hard pan gravel oontaining not less than 50% olay, making it
an unsatisfaotory surfaoing material.
Would recommend:- That three Or four inohes of fine
gravel be plaoed on this highway to equalize the surplus of
olay in the material that has been plaoed.
Also that Contraotor be required to oonstruct ditohes
to full ditoh seotion as shown on plans.

. the plans and specifioations of Permanent Highway '+ B., a.nd order-
ing a new survey, whioh I trust will meet with your approval.
'rhe objeot of the proposed change is to lessen the gra.des
on the lower end of ,the survey, by t~lrowing t:H~ line higher up on
the hillside; this change wi])l be cf still greater advantage to
the proposed extension of 4 B, which will eventually continue the
line Northward.
It is the intention of the Commissioners to prov1de a
tie-road into the main County road, a~ was planned on the original
survey.
The survey crew w11.1 sta.rt ...,'ork immediately, and, if
for any reason the ohange does not meet with your approval, I
would. like to to be aclvised. as soon as possible.

Puget Mill Compeny to the County of Jefferson - one of vhich conveys right-of-way
for a portion of the new road between Quilcene and Port Tovmsend, end the other
for the new road into Tarboo; Bay.
We wish tb call your attention particularly to the fact that
the timber along the rights-of-way ment ioned is re served to Puget _Mill Company.
In previous ri~hts-of-way in this locality we have been subjected to trouble on
account of the Conunissioners or Contractors taking it upon themselves to dispose
of the timber which was cut on the right-of-way. We wish to impress this upon you
as it is of importance to us ani v.e trust this co ndi t ion of the agreement wi 11 be
adhered to.

Highway Commissioner, conforming in all ways to the specifications
adopted August 16th, 1909, by the American Society for Testing

MIXING. Approved mixing machinery may be used.
Hand mixing shall be done as follows: The Contraotor shall
provide water-tight platforms, of an approved size and form. The sand
and oement, each in its proper proportion, shall be thoroughly mixed
dry. Enough water shall then be added to make a plastic mortar.
After the Mortar has been brought to the pr6per consistenoy, the
broken stone, having previously been drenched with water, shall be
added. The mass shall then be turned with shovels at least three (3)
times, adding more \'Vater from time to time, until the mixture isplas-
tic and quakes under the blow of the tamper.
The concrete thus prepared shall be deposited in the forms
in uniform layers, of such thickness that it can be incorporated with
the one previously laid. It shall be so conveyed al1d pIa.oed that
there shall be no distinct separation of the differ6~'t ingredients.
Each layer shall be tamped with iron-shod tamping bare weighing not
less tha.n aight. pounds, The faces against the forms shall be well
spaded to giye a smooth even surface when forms are removed. All
mortar and concrete shall be used while fresh and before it has been
set. Any mortar or concreta that has taken an initial set shall be

facilities at all times for the inspection of the work by the County
or its authorized representatives. The said Contractor shall furnish
the County or its authorized representatives, without charge, samples
of materials used in construction as said samples may be re~uired, in

Should the Contraotor be delayed in the prosecution or oom-
pletion of the work by the act, negleot or default of the County or
Eng:;.fi."3er in oha.rge, or of any other contractor employed upon the work,
uf b:' any damage caused by fire or other casualty for which the Con-
tractor is not res)onsible, or by combined action of workmen, in no
way cause by or resulting from default or collusion on the part of
Contractor, then the time herein set for the completion of the work
shall be extended for a period equivalent to the time lost by reason
of any or all of the causes aforesaid, whioh extended period shall be
determined and fixed by the County, whose determination shall be fin-
al, but no such allowance shall be made unless a claim therefor is
presented in writing to the County within ten(lO) days after the
occurrence of such delay.
XI. It is further mutually agreed between the parties here-
to that no certificate given or payment made under this contract, ex-
.cept the final certificate or final payment, shall be evidance of the
performance of this contract, either wholly or in part, and that no
payment shall be construed to be an acceptance of defective work or
improper material which may appear within two (2) years after such
payment.

XIII. The Contractor shall not let, assign or trans:fer this

sent, in writing, of the County. The Contractor shall file with the
C.:."..nty a duplicate of all sub-contracts made by him as aforesaid.
The, Contra.ctor shall give his personal a.ttention to the work
at all times, and shall be present, either in person or by duly auth-
orized representative, on the site of the work continually during its
progrea'B, and shall receive inst;uctions from the ingi;neer in charge.
Any sub-contra.ctor shall be considered the agent of theContrao~tor,
and ,the latter shall be responsible for any indebtednass incurred by
such agent. If any sub-oontractor fails to parformhis work in a sa.t~
isfactory manner, his sub-contract may be terminated by tha County.
xtV. The Contra.ctor shall-be liable for all 'c;la.mages and
injury which shall be caused, or whioh shall occur to any person or
persons or property whatsoeveT, by reason of any negligence of said
Contraotor, or a.ny of his servants, emplo'Jes, or sub_oontractors, or
by raason of any breaoh or viola.tion of any of the pro'!:i.sions of 'this

It is mutuallY agreed b(jtween the parties hereto that any
payments of contributions due or ~equired by Chapter 74 of the Laws of
1911 (Industrial Insurance Act) or a.ny amendment thereof from the
State of Washington by virtue of or on aoaount of any of the work
covered by this contraot may be deducted ~y,the County from any pay-
ment or payments made to the Contractor herein, and that the sum or
sums so ieducted shall be determined each month upon the basis of the
wo:rk of said month.., and shall be made upon the proper written ord.er
