I~Turphy, of ~himacum wrote - Kreielsheimer Bros., and enclosed a waiver 3.n connection vrith right of way across-the properly and requested that it be signed. ode made known our attitude to them, but triey evidently- did not. receive the letter, as they vlrote to us a-short time ago enclosing another letter from r~r. IyTurphy concerning the ~i~nt of vray, and.he claimed that the road S~~asalready built, but gnat he eauld not get .~ - any ~.elp prom the County until he got the right of ~t7ay. ~~e have no gray of ascertaining whether or not there is a road and if so tivhat the field notes of the road awe across the property, and we vrould cer~ainly greatly appreciate any assistance you can give us in determining the facts, " If this rcad has been built and in use, vre feel disposed . to legally vest title, 3~ut not knowing anything -about the property, hesi'~ate to give a. blanket right of way across the land. . Qlympia Bre•~ring Company, t~lympia, ~ashin{;ton, Gentlemen: I have your far of the 16th instant, with referenve to road across the E~ of ~-i of Sec. ~3, Twp. ~~; N., R. 1 ~1., waiver for~~hich is asked ~or by Mr. F. H. Murphy of Chimaeum. The records of this office show th_~~t there is a private road crossing the above described land, known as the "Gibbs Lake Road". From inquiries whieh I have made, it appears that the road, has been open and travelled for twenty or thirty years. The part where it Crosses your land is of the typical old- fashioned wagon road kind, narrow and crooked, but further in, where it approaches the Murphy place the road has been improeed and is in excellent condition. .The last. mentioned part of the road has been improved by Mr. Murphy, partly at County expensed but when the attention of the County Commissioners was called to the fact that. the road .had never been dedicated, they re- fused to spend any more money on it, and Mr. Murphy has been compelled to keep the entire road open at his own expense. The County cannot legally spend money on a road until a right~of- way has been s~;cured and the road dedicated. I am also advised that the owner of the land between yours and Mr Murphy's has refused to grant a right-of-way unless yours was granted. I have no survey of-the road, but am quite sure that it crosses your land, and I am enclosing a road waiver of a type that will covsr the situation without more definite knowledge. Zf the road. is-ever changed to a surveyed location, the unused part or parts would, of course be abandoned. The granting of the right-of-way mould be a great favor to Mr. Murphy, and would be of some advantage to the other lands crossed, as-the entire road could then be maintained. at the County"s expense. Of course the present road is unnecessarily crooked, bit if a new road were built, it would probably follow the ss.me general direction. To illustrate, he old "Tdrboo roadn in this County was of the type that said to be laid ot~t by sailors, ~$d well diggers, because-it dent over the top of every high point and descended to every low point in the nei hbothood, with grad~;s running as high as 12 or 15 per cent. On relocation, a route was found with even grades of not to exceed 6 per cent., fo~:Iod~ing so near the line of the old road that it crossed and recrossed it, and nowhere was more than a few hundred feet distant. There is no such thing as a settlement or community in the vicinity of the ~durphy place, and no likelihood of a new road being located for ,nany yearn to Dome. If the neighborhood should be developed and more thickly Settled, an entirely different outlet might b be found necessary.. In the meantime, I look upon the Gib~;s Lake , road as a makeshift, which will probably play its part in getting settlers into tale country, ~.nd then be abandoned for a better location. I~urpYty, but on the other hand, we hesitate still. to sign a blanket waiver. Could- you tell us, or could you ascertain if it .was 'possible to locate a road along one side of this property rather than have it go wandering through. You can naturally realize that the road may-cut the land up in such shape as to reduce its value so we are anxious to get a location that would run along the edge if possible or through the center if it had to be so as to avoid un- necessary fencing and badly cut up fields. If you can assist us further, we would appreciate it.
