DE LEO CHAIRMAN VICE-CHAIRMAN MEMBER ALTERNATE RECONVENED 1988 BOARD OF EQUALIZATION M I NUT E S AUGUST 2, 1989 The Reconvened 1988 Board of Equalization heard petitions on two short plats from petitions filed in January 1989 for the year of 1988. Chairman A.C. Dalgleish, Member Archie Barber, Jr. and Clerk Dierdrei Keegan-Whiteford were present. The Board dispensed with the reading of the Minutes of previous meetings at this time. Vice-Chairman David G. Douglas was absent. BOE-088-097-LO PETITIONER: H. B. Maddox PARCEL NUMBER: 002-331-038 Petitioner H. B. Maddox was not represented at the petition was read into the record in his absence. represented the Assessor's office. hearing; his Bob Shold This parcel is Lot 1 (2.53 acres) of the Maddox Short Plat within Tax 13, Section 33, Twp. 30 N, R 2 W. It is located on Old Schoolhouse Road. The short plat was filed 9/18/87. The current valuation is $17,640. The petitioner submitted the following: 1. The parcel was purchased 10/29/86 for $12,500 and has been offered for sale for four years at $32,500. 2. The petitioner presented four maps locating parcels of acreage sold in recent years in Sec. 28, 33, and 34. The petition lists sales of tax lots and prices per acre. Bob Shold reported that the subject parcel is valued at $7,000 per acre for 2.52 acres equalling $17,640. He thinKs that it is significant that this petitioner is offering the parcel for $32,500 or $12,900 per acre. The Board will conduct an on-site inspection before making a determination. BOE-88-098-LO PETITIONER: H. B. Maddox PARCEL NUMBER: 002-331-039 Petitioner Maddox was not represented at the hearing; his petition was read into the record in his absence. Bob Shold represented the Assessor's office. This parcel is a 2.27 acre lot, Lot 2, Maddox Short Plat within Tax 13, Sec. 33, Twp. 30 N, R 2 W. It is located on Old Schoolhouse Road. The short plat was surveyed on 9/18/87. The current valuation is $15,890. The petitioner states that: 1. The parcel is valued at $17,640 or $8,018 per acre. 2. He lists saies of parcels in recent years in Sec. 28, 33; and 34 along with the prices per acre. 3. The thrust of the petition is that the valuation of the parcel should be at $5,000 an acre or $11,350 rather than $17,640. Bob Shold states that the current valuation is based on Land Use Code 4091 for 2.27 acres at $7,000 an acre equalling $15,890. He noted that the parcel is offered for sale at $32,500. The Board will conduct an on-site inspection before making a determination. BOE-88-099-LO PETITIONER: J. W. Levine PARCEL NUMBER: 002-342-040 The petitioner, J. W. Levine, was not his petition was read into the record represented the Assessor1s office. represented at the hearing; in his absence. Bob Shold This parcel is 2.47 acres and is Lot 1, Levine Short Plat No.1, Sec. 34, Twp. 30 N, R 2 W. The petitioner presented the following: 1. A map of Levine Short Plat No.1 in section 34. 2. Maps of Sec. 34 and 33. a) Sec. 33 indicated 14 parcels with prices paid per acre from $5,500 to $8,188. No dates of sales were included. b) Sec. 34 indicated 20 parcels with prices paid per acre from $2,500 to $11,364. c) Fifteen Real Estate Tax forms, recording the sales history, were also included. 3. The petition indicated that current valuation is based on $7,000 per acre for $17,290. It was requested that a reduction be granted at $5,000 per acre, for a total of $12,350. The petition also indicated that the parcel is offered for $32,500 or $13,158 per acre~ Bob Shold states that the parcel is valued under the Land Code at $7,000 an acre for a total of $17,290 for the 2.47 acres. The Board will conduct an on-site inspection before making a determination. BOE-88-100-LO PETITIONER: J. W. Levine PARCEL NUMBER: 002-342-041 Petitioner J. W. Levine was not represented at the petition was read into the record in his absence. represented the Assessor's office. hearing; his Bob Shold This parcel is 2.25 acres; it is Lot 2, Levine Short Plat No.1, which is subject to a 293.75 foot access easement from Old Schoolhouse Road in Sec. 34, Twp. 30 N, R 2 W. The plat approval was 8/22/88. The current valuation is $15,750. The petitioner uses the same maps and sales records as utilized for petition BOE-88-099-LO above. He uses these records to justify a reduction in valuation to $5,000 per acre or $11,250 rather than $15,750. Bob Shold states that the current valuation is based on Land Code 4091, which is $7,000 an acre for 2.25 acres with the total value being $15,750. Levine was not represented at the petition was read into the record in his absence. represented the Assessor's office. hearing; his Bob Shold This parcel is 1.58 acres; it is Lot 3, Levine Short Plat No.1, and is subject to an access easement through Lot 2 from Old Schoolhouse Road in Sec. 34, Twp. 30 N, R 2 Wand is currently valued at $12,500. The petitioner used the same rationale presented in Petition BOE- 88-99-LO, above, to justify a reduction in valuation from $8,900 per acre to $4,000 per acre for $6,320 total. The land is offered for sale at $28,500 or $18,038 per acre. Bob Shold responded that the parcel is currently valued under Land Code 1035 for $12,500 per site. The Board will conduct an on-site inspection before making a determination. BOE-88-102-LO PETITIONER: J. W. Levine PARCEL NUMBER: 002-342-043 Petitioner J. W. Levine was not represented at the petition was read into the record in his absence. represented the Assessor's office. hearing; his Bob Shold This parcel is 1.11 acres, and is Lot 4, Levine Short Plat No.1, Tax 54, Sec. 34, Twp. 30 N, R 2 W. It is subject to access through Lots 2 and 3 from Old Schoolhouse Road. The current valuation is $12,500. The petitioner referenced the same maps and sales of Sec. 33 and 34 as used in BOE-88-99-LO above. He seeks to justify an adjustment from $12,500 to $3,500 per acre or $3,885 for the parcel. Bob Shold replied that the current valuations are based on Land Code 1035. It is currently on at $12,500. He pointed out that this property has been offered for sale at $28,500 or $26,676 per acre. The current valuation is $13,090. The petitioner referenced the same maps and sales as used above in petition BOE-88-98-LO as justification to seek a reduction in valuation from $13,090 (at $6,889 per acre) to $9,350 at $5,000 per acre. The petition indicated a willingness to sell the property for $39,500 or $21,123 per acre. Bob Shold stated that the current valuation is based on Land Code 4091 for 1.87 acres at $7,000 per acre for a total of $13,090. The Board will conduct an on-site inspection before making a determination. BOE-88-104-LO PETITIONER: J. W. Levine PARCEL NUMBER: 002-331-041 Petitioner J. W. Levine was not represented at the petition was read into the record in his absence. represented the Assessor's office. hearing; his Bob Shold This parcel is 1.81 acres and is Lot 2 of Levine Short Plat No.2 which was approved 8/22/88. It is tax 14, Sec. 33, Twp. 30 N, R 2 W, with an access easement across Lot 1 from Old Schoolhouse Road. The current valuation is $12,670. The petitioner referenced the maps and sales used in the above petition BOE-88-99-LO as justification for reduction of valuation from $12,670 to $9,050 at $5,000 per acre. Bob Shold responded that the valuation is based on Land Code 4091 at 1.81 acres which is $7,000 per acre for a total of $12,670. He notes that the property is listed for $39,500 or $21,823 per acre. It is Lot 3 of Levine Short Plat No.2, which was approved 8/22/88. It is Tax 14, Sec. 33, Twp. 30 N, R 2 W. It has access through Lots 1 and 2 of the Plat from the Old Schoolhouse Road. The current valuation is $12,500. The petitioner referred to the same maps and sales utilized in the above petition BOE-88-98-LO for justification to adjust the valuation from $12,500 to $8,200 at $5,000 per acre. Bob Shold responded that the current valuation is based on Land code 1035 for $12,500 per site. He commented that the parcel is listed for sale at $39,500 or $24,085 per acre. The Board will conduct an on-site inspection before making a determination. OTHER BUSINESS OF THE BOARD There being no further business before the 1988 Board of Equalization, the Board moved to adjourn until the reviews for the Orders of the Board could be completed.
